The following council members and officials were present: Council Member Eb C. Girvin, Council Member Joan King, Council Member Marvin E. Lackey, Council Member Bill Connor, Council Member William C. Shell, City Secretary Pat Caballero, City Manager R. Bob Gaylor, Director of Finance and Administration Gwen Sherman, Director of Community Services Hartley Sappington, Director of Public Works Allyn Moore, and Development and Planning Director Ed Barry. Consent Agenda: Motion by Connor and second by Shell to approve consent items numbers 87103, 87104, 87105, and 87107 as follows. Motion carried by unanimous vote. Item number 87106 was removed from consideration. 870103. Minutes To approve the March 10, 1987 Regular Council Meeting Minutes as submitted by City Secretary Pat Caballero. 870104. Membership of a resolution previously adopted by the City Council on February 26, 1987 establishing a Parks and Recreation Committee be amended to hereby read as follows. 03/24/87 regular council meeting ;page I of 7 C. Organization. 1. Membership. The Committee shall be composed of nine (9) residents of the City and its ETJ recommended by the Mayor and approved by the Council. They shall be broadly representative of Greater Georgetown in age, sex, race or ethnic group, neighborhood, and type of recreation interest; but also committed to serving the needs of the whole community. Chamber of Commerce Lease Assignment, Randy Stump Motion by Connor and second by Shell to instruct City Attorney Randy Stump to prepare a Chamber of Commerce Lease Assignment, along the lines of the city attorney's recommendations concerning the City's rights of refusal and reclaiming the property, and bring it back for consideration Motion carried by unanimous vote. 870123. Frank Reed Settlement, Randy Stump Motion by Shell and second by Connor to: 1) Approve final settlement of the Frank Reed Agreement. 2) Authorize the Mayor to sign such agreement. 3) Ratify such acts that have been preformed to settle this claim. Motion carried by unanimous vote. 870109. Committee Appointments, Planning and Zoning, Zoninz Board of Adjustments, Housing Authority/Salary Renumeration, Mayor Colbert Motion by Connor to confirm the following Planning and Zoning Appointments as recommended by Mayor Colbert. Motion by Lackey and second by King to confirm Mayor Colbert's recommended appointments to the Housing Authority as follows. Motion carried by unanimous vote. 1. Tourism Task Force Committee Recommendations, Sandy Langford McKinnon /Robert Gaylor The Council indicated conceptual approval of the creation of The Georgetown Tourism Corporation to oversee the expenditure of hotel/motel tax revenues and asked that a more detailed plan be returned to the City Council for further consideration. 870111. Ordinance, Administrative Organization, Emergency Reading, Robert Gaylor Motion by Connor and second by King to adopt on emergency reading the following captioned ordinance. Motion carried by unanimous vote. ORDINANCE NUMBER 870111.002 AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, SECTION 2-10, ADMINISTRATIVE DIVISIONS AND DEPARTMENTS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR EMERGENCY ADOPTION; AND SETTING AN EFFECTIVE DATE 870112. Variance, Reinstatement of Final Plats, Quail Meadow 6 and 7, John Warden Owner/Applicant: Donald E. Parker, et al 3100 Williams Drive Georgetown, Texas 78628 Request: A variance from Section 4.04 Part 15 of the Subdivision Ordinance to reinstate Final Plat approval for a six month period for Quail Meadow 6 and Quail Meadow 7. Harold S. Parker requested that the following letter be read into the record by City Secretary Pat Caballero. To: Mayor & City Council, I am writing this letter to the council because I am not sure that you fully understand how your engineering review policy effects an average subdivision. We are presently (27 months and $54,162.20 in fees to our engineers) trying to obtain final approval of two small subdivision. As we understood the policy on review fees, when we presented these two plats, was that if they would exceed $1000.00 adjacent per subdivision we were to be notified in writing. (Section V of the City Ordinance Establishing Rates for Review of Plats and Plans). We had received around no such notices when we declined to pay the fees in question ($1896.09). These fees seem excessive to me and when paid will bring the total review fee to