The City Council of the City of Georgetown met
in Regular Session on the above date at 7:00
P.M. with Mayor Jim Colbert presiding. The
following council members and officials were
present: Council Member Eb C. Girvin, Council

Motion by Lackey and second by Shell to
approve consent items 870043, 8700453 870046,
870047, 8700485 870049, 870050, 870051 and
870053 and to consider items 870044 and 870052
separately. Motion carried by unanimous vote.
To approve the January 20, 1987 Special
council minutes and the January 27, 1987
regular council meeting minutes as submitted
by City Secretary Pat Caballero.
870044. Bills over $5,000.
Motion by Lackey and second by Connor to
approve the following bills over $5,000. with
a note that the Cooper Equipment payment
listed is 90% of the amount owed for the
Vacuums Sweeper and that the remaining 10% may
be paid after receipt of the equipment
operations manual. Motion carried by
unanimous vote.

AND
PROMOTING
ANY
AND ALL
LEGISLATIVE
ACTION
AND
INFLUENCE
ON
STATE
LEGISLATORS
TO
SUPPORT
INTRODUCED
LEGISLATION
WHICH
REMOVES
THE
CITY'S
LIABILITY
UNDER
THE
INDIGENT
HEALTH
CARE
AND
TREATMENT
ACT.
WHEREAS, Georgetown, Texas is an incorporated
municipality within Williamson County, Texas;
and
WHEREAS, by enactment of the Indigent Health
Care and Treatment Act (Article 4428f,
Vernon's Texas Civil Statutes), the residents
and taxpayers of the City of Georgetown are
being taxed by Williamson County to provide
for the cost of delivery of health care to
indigent residents not residing with the City
of Georgetown; and
WHEREAS, upon the creation of the Georgetown
Hospital Authority, it was clearly intended
and ordained that:

The City shall not be liable or in
any way legally responsible for any
part of the operation, construction,
maintenance, or other activities of
he Hospital Authority or for any
debts or obligations created by such
Authority and hereby represents that
the City shall in no way assume such
liabilities.

WHEREAS, the City of Georgetown, as
having created the Georgetown
Authority, is made liable for
delivery of health care to indigent
of the City under said Indigent
and Treatment Act;

THEREFORE, be it resolved by the City Council
of the City of Georgetown
That all residents of the City of Georgetown,
Texas, be, and are hereby urged to bring to
the attention of any and all legislators of
the State of Texas urging them to support
House Bill 81 or Senate Bill 41 which shall
remove the liabilities of cities having
created Hospital Authorities, for the payment
of services for which counties shall have
collected tax revenues. Furthermore, support
the amendments to Section 2 (6) of the
Indigent Health Care and Treatment Act that
hospitals created under Hospital Authorities
not be classified as Public Hospitals and
Hospital Authorities not be considered
Governmental Entities.
BE IT FURTHER RESOLVED:
That the Mayor and City Council hereby and
direct the City manager to participate with
the Hospital Authority and other
municipalities in the State of Texas which
suffer the same or similar inequities related
to the provision of the Indigent Health Care
and Treatment Act to prepare oral and written
testimony and other supportive documents to be
presented to legislative hearing to gain
relief from this unjust State imposed
legislation.
870056. Resolution Establishing Parade Permit Procedures, Hartley
Sappington
Motion by King and second by Shell to adopt
the following resolution. Motion carried by
unanimous vote.
WHEREAS,
the

Council
of
the City
of
Georgetown,
Texas
desires
to
allow
all
citizens
to
organize
and
participate
in
parades
and
scheduled
events;
and
WHEREAS, the City Council of the City of
Georgetown, Texas desires to establish a
Policy to assure a fair and equitable
administration of parade permit requirements

to be met by all applicants;
That the parade permit policy and procedure
stated below be followed by the City Council
and the city staff:

PARADE PERMIT APPLICATION PROCEDURE;
1. Any individual, or group, proposing an
activity which requires a parade permit shall
obtain, on forms prescribed by the city, an
application for parade permit. Upon
completion, the application shall be filed
with the designated city office.
2. The application shall be" -reviewed by the
city to determine compliance with Section
17-6.3 of the City of Georgetown Code of
Ordinances including the amount of general
liability insurance (a minimum amount of
$100,000.00 and a maximum of $1,000,000.00) to
be obtained naming the City as an insured
party.
3. Upon the delivery of a certificate of
insurance of the prescribed amount and
compliance with any and all other
restrictions, requirements, cost and deposits,
the City may issue a parade permit in
conformance with Georgetown Code Section
17-6.3
4. If an application for parade permit is
disapproved by the city the applicant shall be
notified in writing.
5. If the applicant is of the opinion that
the application has been unfairly rejected or
the amount of insurance, restrictions and/or
other costs to be imposed are excessive, the
applicant may appeal for a public hearing
before the city council.

870057. Methodist Church Parking Reauest, Ed Barr
Applicant: First United Methodist Church
410 E. University
Request: To permit the use of public
right-of-way (ROW) behind the east curbline of
Elm Street for 45 degree angle parking.
Motion by Shell and second by Lackey to
permit the requested 45 degree angle parking
with parking allowed along the west side of
Elm Street. Motion carried by unanimous vote.
870058. Report on Schedule for Review of Proposed New Subdivision
Ordinance, Barbara Pearce
Barbara Pearce gave a report on a schedule of
the proposed subdivision ordinance public
hearings and adoption. Such schedule
involves the Planning and Zoning Commission
making a formal recommendation concerning the
adoption of the new subdivision ordinance.
The City Council will then hold a series of
Public Hearings (with the Planning and Zoning
Commission in attendance). The Planning and
Zoning Commission will then hold another
meeting to prepare the ordinance for final
adoption by the Council

The

should
pursue
the
creation
of an
Underground
Water
District
within
this
region
of
the
State.
870063. Discussion, Woodmen of the World Lodge Lease, Robert
Gaylor
City Manager Robert Gaylor outlined a plan that
involves the Woodmen of World Lodge Building
and the Georgetown Volunteer Fire Department.
This plan would allow the current lease for
the Woodmen Building Site to expire and that
the city would assume ownership of the current
building. At that time the City would grant
the Volunteer Fire Department a lease for the
building with the condition that the Woodmen
have occasional use of the facilities. The
Council indicated that City Manager Robert
Gaylor proceed with the proposal.
870064. Discussion of Options Regarding Non-residential utility
meter deposits
Motion by Connor and second by Lackey to
permit the City Staff, with approval by the
City Attorney, to interpret the current code
requirement of Non-residential utility meter
deposits to allow surety bonds, letters of
credit or other suitable securities to be used
in lieu of a cash deposits. Motion carried by
unanimous vote.
