PUBLIC HEARING ON SUBDIVISION PLAT FEE ORDINANCE - ED BARRY The city council held a public hearing on Plat Fees. Motion by Lackey and second by Connor to authorize the Mayor to sign the Tri -Tract Capital Recovery Fee Credits Agreement after certain changes, that City Attorney Randy Stump and Attorney Richard Suttle have agreed upon, have been incorporated into the agreement. Motion carried by unanimous vote. 12. WILLIAMS COMMERCIAL PARK CAPITAL RECOVERY FEE CREDITS - ED BARRY Motion by Connor and second by Lackey to refer the matter back to the planning staff for further consideration. Motion carried by unanimous vote. 13. VARIANCE FROM OFF-STREET PARKING REQUIREMENTS 101 PARQUE CIRCLE - ED BARRY Motion by King and second by Shell to deny a variance request from Donna and Robert Edgeman for a variance from Section 7.101, Off-street Parking Requirements of the Zoning Ordinance. RESOLUTION - RECREATIONAL FEE POLICY - RON GAHAGAN Motion by Connor and second by Lackey to adopt the following resolution. Motion carried by unanimous vote. Eligibilit Organizations which meet all of the following criteria are to be considered volunteer public-service organizations and are not subject to user fees imposed by the City so long as these criteria are met by such organizations; 1) Must be open to all members of the public within the designated boundaries enumerated above, 2) Must be a non-profit organization recognized by the Internal Revenue Service under its regulations, 3) Have a charter or statement of purpose registered with the Secretary of State, 4) Have a duly elected Board of Directors or a governing board, 5) Staffed by volunteers with no paid employees, 6) Provide for a City review of all financial records of the organization, 7) Provide that all fees or funds which are collected be returned to the program for the benefit of those persons who paid the fees or funds, 8) Have a regular schedule of recreation activity on at least an annual basis, g) Have a recreation programa with participation by at least 25 persons, 10) Perform ordinary and 8/26/86 regular council meeting page 10 of 14 routine maintenance on the facility which the organization is using. (This is not the maintenance which must be performed by the City on the various City provided utilities.) Basic Services, as defined by the Parks & Recreation Department, will be provided at no charge. Special services will be provided for a fee, as established by the City, Any organization which does not meet all of the above criteria will be considered as a non -volunteer service City organization and; as such, will be required to reimburse the City of Georgetown for the use of recreation facilities at the prescribed rate for such usage. These rates shall be determined annually by the City staff and such rates will provide for a return of funds expended by the City for maintenance, operation, and replacement costs of such facilities. Replacement costs should be computed over the reasonable useful life of the facility. The replacement cost should not include the cost of land. RESOLUTION - UTILITY FUND FISCAL POLICY - BOB GAYLOR Motion by King and second by Connor to adopt the following resolution. Motion carried by unanimous vote. Whereas, the City Council of the City of Georgetown, Texas desires to keep the Utility and Corporation of the City a viable operation entity with all the privileges of any Corporation; and Whereas, the Citizens of Georgetown being apparent stockholders of the Corporation; and Whereas, certain the fiscal Utility attributes Corporation requires to demonstrate excellent fiscal status; and Whereas. the City of Georgetown requires contribution from the Utility Corporation for operation its General Fund for the betterment 8/26/86 regular council meeting page 11 of 14 and protection of its Citizens. NOW, THEREFORE, AND Council BE IT RESOLVED BY THE CITY COUNCIL gross General revenue Fund of the City, which will be acting in behalf OF Citizens as Stockholders; APPROPRIATING THE VARIOUS THE AMOUNTS CITY OF GEORGETOWN, THEREOF TEXAS: That from hence on, the City Council will protect the Utility Corporation's fiscal integrity by assuring: 1) The profit margin will be maintained at a level equal to or above the 150% level of debt servicea and 2) The operating reserves will be maintained at a level equal to three (3) times the monthly operating cost; and 3) The Corporation will initiate a dividend as approved by the City AND Council acting as its Board, not to which will be exceed (6)% of its transferred to the gross General revenue Fund of the City, which will be acting in behalf of the Citizens as Stockholders; APPROPRIATING THE VARIOUS AMOUNTS and 4) The activities and expenditures of the Corporation will acknowledge the above mentioned requirements and control its expenditures and reserves accordingly; and 5) the self insurance fund will be excluded from these considerations and will act as a protector of the Corporation as a whole against general liability. 21. ORDINANCE - 1986187 FISCAL YEAR BUDGET - 2ND READING - DAVID QUICK Motion by Connor and second by Shell to adopt on second and final reading the following captioned ordinance. Motion carried by unanimous vote. "ORDINANCE NUMBER 86-33 APPROPRIATION ORDINANCE AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR BEGINNING, SEPTEMBER 1, 1986 AND ENDING AUGUST 31, 1987, IN ACCORDANCE WITH ARTICLE 689A-13 OF THE REVISED STATUES OF TEXAS AND HOME RULE CHARTER FOR THE CITY OF GEORGETOWN, TEXAS.