around $7150.00 on these two subdivisions. One of these subdivisions has only 5 lots and is adjacent to existing paved street with all utilities. Drainage was really a very simple matter of letting the excess water run down hill into a drain system already provided in adjacent subdivision. The fee for these 5 lots was around $500.00 per lot. Parker these fees are reasonable a check is 03/24/87 regular council meeting page 4 of 7 Upon confirmation that the review fees stated above were paid by the applicant, motion by Connor and second by Shell to grant a six month reinstatement of Final Plats of Quail Meadow 6 and Quail Meadow 7, to expire on September 24, 1987, subject to all of the original conditions of Final Plat approval for each plat. Motion carried by unanimous vote. 870115. Preliminary/Final Plat, Toyah Point Section 4, John Warden Motion by Lackey and second by Shell to refer this matter to the Planning Zoning Commission to re-evaluate the access to the property subject to the consent of the applicant. If the applicant does not agree to suspend the 30 day automatic approval rule, then the matter shall be brought back to the City Council at the April 2, 1987 Special Council Meeting. Motion carried by unanimous vote. 870116. Resolution, Rural Fire Protection, Les Bunte Motion by King and second by Shell to adopt the following resolution. Motion carried by unanimous vote. A RESOLUTION OF THE CITY COUNCIL OF GEORGETOWN, TEXAS TO DEVELOP A POLICY STATEMENT REGARDING RURAL FIRE PROTECTION AND THE ENCOURAGEMENT AND PROMOTION OF CREATING A RURAL FIRE PROTECTION DISTRICT FOR SPECIFIED AREAS OUTSIDE THE CITY. WHEREAS, the City of Georgetown, an incorporated municipality within Williamson County, currently provides adequate and reliable fire protection to it's citizens, that the City Council is strongly committed to meeting the necessary that the City requirements to continue to provide satisfactory no longer continue fire protection service to it's own taxpayers; AND WHEREAS, the City of Georgetown directs approximately 50% of protecting lives and property Georgetown with very little County for such service; AND Fire Department each year it's services and resources to outside the City Limits of compensation from Williamson WHEREAS, Williamson County is not willing to bear a fair and reasonable cost for providing fire service protection to it's rural citizens, and that the City of Georgetown taxpayers can no longer continue to subsidize the cost of providing rural fire protection; AND WHEREAS, the City Council is willing to enter into a contractual agreement with a Rural Fire Protection Tax District to continue to provide fire protection outside the City Limits in order to receive a fair and reasonable compensation for providing such service; THEREFORE, BE IT RESOLVED THE CITY COUNCIL OF GEORGETOWN: That the City Council resolves to petition for an election to create a Rural Fire Protection Tax District for areas outside the city limits, Georgetown will and as of January 1, 1988 no longer provide fire protection the City outside of the 03/24/87 regular council meeting page 5 of 7 City Limits except under a contract with Protection Tax District. ORDINANCE NUMBER 870117.022 AN ORDINANCE AMENDING ORDINANCE 86-17 AND SECTION 22-42 OF GEORGETOWN CODE OR ORDINANCES; CHANGING THE PERIOD OF TIME, WHICH A VEHICLE CAN BE LEGALLY PARKED IN ZONES SO MARKED AND DESIGNATED AS TWO HOUR ZONES, TO ONE HOUR ZONES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION AND SETTING AN EFFECTIVE DATE: 870118. Agreement, Management of Municipal Swimming Pools, Hartley Sappington Motion by Lackey and second by King to authorize the Mayor and City Manager to sign a Management Agreement with Aquatics Unlimited, Inc. to manage the operation of the City's two swimming pools and the aquatics programs of the City Recreation Department. Adopt Electrical Policy, Allyn Moore Motion by Connor and second by Girvin to adopt an electrical installation policy as prepared by the Director of Public Works Allyn Moore (a copy of which is filed in the office of the City Secretary. Reference Number 870119.) Motion carried by unanimous vote. 870120. Award Contract, Project No. 00274, 12" Raw Water Line from 2nd to N. College, Allyn Moore Motion by Connor and second by, Lackey to award the 12" Raw Water Line 5th to College Street Project No. 00274 to Rhode Pipe Construction of Hillsboro for $83,239.00.
