The following council members and officials were present: Council Member Luther Laubach, Council iember Joan King, Council Member Marvin E. Lackey, Council Member Barbara Pearce, Council Member like McMaster, Deputy City Secretary Denise Lebowitz, City Manager R. Bob Gaylor, Director of Finance and Administration Gwen Sherman, Director of Community Services Hartley Sappington, Director of Public Works Allyn Moore, and Development and Planning Director Ed Barry. Note: Council Member Barbara Pearce was not present for Item #870480, PUBLIC HEARINGS: 6:30 PM 870480. Proposed Annexation Mayor Colbert called to order the public hearinb on Proposed on Proposed Annexation. Mayor Colbert advised that if anyone would care if anyone to hear the staff presentation or would like to address the Council regarding this item he would recognize Mayor thea. No one cozrmiented. RESOLUTION NO. 870490.18 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS DECLARING THAT THE CITY COUNCIL OF THE CITY OF GEORGETOWN HAS CHOSEN NOT TO ADOPT THE OPTIONAL AMENDMENTS OF SENATE BILL 505. WHEREAS, the Texas has passed the Texas Municipal LeUlslature Senate Bill Retirement 505 System of the amending the Act. Read and adopted on this 27th day of October, 1987. 870491, Speed Zone Change Ordinance -State Highway 29/EMERGENCY READING Staff gave presentation and advised Council that it was at ZONING FOR IN THE CITY LIMITS OF THE CITY OT' FIXING A PENALTY THEREFOR; COMPLAINT IN PROSECUTIONS GEORGETOWN; DEFINING DECLARING WHAT HEREUNDER; PROVIDING MAY BE A SPEEDING AND A SUFFICIENT SEVERABILITY CLAUSE; AND the request of the TDHPT that this ordinance be considered for approval on Emergency Reading. There were Council Staff advised Council that questions addressed to staff and discussion of item. Motion by King and second by Pearce to approve the following; captioned ordinance on Eaergency Reading. Motion carried by unanimous vote. AN ORDINANCE TRAFFIC AND OF THE RATE CITY OF GEORGETOWN, OF SPEED THEREIN, TEXAS, ON STA 29 ZONING FOR IN THE CITY LIMITS OF THE CITY OT' FIXING A PENALTY THEREFOR; COMPLAINT IN PROSECUTIONS GEORGETOWN; DEFINING DECLARING WHAT HEREUNDER; PROVIDING MAY BE A SPEEDING AND A SUFFICIENT SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE 870492. Revised Ordinance Amending Chapter 5, Animals and Fowl Code of Ordinances SECOND READING Staff advised Council that changes had been made to this ordinance per Council directives at first reading on Oct. 205 1987 council rtleeting and advised Council that the revised ordinance now being submitted to Council for second reading had not yet been signed by the City Attorney Mayor Colbert asked staff to read each section of the ordinance and that 10/27/87 regular council meeting (csf oct27.min) page 3 of 8 questions and comments would be addressed after the reading of each section. Discussion followed between Council, Staff and audience. Questions were answered by Staff and Council. Dr. Stephen Schaefer representing the Sheriff's Possee made the comment that he stood in support of the ordinance as revised and that he applauded the Council`s efforts in this matter. Mr. Malinovsky addressed his concerns for the protection of water supply from health hazards and asked Council's consideration. Council responded that the 500 fte provisions outlined in this ordinance were guidelines provided by the Texas Water Commission and that the protection of public health safety stanaaras would be governed by and under the direction of the Texas Department of Health. Council asked for Staff confirmation of that information and it was affiriried. Motion by King and second by Lackey to approve the following captioned ordinance upon this second reading with the following conditions: 1. Pending approval by the City Attorney 2. With the change in Section I from X33 -days to read (5) days and in Section 2 from f34-eays to read (5) days. 3. Change in wording to express the Council's intent in Section type did 3(b) purposes not constitute allowing for the p-rovidinc, that a nuisance keeping of animals the keeping of .s defined in such 3(c). for 4 -II animals ORDINANCE NUMBER 870493.005 AN ORDINANCE AMENDING CHAPTER 5, ANIMALS AND FOWL, OF THE CITY OF GEORGETOWN CODE OF ORDINANCES BY AMENDING SECTIONS 5-81 5-95 AND 5-10 BY MODIFYING THE RESTRICTIONS REGULATING THE KEEPING OF LIVESTOCK, FOWL AND OTHER ANIMALS WITHIN THE CITY LIMITS OF GEORGETOWN, TEXAS; PROVIDING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE Motion carried by 870493. Motion carried by unanimous vote. 870494. Hygeia, Vacating and Amending Plat Staff presentation was given and staff recorrmendation for approval was noted. Mayor Colbert read a letter received from Liz Mealey regarding the Dwatter and requesting that. fees 10/27/87 regular council i_Zeeting (csf oct27.rnin) page 4 of 8 be waived in consideration of land use loss to owner. Ms. Beverly Robinson representing the owner addressed the Council regarding item 870494 and related request to waiver fees. There was Council discussion, responses to Ms. Robinson and Ms. Mealey. Council Member Pearce asked that the easement granting and the fee paywent