Approved 6 -01 Council Minutes - Regular Session - 9/11/90 Page 1 of 6 pages Regular Agenda 900426 Revocation of special permit for the operation of a 8th St./Ed Barry Councilmember McMaster pulled this item opposition to the special permit, he wanted to mE permit was now being revoked. There were no citizens wishing to address the Council. 900430 Mayor, Council, and City Manager comments and reports. Councilmember Valdez asked that wood burning in the barbecue pit behind the Community Center be restricted due to safety hazards. Councilmember Pearce asked Council approval for the City to sponsor several individuals to attend the 1990 Adult Leadership Conference sponsored by Texan's War On Drugs. Councilmember Schrawger attended the TML Region X meeting last week, including a workshop on the Open Meetings Act, at which TML's attorney stressed the importance of avoiding possible deliberations outside of open session, including even casual meetings. City Manager Hart reported that Georgetown was one of three cities selected by LCRA for participation in a pilot weatherization program. Also, it appears that there is a tentative settlement with the New Braunfels group and other intervenors in the LCRA rate case. 900431 Resolution and proclamation to designate Thursday, Sept. 13, 1990 as DARE day/Hugh Anderson Motion by McMaster and second by Pearce to approve the resolution. Approved 6 -01 900432 Presentation on take -home vehicle program for police/Hugh Anderson Police Chief Anderson reviewed the history of one -to -one fleet policies nationwide and the City's history of police vehicle purchase and maintenance. The take -home policy is recommended for the City of Georgetown because it is associated with reduced service and maintenance costs, increases officer pride and morale, provides crime deterrence, and is a cost - effective alternative to increasing the size of the police patrol force. In response to questions from Councilmember Saegert, Chief Anderson stated that off -duty police are frequently called at home for emergencies, and /or provide assistance to the public. Councilmember Schrawger expressed concern regarding increased fuel costs, possible City liability when employees drive their Council Minutes - Regular Session - 9/11/90 Page 2 of 6 pages families around in City vehicles, and possible misperception on the part of citizens who see police driving a "free" vehicle. He stated that any City vehicle with a tax - exempt tag should only carry City employees on City business. Councilmember Pearce stated that the take -home policy does effectively increase the visibility of the police force, at minimal cost to the City. The Mayor called a recess at 7:45, and reconvened at 7:55. 900433 Ordinance adopting a budget for the fiscal year beginning Oct. 1, 1990 and ending Sept. 30, 1991 - Second Reading/ Glenn Reynolds and Bob Hart Councilmember Tonn requested a transfer of a total of $160,000 into the Council contingency fund to be taken from proposed line items of $25,000/housing grant, $50,000/Youth Center, $25,000/LCRA and BRA legal cases, $25,000/MIS Coordinator, $15,000 /customer service training, $20,000/Pool fund. He stated that the purpose of the transfer would be to give the Council increased control over the funds. Motion by Pearce and second by Schrawger to approve the budget as read. Approved 4 -2 (Tonn and Saegert opposed). 900434 Ordinance amending Ch.2 "Administration" Sec. 2 -10 "Administrative Division and Departments" of the Code of Ordinances - Second Reading /Glenn Reynolds and Bob Hart Motion by Saegert and second by Tonn to approve the ordinance as read. Approved 6 -0. 900435 Ordinance levying a tax rate for the City of Georgetown for the tax year 1990 - Second Reading /Glenn Reynolds and Bob Hart Motion by Schrawger and second by Pearce to adopt the ordinance as read on second reading. Approved 4 -2 (Tonn and Saegert opposed). 900436 Ordinance restructuring the Parks and Recreation Committee - First Reading/Randy Morrow and Hartley Sappington This ordinance will increase the number of members on the Parks and Recreation Committee from five to nine, incorporate some of the functions of the current ad hoc Youth Advisory Committee, require that seven of the nine members reside in the City, and designate one of the nine positions as a representative of the Georgetown Independent School District. There was consensus that nine members is the appropriate number for the reorganized Committee, that two positions be designated as GISD appointments, that the ordinance delete specific reference to any sports group or organization, and that six of the nine appointees live within City limits. Motion by McMaster and second by Valdez to defer deliberation and action on this item until after Item No. 900447. Council Minutes - Regular Session - 9/11/90 Page 3 of 6 pages 900437 Ordinance amending Ch. 23, "Utilities and Services ", Sec. 23 -1(c) "Rates and Charges for City Services - Schedules, Sewer ates "of the Code of Ordinances - First Reading /Glenn Reynolds Motion by Schrawger and second by Pearce to adopt the ordinance as read on first reading. Approved 6 -0. 