Council Members Present: Staff Present: Bob Hart, City Manager Marianne Landers Banks, City Attorney Sandra Lee, Deputy City Secretary Donna Rogers Hogg, Legal Assistant SESSION -r to!•- 1•rE MembersCouncil Absent0. t •ld The Mayor/Mayor Pro -Tem announced that the Council Would recess to Executive Session to discuss real estate pursuant to 6252-17, Sec. 2(£),.'•C S• 910345 Sec.2(f) Real Estate Discussion of potential acquisition of Lakeway Property(ies)/Marianne Banks REGULAR SESSION Council returned to the Council Chamber and the Mayor reopened the Regular Session at 12:47 p.m. and asked for any action by Council concerning the item discussed in Executive Session. Motion by McMaster, second by Tonn to acquire the land on Lakeway Drive at a value previously discussed by Council in Executive Session. Mr. Frank Hubbard of 2503 Gabriel View Drregistered to speak� Mr. Hubbard declined to officially address Council, but spoke intermittently during the discussion. Bob Hart stated that during processing of two lawn exemption applications, staff discovered problems with the procedure specified in Ordinance 91-11. When contacted, many neighboring property owners decline to file a written objection, so that written responses received do not give a clear indication of the overall feeling. In these two instances, some have protested against the applications and some have protested against the procedure itself, stating that they do not want their names released for fear of alienating their neighbor, and do not want their names released. Mayor Connor reiterated that the Council did not intend to put neighbors into conflict with each other and also pointed out that a of time limit for granting the exemption had not been included in the ordinance. Winfred Bonner is concerned about the urgency of taking action immediately. He agrees that the current ordinance is unclear, but prefers to take no action today. He would like to see it brought back to Council for a decision at an evening meeting when more citizens would be able to attend and give input. Bob Schrawger asked if the sunset provision of the ordinance could be applied- to the time frame of the application as it applies to the duration of the ordinance. He also noted that for zoning purposes, the Planning and Zoning Committee posts a sign on the subject property notifying the surrounding property owners as well as other citizens in the area who may have an interest in the zoning of that lot. Mike McMaster added that no time frame in the ordinance was established for the City Secretary to approve or deny natural lawn exemption applications. Ferd Tonn asked if we could bring this issue back to the next Council meeting for discussion. Bob Hart said it would be brought back as an item on the next agenda with options presented from the staff based on today's Council discussion. Mayor Connor stated that, if the applicant is exempted, it will encourage the staff to respond quickly to the application. Mayor Connor adjourned the meeting at 1:13 p,ma Approved: Attest: W. H.
