BOX 409 GEORGETOWN, TEXAS 78626 MARCH 14, 1989 The City Council of the City of Georgetown, Texas met in a Workshop and Regular Session on the above date at 6:00 p.m. with Mayor Kennedy presiding. The following members of Council and officials were present. Councilmembers Ercel Brashear, Doak Fling, Luther Laubach, Mike McMaster, and Barbara Pearce; City Manager, Bob Hart; City Attorney, Diane Callander; City Secretary, Leta F. Wallace Winkler & Rice .......................$ 479554.32 Note: This list excludes budgeted inter -fund transfers, purchases of CD's and routine payments for payroll related and debt service expenditures. 890079 Approval of Monthly Meeting Minutes - February 28, 1989/ Leta Willoughby Minutes were approved as presented and shall be included in the official records of the City. 890080 Award of Bid for High Pressure Sodium Street Lamps/Terry Jones and Glenn Reynolds 03/14/89 (csf marl4.min) page 1 of 10 Bid awarded to the low bidder, Temple, Inc. for a total of $119289.00. 890081 Award of Bid for Two (2) 1989 3/4 ton Pickups/Terry Jones and Glenn Reynolds Approved the purchase of the pickups from the State of Texas Purchasing and General Services Commission at a cost of $205670.00. 890082 Consideration of and Possible Action on Award of Bid for an Emergency Power Generator at Fire Station No. 1/Les Bunte Bid awarded to the low bidder, Waukesha -Pearce Industries in the amount of $15,995.00. 890083 Approve Resolution Authorizing Amendment to Materials Testing Contract with Pre -Test Laboratory/Travis McLain and Hartley Sappington RESOLUTION NUMBER 890083 A RESOLUTION APPROVING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF GEORGETOWN, TEXAS AND PRE-TEST LABORATORY FOR THE MATERIALS TESTING ON THE FEDERALLY FUNDED AIRPORT IMPROVEMENT PROJECTS AT THE GEORGETOWN MUNICIPAL AIRPORT AND AUTHORIZING THE MAYOR TO EXECUTE SAME AND THE CITY SECRETARY TO ATTEST. WHEREAS, the City Council (the "Council") of the City of Georgetown, Texas has accepted federal grant funds from the FAA in order to improve facilities and safety at the Georgetown Municipal Airport; and WHEREAS, the Council approved the Contract Agreement between the City and Pre -Test Laboratory for the materials testing on the airport construction projects in the amount of $8,750.00 on October 26, 1988 by Resolution Number 880363; and WHEREAS, certain conditions have arisen not otherwise contemplated nor reasonably forseen by either party, which necessitate additional material testing be performed by Pre -Test Laboratory in the performance of said contract; and WHEREAS, the parties find that such additional material testing is necessary for the successful completion of the project; and WHEREAS, the City agrees to additionally compensate Pre -Test Laboratory in an amount not to exceed $ 10,880.00 for such services and Pre -Test Laboratory agrees to accept same and to provide such additional testing by amending the previous Contract Agreement; and 03/14/89 (csf marl4.min) page 2 of 10 WHEREAS, the Council has found that this action is not inconsistent nor in conflict with any Century Plan Policy as required by Section 2.03 of the Administrative Chapter of the Policy Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS. SECTION I. All the facts recited in the preamble to this Resolution are hereby found by the Council to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied herein verbatim. SECTION II. That the Council approves the amendment for additional testing in an amount not to exceed $ 10,880.00 to the previously approved contract for Pre -Test Laboratory's services, such amendment is attached hereto and incorporated herein. SECTION III. That the Council authorizes the Mayor to execute, the City Secretary to attest. Motion by Councilmember Laubach and Second by Councilmember Fling to approve all items on the consent agenda. International 155 Rohan Company 162 Rohan Company 890087 Consideration of and Possible Action on an Ordinance to Modify 15 Minute Parking Zones in the Downtown Area to 2 Hour Parking/FIRST READING/Hugh Anderson Motion by Councilmember Brashear and Second by Councilmember Pearce to approve on First Reading as read. MOTION: BRASHEAR SECOND: PEARCE MOTION CARRIED: UNANIMOUS ORDINANCE NO. AN ORDINANCE AMENDING ORDINANCE NO. 880010.022 AND SECTION 22-41 OF ARTICLE III, PARKING, CHAPTER 22 OF THE GEORGETOWN CODE OF ORDINANCES, CHANGING THE PERIOD OF TIME DURING WHICH A VEHICLE CAN BE LEGALLY PARKED IN ZONES SO MARKED AND DESIGNATED AS FIFTEEN MINUTE ZONES, TO TWO HOUR ZONES AS SPECIFIED ON ADJOINING STREETS* PROVIDING A SEVERABILITY CLAUSE* PROVIDING A PENALTY FOR VIOLATIONS