On behalf of the entire Council, Councilmember Pearce expressed her sincere appreciation of the many long hours these individuals contributed to the Drug Task Force. PUBLIC HEARING - Call to Order 7:13 pm 900520 Hearing on the proposed annexations to the City's incorporated area/ Michael Lauer and Ed Barry R.B. Motherall, owner of one of the tracts of land proposed for annexation, sent a letter to the City Manager opposing annexation. Ed Barry stated that W.B. Jack R. Barnes spoke against annexation of his property located in the Southeast quadrant of the City. There were no more persons desiring to speak, and the Mayor closed the Public Hearing at 7:38. 900523 Resolution approving continued funding of the USGS water monitorm' g program for FY'91 /Jim Briggs 900524 Authorization to intervene in Docket No. 9749 (GTE statewide petition to the PUC for Extended Area Service S))/Marianne Landers Banks Councilmember Valdez filed a conflict of interest on this item. 900525 Resolution regarding treatment of LCRA rate case facilities lease payment/ Bob Hart Motion by Saegert and second by Schrawger to approve the consent agenda. Approved 7 -0 (Valdez abstaining on Item 900524). Minutes - 10/23/90- Council Meeting Bob Hart reviewed components of the proposed LCRA rate settlement now before the PUC, position of various intervenors, timetable for public hearings et a' to be held by the PUC, impact on rates approves the settlement, and other aspects of •, rate case. Councilmembers McMaster and Pearce noted that the CitVA's efforts to fi. t the LCRA have resulted co in much more favorable rates for the ity. 900535 Resolution approving a funding agreement with the Georgetown Heritage Society to operate the History and Visitor's Center/Liz Taylor and Hartley Sappington Alan Battersby explained to the Council why the Visitor's Center volunteers can no longer handle all of the administrative chores related to operating the Visitor's Center, and therefore request the City's support in funding a part time person to assume these duties. Motion by McMaster and second by Pearce to approve the resolution as read. Approved 7 -0. 900530 Ordinance regulating smoking in public places -First Reading/Marianne Banks Council requested that the City provide notification to businesses, in addition to the required publication of the ordinance in the newspaper. Motion by Pearce and second by Schrawger to approve the ordinance on first reading. Approved 5 -2 (Bonner and Saegert opposed). 900531 Approval of request by Diamond Shamrock to refund planning building fees/Ed Barry and Roy Green Motion by Schrawger and second by Saegert to refund $4252.50 to Diamond Shamrock and $37.25 to J M Utilities. Approved 7 -0. 900532 Update on the progress of the Balcones Canyonlands Habitat Conservation Plan (BCHCP)/Hildy Kingma and Ed Barry Hildy Kingma stated that, based on consultant's recommendations, approximately 78,000 acres will have to be purchased to create a preserve for the affected endangered species. The cost to the City is still unknown, and several funding mechanisms are being discussed for use by local governments to pay their share of acquiring and operating the preserve. One possibility is a Habitat Mitigation Assessment to be assessed against private and public development. The proposed entity responsible for administering the preserve may be called the Balcones Canyonlands Habitat Conservation Authority. She also reviewed key provisions of a draft bill authorizing enforcement and financing of the BCHCP. The Mayor instructed staff to see that any comments prepared by the attorneys working on this issue are entered into the record of the BCHCP Executive Committee, Minutes - 10/23/90- Council Meeting Jim Briggs reviewed the history of the City's application for a loan through the SRF. Financing through revenue bonds will probably cost around two percent more, but the City will avoid costs (time and money) associated with obtaining approval of the SRF application. Motion by McMaster and second by Pearce to approve the resolution as read. Approved 7 -0. 900534 Approval of ordinance creating a Tax Increment Financing District (TIJF) on the Rivery to be known as Reinvestment Zone No. 1 -First Reading/Ed Barry Motion by Saegert and second by Schrawger to approve the ordinance as read on first reading. Approved 7 -0. 900536 Ordinance repealing a taxicab and bus franchise ordinance and adopting a new ordinance regulating taxicabs, busses and other vehicles for hire -First Reading/ Marianne Landers Banks John Hudgens indicated to Council his interest in starting a taxi service in Georgetown. Motion by Pearce and second by Schrawger to approve the ordinance as read on first reading. Approved 7 -0. 900537 Resolution appointing members of the Subdivisions Regulations Advisory Committee to conduct the 1990 sunset review of the Subdivision Regulations/Ed Barry and John Warden The Mayor recommended appointment of Patty Eason (Chairperson), Karen Gilbert, Bobby Stanton, Ercel Brashear, Luther Laubach, and Councilmembers Bob Schrawger and Ferd Tonn. Motion by Schrawger and second by Pearce to adopt the resolution as read. Approved 6 -1 (Saegert opposed). The Mayor called a recess into executive session at 10:07. Police car bids will be included on the agenda for that meeting. There will be a joint P &Z /City Council breakfast on Thursday, Nov 15 at Southwestern University, The Mayor adjourned the meeting at 10:57 pm.
