Council Members Present: Ferd Tonn Mike McMaster Jane Voltz Doris Curl Dick Vincent Staff Present: Council Members Absents Leo Wood, Mayor Winfred Bonner I •- Carranco Bob Hart, City Manager Elizabeth Gray, City Secretary/Dir. of Management Services Ed Barry, Dir. of Development Svcs. Hildy Kingma, Chief Planner Regular Session --Called to order at 8:25 a.m. A Approval of final plat of Lake Aire Subdivision, Section Two, located at 2415 Williams Drive; and variances to the Subdivision Regulations/Ed Barry and Hildy Kingma Kingma informed Council that Planning and Zoning met this morning to approve the final plat and variances listed. Motion by Tann, second by Vincent to approve the final plat and variances. Approved 5-0. B Approval of Environmental Protection Agency (EPA) Municipal Water Pollution Prevention Environmental Audit Report for San Gabriel Wastewater Treatment Plant/Jim Briggs and Kirby Chaney Briggs explained to Council that these reports are important and are given careful scrutiny by the EPA, hence the requirement for Council approval. Motion by McMaster, second by Curl to approve the reports. Approved 5-0. Minutes of City Council Meeting December 17, 1993 Page 1 of 2 Pages C Approval of a development agreement regarding the park land dedication for the final plat of Fountainwood Estates, Phase 2 Subdivision and future phases of the 474 acre Fountainwood Estates Development/Ed Barry and Marianne Banks Kingma introduced the item to Council. Motion by Tonn, second by Vincent to approve the development agreement. Approved 5-0. Council Members Present: Ferd Tonn Mike McMaster Winfred Bonner Jane Voltz (arrived late) Doris Curl Dick Vincent Lupe Carranco Staff Present: Bob Hart, City Manager Marianne Banks, City Attorney Sandra Lee, Deputy City Secretary Regular Agenda A Citizens wishing to address the Council Council Members Absent: Q B Mayor, Council, City Manager and staff comments and reports ® Governance Workshop on Monday, January 17, 4:00 p.m. to 10:00 p.m. Hart told Council that they have scheduled governance training with a consultant, Gene Royer. ® Partnership Meeting at Berry Creek C.C. on January 19, 10:30 a.m. to 1:30 p.m. ® Curl announced to Council that the Heritage Society was able to get the HVAC for Grace Church donated by Airco, Inc. C Approval of a resolution authorizing the City Manager to execute a deed conveying Lot 1, Block 1 of Lakeaire Subdivision, Section l/Bob Hart Hart explained that the title company needed more clarification of Council's intent. Motion by McMaster, second by Tonn to approve the resolution. Approved 6-0. (Voltz absent) Minutes of City Council Meeting December 28, 1993 Page 1 of 2 Pages D Authorization for the Mayor to execute a development agreement with Hal Leverson and/or TIAL Investments/Marianne Banks Banks explained to Council that Leverson will file suit in District Court in order to take action prior to the statute of limitations deadline. No agreement could be reached at this time. A development agreement will be brought to Council at a future meeting. Executive Session --Called to order at 5:40 p.m. E Sec. 551.071 Consultation with attorney F Sec. 551.074 Personnel matters Performance evaluation of the City Manager, performance evaluation and administrative review of the City Attorney, and administrative review of the City Secretary Regular Agenda --Called to Order at 9:22 p.m. G Take any action necessary regarding threatened litigation/Marianne Banks No action was taken by Council. H Take any action necessary following evaluation of City Manager and City Attorney and action related to the appointment and duties of the City Secretary and Deputy City Secretary/Mayor Wood Motion by Voltz, second by McMaster to appoint Sandra Lee as City Secretary, and Elizabeth Gray, Cari Speegle, Donna Hogg and Mary Rodriguez as Deputy City Secretaries; and review specific responsibilities of the City Secretary in about a month. Approved 7-0. Motion by Voltz, second by McMaster to award one-time bonuses (in lieu of raises) to former City Secretary Elizabeth Gray in the amount of $1,000, City Attorney Marianne Banks in the amount of $2,000, and City Manager Bob Hart in the amount of $2,500. Approved 7-0. The three were allowed to decide whether they wished to have their bonus checks before or after the New Year. It was pointed out that the Manager and Attorney have not had raises in the past two budget years. I Final comments and evaluation of meeting process Mayor Wood stated for the record that a sign-up sheet to speak had been turned in by Ed Steiner, but he was not present when the Council came out of executive session.
