Assistant Larry Revering, Water Superintendent Jeff Clausius, MIS Director Workshop --Called to order at 5:30 p.m. A Selection of a consultant for developing Impact Fees Barry explained that Requests for Proposal were not sent out due to the need to expedite the process, and reviewed with Council the two proposals that were provided in the Agenda Packet. Barry explained that staff recommended that the firm of James Duncan and Associates be selected. The proposed development of fees would be divided into two phases. The first phase is expected to cost no more than $25,000. That amount has already been budgeted for use on an impact fee study. Funds are also available from revenue of water sales during the drought last summer. The total project cost is expected to be approximately $90,000 for a "turn -key" operation to collect impact fees. Development of the fee structure will involve the appointment of two citizen committees and public hearings. (See Regular Agenda) T Pulled (See Regular Agenda) U Approval of payment of deductible to National Casualty Company for defense of public officials liability claim in the amount of $15,000/Marianne Banks Motion by Tonn, second by Curl to approve the Consent Agenda with the exception of Items S and T. Approved 6-0. Regular Agenda S Authorization for Mayor to execute Amendment No. 5 to Contract No. 701132, between the City of Georgetown and the Texas Department of Housing and Community Affairs to extend the termination date of the contract to June 6, 1994/Bob Hart (pulled by Bonner) Bonner thought that this item referred to housing rehabilitation, but actually refers to the loan through Texas Department of Housing and Community Affairs to Poly Resource Recycling. Motion by McMaster, second by Bonner to authorize the Mayor to execute Amendment No. 5. Approved 6-0. T Resubdivision of Oak Crest Ranchettes, Unit II, Lots 9 and 10, located at 310 through 320 Oak Ridge Drive/Ed Barry and Hildy Kingma (pulled by McMaster) Barry explained that the Planning and Zoning Commission had voted to approve this resubdivision. McMaster explained that he is concerned about the water pressure. Barry and Jim Briggs confirmed that the subdivision is fed by a 6" line, has been tested and meets fireflow standards. Voltz asked for confirmation that even if the residents of the area were concerned about the occasional pressure problems, there was still no legal, valid reason for the Council to deny the potential addition of five more houses onto this line. Due to the increased development in the area, Barry stated that there will be future applications, and at each application, investigation will be done to ensure that the existing utilities are adequate. Curl suggested that staff send a letter to the area residents explaining the issues involved in this approval. Motion by Voltz, second by Vincent to approve the resubdivision. Approved 5-1. (McMaster opposed) V Citizens wishing to address the Council Frank Parmenter of 4106 Sequoia Trail East spoke against Items AA and BB. Minutes of City Council Meeting April 12, 1994 Page 3 of 7 Pages Judith Moore of 301A Algerita asked advocate for hidden disabilities. the Mayor to appoint a committee to W Mayor, Council, City Manager, and staff comments and reports ® Reception for Southwestern University Interns - Tuesday, April 26, 5:00 - 5:30 p.m. in the Council Chambers Acting City Manager Sappington reminded Council of the reception. ® Clean Air 2,000 Award Sappington confirmed car pooling arrangements for attending the Awards Dinner on Thursday, April 14, where the City of Georgetown will be presented with an award of Environmental Excellence. ® Joint workshop meetings were tentatively scheduled between Council and Library Advisory Board for Monday, May 16, at 6:00 p.m. at the Library and with the Planning and Zoning Commission for Monday, May 2 for either 5:30 p.m. or 7:00 a.m. -- confirmation to follow. ® Sappington requested that Coleman have ready by Friday the packet for the Mayor and Councilmembers to use in promoting the proposed charter amendments to be included on the ballot for the General Election on May 7. Councilmembers and Charter Review Committee Members will speak to various citizen groups in order to familiarize citizens with the charter propositions. ® Voltz announced that she and Curl would be attending the "Tourism and Your Community" conference in New Braunfels on Wednesday, sponsored by the Association of Wholesale Customers and the Lower Colorado River Authority. Curl has been asked to speak on a panel discussion about the development of historical interests, and Hildy Kingma of Development Services has been asked to moderate a panel discussion about developing breakfasts and recreational vehicle facilities. X Selection of consulting firm to assist in preparing and adopting impact fees/Ed Barry Motion by McMaster, second by Tonn to approve a contract with James Duncan and Associates for two-phase preparation, with the first phase not to exceed $25,000. Approved 6-0. Minutes of City Council Meeting April 12, 1994 Page 4 of 7 Pages Y Consideration of a Development Agreement with Southwestern University/Marianne Banks Banks explained that Southwestern plans to begin some construction and improvement