UP TO $200.00* PROVIDING FOR PUBLICATION AND SETTING AN EFFECTIVE DATE: 03/14/89 (csf marl4.min) page 4 of 10 WHEREAS, the Georgetown Post Block of East 8th Street; and Office has relocated from the 100 WHEREAS, the Council finds that the established fifteen minutes zones in front of the abandoned Post Office Building and other spaces and certain specified zones on adjoining streets are no longer necessary; and WHEREAS, the City Council has found that this action implements Economic Development Policy 2 and Transportation Policy 1 of the Century Plan - Policy Plan Element, and is not found to be inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION I. That Section 22-41 of Article III, Parking, Chapter 22 of the Code of Ordinances be amended to read: " Section 22-41. Fifteen -minute zones. When signs are in place giving notice thereof, during the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday and on Saturday to 12:00 noon, except legal holidays, it shall be unlawful for a person to leave standing or parked, any vehicle for a period in excess of fifteen (15) minutes in the following zones and each successive fifteen (15) minutes that a vehicle shall be left continuously parked in such zones shall constitute a separate offense: The North side of the 100 Block of East 7th Street from the West curb line of Main to a point 75 feet West of Main Street. The West side of the 700 Block of Rock Street beginning at a point 33 feet from the North curb line of 8th Street to a point 117 feet North of 8th Street." SECTION II. That any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than $200.00. Each fifteen minute period a violation shall continue shall be deemed a separate offense. SECTION III. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held to be unconstitutional by 03/14/89 (csf marl4.min) page 5 of 10 a court of competent jurisdiction, it shall not affect, impair, or invalidate the remainder of this ordinance which shall be given full force and effect. SECTION IV. Upon final passage the City Secretary shall cause this ordinance's caption to be published in the newspaper of general jurisdiction and this ordinance shall become effective 10 days after its publication. 890088 Consideration of and Possible Action on an Ordinance to Revert the 100 Block of East 8th (Old Post Office) from One -Way to Two -Way Traffic/FIRST READING/Hugh Anderson Motion by Councilmember McMaster and Second by Councilmember Laubach to appprove this ordinance on First Reading as read. MOTION: MCMASTER SECOND` LAUBACH MOTION CARRIED* UNANIMOUS ORDINANCE NO, AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS DESIGNATING TWO-WAY TRAFFIC ON A PORTION OF 8TH STREET FROM MAIN STREET TO CHURCH STREET IN THE CITY LIMITS OF THE CITY OF GEORGETOWN; ESTABLISHING THE BOUNDARIES BEING MODIFIED FROM THE EXISTING ONE-WAY PORTION OF 8TH STREET; PROVIDING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE* WHEREAS, the City Council of the City of Georgetown, Texas, finds that the one way designation of the 100 Block of East 8th Street from Main Street to Church Street is no longer required due to the relocation of the United States Post Office and; WHEREAS, the City Council finds that the return to two-way traffic in that particular block, coinciding with the remaining portions of 8th Street and consistent with traffic patterns in the Downtown area of the City could facilitate traffic flow into, around and away from the Courthouse Square; and WHEREAS, the City Council has found that this action implements Economic Development Policy 2 and Transportation Policy 1 of the Century Plan - Policy Plan Element, and is not found to be inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: That the City Council adopts the recitals set forth in the preamble as true and correct and are adopted herein. 03/14/89 (csf marl4.min) page 6 of 10 SECTION II. That the City Council authorizes the 100 Block of East 8th Street, from Main Street to Church to revert from a one-way street, including appropriate street lining and signage, to a two-way street to allow travel for East and West bound traffic and that the staff be directed to implement all action to accomplish this change. SECTION III. Any existing ordinance, resolution, policy, that is in conflict with the provision of this ordinance, then that ordinance, resolution, or policy is hereby repealed to the extent of any conflict. SECTION IV. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held to be unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate the remainder of this ordinance which shall be given full force and effect. SECTION V. Upon final passage the City Secretary shall cause this ordinance's caption to be published in the newspaper of general jurisdiction and this ordinance shall become effective 10 days after its publication. 