900438 Resolution establishing an Internal Revenue Code Sec. 125 (cafeteria) plan and establishing a plan year /Glenn Reynolds Glenn Reynolds explained that the proposed cafeteria plan is an outcome of the City's change in policy regarding payment of health premiums for the employee's spouse and family. Instead of the City paying part of the premium directly, and certain employees paying any additional required premium from their after -tax wages, all spouse and family premiums will be paid by the employee (utilizing a City subsidy of up to $131). Under the cafeteria plan, the employee has the option of paying premiums with pre -tax wages. The only payment options available on Oct. 1, 1990 to employees will be the health benefit plan and dental plan. On Jan. 1, 1991 the City expects to offer additional options including unreimbursed medical expenses, term life insurance, and dependent care. Motion by Saegert and second by Tonn to approve the resolution as read. Approved 6 -0. 900439 Ordinance updating TMRS service credits - First Reading /Glenn Reynolds and Bonnie McLain Motion by Pearce and second by McMaster to approve the ordinance as read. Approved 6 -01 900440 Ordinance adopting provisions of Senate Bill 505, related to employee benefits, through the TMRS (Texas Municipal Retirement System) plan - First Reading/Glenn Reynolds and Bonnie McLain Bonnie McLain state that this ordinance will broaden the benefit package and, hopefully, encourage more stability and longer tenure of City employees. Councilmember McMaster stated that this will benefit employees who may have been adversely affected by other budget measures this year. Motion by McMaster and second by Schrawger to approve the ordinance as read. Approved 6 -0. The Mayor called a recess at 9:00 and reconvened at 9:13. 900441 Resolution approving a depository agreement with NCNB /Glenn Reynolds Glenn stated that the City received two bids, one from Citizens State Bank and one from NCNB. NCNB proposed paying interest on the City's collected funds, whereas Citizens State Bank did not. Motion by Saegert and second by Tonn to adopt the resolution as read. Approved 5 -1 (McMaster opposed). Council Minutes - Regular Session - 9/11/90 Page 4 of 6 pages 900442 Resolution to authorize agreement with C 2M Hill regarding review of the SRF (Dove Springs land acquisition procedures). /Jim Briggs CH2M Hill is an international firm approved by the Texas Water Development Board to perform the independent review. Counciimembers McMaster and Pearce expressed some frustration with the fact that the TWDB is requiring Council to spend additional money on this phase of the project given that two in -depth engineering studies have already been performed. Motion by Schrawger and second by Valdez to adopt the resolution as read. Approved 6 -01 900443 Staff report, Council discussion, and possible Council action regarding the City's 1990 annexation schedule/Ed Barry Ed Barry described the six "donut holes" that are potential candidates for annexation by the City. Council discussed the particular history of each tract of land. Council agreed that they would like to explore annexation of all but the Golden Oaks subdivision. Motion by Saegert and second by Tonn to direct the staff to proceed with annexation of all identified tracts but the Golden Oaks Subdivision. Approved 6- 0. Executive Session The Mayor convened an executive session at 9:55 pm. 900444 Pursuant to Article 6252 -17, Sec. 2(r) Staff Report Report on status of the LCRA rate case/Bob Hart (Certified agenda on file with City Secretary.) 900445 Pursuant to Article 6252 -17, Sec. 2(r) Staff Report Report on status of the River Ridge pool/Marianne Landers Banks (Certified agenda on file with City Secretary.) 900446 Pursuant to Article 6252 -17, Sec. 2(f) Real Estate Discuss possible purchase of the old Post Office by the City/ Bob Hart and Marianne Landers Banks (Certified agenda on file with City Secretary.) 900447 Pursuant to Article 6252 -17, Sec. 2(e) Legal Report Discuss potential and pending litigation against the City of Georgetown/Marianne Landers Banks (Certified agenda on file with City Secretary.) Mayor Connor reconvened the open session at 10 :57 pm. Councilmember Saegert stated that he opposes the ordinance because he feels that nine members is too large. Motion by McMaster and second by Pearce to approve the ordinance as read on first reading. Approved 5 -1 (Saegert opposed). 900448 Action pursuant to Executive Session Item No. 900446 - the Old Past Office/ Bob Hart Motion by McMaster and second by Pearce to appoint Bob Hart as the City's designated bidder and Glenn Reynolds alternate bidder, to bid an undisclosed amount for the Post Office, to place a $10,000 deposit as required under the GSA bidding procedures, and for the City Secretary to certify the required certificate of corporate bidder. 900449 Action pursuant to Executive Session Item No. 900447 - potential and pending litigation/ Marianne Banks No action was taken on this item. The Mayor appointed Councilmembers Pearce, McMaster, and himself (ex officio) as members of the River Ridge Pool Subcommittee. He noted that he is seeking volunteers to serve on a Council Committee for Space Utilization (to assess the City's long term needs for office space). The meeting was adjourned at 11:05 pm. H.