issue be considered documented as separate issues. Council discussion focused on the need for consistency of policy regarding payment of fees before further action on the plat. of issues Motion Member Barbara Pearce presented by Laubach and second by Lackey to table this iters until recommendations fees had been paid. Subdivision Regulation's by the end of Advisory Couanittee Interim Report 870490. Ordinance -FIRST RE Council Member Barbara Pearce presented verbal report to Council. Agreement was reached that recommendations to Council would be presented by Dec. 8, 1987 and that a unanimous vote. documented report would follow hopefully by the end of the 2nd week of January 1988. Council requested the list of issues being reviewed by the Committee to be sent to there. Rezoning, Dennis P. McCoy Subdivision, RS to C2 -A ADING Staff gave presentation to the Council. Discussion followed. Motion by Lackey and second by King to affirm ordinance on first reading and to waive rezoning application fees. Motion carried by unanithous vote. 870497. Raintree Lots 7&8 Block C, Partial Vacating and Amended Plat Staff presentation and recoiruriendations given also advising that the Planning & Zoning Comiission concurs with staff recommendations. Motion by King and second by Pearce to approve the Partial Vacating and Amending Plat, subject to Planning and Zoning Commission recommendation. Motion, carried by unanimous vote. 870498. Ordinance Rezoning 7.93 Acres in Dy°rhes Survey, RS to C2 -A. -FIRST READING Staff gave presentation and recotimendation that this -iter,] be tabled pending site plan submittal to provide for consistency in policy administration. Council Member Kind; requested Mr. Ferd Tonn of the Planning and Zoning Cofiriiiission (present in audience) to respond. Mr. Ferd Tonn affirmed the stated Planning and Zoning Cormitission actions as noted in the staff report. Council Member King asked if Planning and Zoning Commission consideration was given to the required procedure of site plan submittal. Motion carried by vote. Riyeroaksi Resubdivision, Reconsider condition of Prelimina Approval_ Staff gave presentation to Council. Pl at Mayor Colbert recognized Mr. Brock, Wi11iaias Interests -NPC to address the Council. Mr. Brock gave presentation to the Council which included two proposals. 1) Proposed an alternative public access to the river along the north property line but not from the river within the defined flood plain area. Advising that this proposed alternative public access would be defined and the plat revised to reflect the change. 2) Proposed that the City purchase the designated flood plane area from the owner at fair market value (perhaps it was his understanding that HEB felt that the use of for the purpose of use as a park land area). said Discussion followed between Council and Mr. Brock. Reference was made to Mr. Brock's letter which addressed the status of the H.E.B. plat. Mr. Brock affirmed that the H.E.B. plat would be delayed if Council action was not received on item ;870500. Discussion was held regarding the use of Georgetown Electric for the Riveroak Subdivision. Mr. Gaylor asked Mr. Brock if it had been trarisraitted as a requirerient to the potential buyers that Riveroaks would use Georgetown Electric. Mr. Brock said that he had conveyed to the Potential buyers that Georgetown Electric would be used. Ms. Gaylo-r advised that there had been communication with HEB and it was his understanding that HEB felt that the use of Georgetown Electric was a negotiable itew. Mr. Brock said that he had sent the -m letters and that the City should ask to talk to Bill Reynolds regarding what Mr. Brock had told him. 10/27/87 regular council rneeting (csf oct27.inin) page 6 of 8 Motion by King and second by Lackey to affirm the Council's Council Policy of assuring reasonable reached that the public access to the San Gabriel River corridor land in the plat approval process and that. the Council reaffirm the Council's approval of the preliminary plat including the conditions of that approval. `Doting went as follows: YES: Lackey, Laubach, King 140: (none) Abstain: McMaster, Pearce. Motion carried. 870501. Ethics Ordinance Annual Review -Discussion Council discussion was held. Agreement was reached that the Council would attempt to have this item on the agenda at the Dec. 8, 1987 council meeting. Mayor Colbert designated the Special Projects Subcommittee to Lather input from Council Members and give presentation at Dec. 8, 1987 meeting. Misc. Mayor Colbert asked the Council if they had any other itefis to discuss. None replied. Mr. Gaylor, City Manager, made comments regard the Park Water Plant processing related to the certification procedure. He advised that there are probably going to be some delays in putting on our line because one of the subcontractors working on the project filed bankruptcy. The contractor has asked for a small delay in order to allow time for him to find another vendor. Mr. Gaylor also advised that the staff think they have worked out all the details on the Maple Street. Water Line as well. Adjourn: Motion by Laubach and second by McMaster to adjourn.
