870211. Hearing, Maple Water Line Dispute, Wood Excavating, Communit_
Engineering
The City Council conducted a hearing regarding a dispute of
the bidding process used in securing contractors for Maple
Water Line Construction Project. W. L. Wood Excavation
asserted that due to the failure of their company to received
a bid addendum their bid was not the lowest bidder but
instead was the second lowest bidder. Wood Excavating also
maintained that if the bids were to be evaluated on unit cost
alone, that they would be the apparent low bidder. Joe King,
who conducted the bidding process for Freese and Nichols,
affirmed that W. L. Wood Excavating was sent an addendum
through the mail. Comments were also made by Community
Engineering.

Motion by Lackey and second by King to authorize the City
Manager to acquire the Maple Street Water Line Easement.
Motion carried by unanimous vote.
870214. Award Maple Street Water Line Contract
Motion by Lackey and Second by Laubach
to award the
Maple
Street Water Line Project
to Community
Engineering in
amount.
of $601,661. Motion carried
by unanimous
vote.