890089 Consideration of and Possible Action on a Resolution to Authorize the City's Participation in the LCRA "Team Readiness" Economic Development Program/Bob Hart Motion by Councilmember Fling and Second by Councilmember Brashear to approve Resolution No. 890089 as read. MOTION* FLING SECOND: BRASHEAR MOTION CARRIED* UNANIMOUS RESOLUTION NO.890089 WHEREAS, the City of Georgetown has set as its high-priority goal to promote economic development activities within the City of Georgetown; and WHEREAS, the City of Georgetown desires that economic development efforts are pro -active rather than reactive; and WHEREAS, economic vitality includes the creation of prosperity for our citizens insuring that underemployed have opportunities for full employment; and 03/14/89 (csf marl4.min) page 7 of 10 WHEREAS, the City of Georgetown desires to work with businesses in the creation of new jobs in manufacturing, agriculture, retail and service businesses which will improve the general health and well being for all who choose to live and work in Georgetown; WHEREAS, the Lower Colorado River Authority has developed a "TEAM READINESS PROGRAM" to assist municipalities in economic development; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, THAT: 1. The recitals, as herein stated, are true and correct. 2. The City of Georgetown shall respond to each of the eight items listed in the LCRA TEAM READINESS PROGRAM Outline and provide support materials on each item for the LCRA Files in an effort to be certified by the LCRA as TEAM READY, 890090 Consideration of and Possible Action on a Request to Waive Capital Recovery Fees for Irrigation Water Meter for New H.E.B. SPECIAL MEETING 890095 Consideration of and Possible Action on a Resolution Endorsing Georgetown Independent School District's and Southwestern University's Fight Against Illiteracy/ Bob Hart Councilmember Pearce presented some background information on the Fight Against Illiteracy program. Motion by Councilmember Fling and Second by Councilmember Laubach to pass and approve Resolution No. 890095 MOTION: FLING SECOND: LAUBACH MOTION CARRIED: UNANIMOUS RESOLUTION 890095 WHEREAS, illiteracy is an epidemic affecting one in five Americans --twenty-seven million victims; and WHEREAS, at both the state and national levels, there is growing evidence that the illiteracy problem is stifling economic and social development; and WHEREAS, the Community of Georgetown is determined to make it possible for people who live here to be able to read; and 03/21/89 ----- council minutes(csf mar2l.min) page 1 of 3 WHEREAS, Georgetown Independent School District and Southwestern University have established a goal to provide a community model to address the increasing and related problems of illiteracy and school drop -outs in our society; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Georgetown, Texas, that the City Council endorses the efforts of Georgetown Independent School District and Southwestern University as they examine the issues connected with illiteracy and support the proposed creation of computer laboratories designed for reading instruction which would target the needs of beginning readers, students with reading problems, and adolescent and adult illiteracies. Discussion of these items followed by Council. 03/21/89 ----- council minutes(csf mar2l.min) page 2 of 3 890105 Mayor, Council and City Manager Comments and Reports Councilmember Pearce thanked the Accounting staff, Glenn Reynolds and Bonnie McLain for their assistance. Councilmember Fling echoed his thanks also. Councilmember Brashear expressed concern with Charter limitations pertaining to the budget, specifically, when a line item exceeds the budgeted amount, the Charter places limits on the ability to report what actually happens. If there is a deficiency in a line item, the Charter requires that a transfer be made, within a department, from one line item to the deficient line item. From a management standpoint, it is difficult to tell what you should be preparing for next year. He would like the Council to consider submitting this to the Charter Committee for consideration. Councilmember Laubach stated the same concerns and would like the Charter limitations pertaining to the budget to be reviewed. Mayor Kennedy stated that within the next couple weeks there needs to be a Special Workshop scheduled for the the Council to discuss an incentive package for prospective businesses.