projects on campus consistent with their Facilities Master Plan which was approved by the Council in 1992, when the property was rezoned to RP. The first project will be the expansion of the Recreation Activities Center. Due to the fact that the City Subdivision Regulations were not applicable to development on a college campus, this development agreement was prepared to coordinate the planned construction and improvement projects to the Facilities Master Plan. Motion by McMaster, second by Bonner to approve the development agreement. Approved 6-0, Z Approval of an agreement with the Texas Department of Transportation for payment of the City of Georgetown's fixed participation of $1,000,000 for the construction of the northbound (east side) IH -35 Frontage Road/Susan Morgan Morgan reminded Council that they adopted a resolution in September of 1993 to commit the $1,000,000 for the construction of the frontage road. Approximately $400,000 will be paid from the proceeds of 1992 Certificates of Obligation, and approximately $600,000 will be paid through an investment from the Electric Fund and will be recovered from assessments of adjacent property owners. Motion by McMaster, second by Vincent to approve the agreement for payment. Approved 6-0. AA Consideration of a request to remand the preliminary plat of the Dicotec Subdivision, located on Williams Drive between Mariquita and Sequoia Trail, back to a special meeting of the Planning and Zoning Commission for reconsideration/Ed Barry and Hildy Kingma Motion by Tonn, second by Bonner to remand the preliminary plat back to the Planning and Zoning Commission for further consideration. Approved 6-0. BB Consideration of a request to remand the final plat of the Dicotec Subdivision, located on Williams Drive between Mariquita and Sequoia Trail, back to a special meeting of the Planning and Zoning Commission/Ed Barry and Hildy Kingma Motion by McMaster, second by Curl to remand the final plat back to the Planning and Zoning Commission for further consideration. Approved 6-0. CC Second reading of Ordinance 94-11 to extend the City's Subdivision Regulations from the current expiration date of April 30, 1994, to a revised expiration date of July 31, 1994, and recommended revision to the Subdivision Regulations/Ed Barry and Hildy Kingma Minutes of City Council Meeting April 12, 1994 Page 5 of 7 Pages Barry reminded Council that this ordinance extends the expiration date from the end of April to July 31, and informed Council that the Planning and Zoning Commission held the public hearing on the revisions to the Subdivision Regulations on April 7, and will act on this item at their May meeting. Therefore, it will come to Council for final approval in June. Included with the Subdivision Regulations will be the utility and fireflow standards. Barry read the caption. Motion by Tonn, second by Voltz to approve Ordinance 94-11 on second reading. Approved 6-0, DD Second reading of Ordinance 94-12 to rezone a portion of 52.72 acres in the Nicholas Porter and Joseph Pulsifer Surveys from RS, Residential Single Family to C -2A, Commercial First Height, Restricted/Ed Barry and Hlldy Kingma Barry reminded Council that they would see this same land area on an item at the next meeting for consideration to rezone the small portion left when this portion and that of the next item are approved. The owner has requested that it be rezoned in concert with the other two portions. Motion by Tonn, second by Vincent to approve Ordinance 94-12 on second reading. Approved 6-0. EE Second reading of Ordinance 94-13 to rezone Riveroaks of Georgetown Office Park Subdivision from RS, Residential Single Family to C -2A, Commercial First Height, Restricted/Ed Barry and Hildy Kingma McMaster confirmed with Barry that the "restricted" on C -2A still allows for residential development. Motion by McMaster, second by Curl to approve Ordinance 94-13 on second reading. Approved 6-0. FF Second reading of Ordinance 94-14 to rezone a portion of 259.4 acres in the Nicholas Porter and Joseph Pulsifer Surveys from RS, Residential Single Family to C -2A, Commercial First Height, Restricted/Ed Barry and Hildy Kingma Barry explained that this rezoning was requested by the developers of the Rivery. Motion by McMaster, second by Voltz to approve Ordinance 94-14 on second reading. Approved 6-0. GG Appoint one member to Convention and Visitors Bureau/Ron Coleman Coleman reminded Council that the letter from the Heritage Society recommending that Miriam Baker be appointed had been provided for them on Minutes of City Council Meeting April 12, 1994 Page 6 of 7 Pages the Bias. Motion by McMaster, second by Tonn to approve the appointment of Miriam Baker to the Convention and Visitors Bureau. Approved 6-0. HH Second reading of Ordinance 94-15 amending sections 2.60.020 (composition) and 2.60.030 (Ex Officio Members) of the Georgetown Municipal Code regarding the requirements for the Electrical Examiners Board/Ron Coleman Motion by Tann, second by Vincent to approve Ordinance 94-15 on second reading. Approved 6-0. *(It was determined after the meeting that this item for the Executive Session had been inadvertently included on this agenda and was not intended to be discussed at this meeting.)
