WHEREAS, Highland Park Subdivision is a 19.12 acre subdivision originally
recorded in 1963 in Cabinet A, Slides 369-371 of the Plat Records of Williamson County
(Document No. 19630021G), and partially replatted in 2002 as recorded in Cabinet W.
Slides 200 and 201 (Document No, 2002064432) (the "Subdivision"); and
WHEREAS, the Subdivision includes a street currently designated as "Highland
Drive" (formerly designated as "Easy Street") which was originally intended to connect
23rd Street to 25th Street (now Industrial Avenue); and
WHEREAS, the portion of Highland Drive that is the subject of this Ordinance is
described by metes and bounds on Exhibit "A" and by diagram on Exhibit "B" ; and
WHEREAS, the City of Georgetown owns the property on the east side of the
herein -described portion of Highland Drive, to the centerline of Highland Drive, and
the City consents to the closure of said portion of Highland Drive as set forth herein and
will retain ownership of that tract; and
WHEREAS, Mr. William C. Parr owns the property on the west side of the
herein -described portion of Highland Drive to the centerline, and Mr. Parr has
consented to the closure of that portion of Highland Drive as evidenced by his signature
on the attached Consent to Restricted Access to Platted Street attached hereto as Exhibit
,iCr, and further consents to the abandonment of said portion of Highland Drive and to
the donation to the City of his ownership interest in said portion of Highland Drive, as
evidenced by his signature on the Donation Agreement and Quitclaim Deed attached
hereto as Exhibits "D" and "E" respectively; and
WHEREAS, no lot in the Subdivision requires access to said portion of Highland
Drive; and

WHEREAS, in order to maintain quality of life for the citizens of Georgetown,
the City Council finds it to be in their best interest to prohibit vehicular through traffic
(except for parking) from using the above-described portion of Highland Drive as its
means of access, ingress or egress to the Subdivision or any lot therein; and
WHEREAS, the City Council called a public hearing on the proposed
abandonment of said portion of Highland Drive to be held in conjunction with its
regular meeting in the City Council Chambers at 101 E. 7f Street (northeast corner of 711
& Main Streets) in Georgetown, Texas, on the 28th day of April, 2009, commencing at
6:00 p.m., of which due notice was given by publication one (1) time in the Williamson
County Sura, a newspaper of general circulation in the City on the 22nd day of April,
2009, and said public hearing was held on the day stated in said notice; and
WHEREAS, upon considering the matter, the City Council now finds that (a)
there are no existing City utilities located within the property to be abandoned; OR (b)
the utilities existing in the area of the street, alley, and/or public right-of-way will be
sufficiently protected by being either relocated, placed into easements, or having their
rights reserved from quitclaim of the subject street, alley or public right-of-way, and
except for diose so reserved, that the utility companies serving the area including and
surrounding the right-of-way have determined that their utilities, if existing, will also
be sufficiently protected by the same means.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE OF
GEORGETOWN: I
SECTION 1. The facts and recitations contained in the preamble of this
ordinance are hereby found and declared to be true and correct, and are incorporated
by reference herein and expressly made a part hereof, as if copied verbatim. The City
Council hereby finds that this Ordinance implements the following 2030
Comprehensive Plan Goals, Policies and Actions:
Goal 4.1 Efficient, Responsive Government.
4.1.B We have created and enforced innovative, effective and fair regulatory codes
and developed standards to guide growth and improve development quality. We
have streamlined the regulatory process, particularly for desired development
types and locations.

Further, the City Council hereby finds that the enactment of this Ordinance is not
inconsistent with or in conflict with any other 2030 Comprehensive Plan Goals, Policies
and Strategies.
SECTION 2. That the subject portion of Highland Drive described on Exhibits
„A„ and °`B" attached hereto and made a part of this ordinance for all purposes, be, and
the same is hereby abandoned, vacated and closed insofar as the right, title or easement
of the public is concerned; subject, however, to the conditions, requirements and
restrictions hereinafter more fully set out.
SECTION 3. That said portion of Highland Drive right-of-way is not needed for
public street right of 'way purposes and it is in the public interest of the City of
Georgetown to abandon the described portion of thestreetright-of-way.
SECTION 4. That the abandonment provided for herein shall extend only to the
public right, title and easement in and to the tracts of land described in SECTION 2 of
this ordinance and on Exhibits "A" and "E" and shall be construed only to that interest
the governing body of the City of Georgetown may legally and lawfully abandon.
SECTION 5. That the abandonment is made subject to all present zoning and
deed restrictions if the latter exist, and all drainage and utility easements, whether
apparent or non -apparent, aerial, surface or underground.
SECTION b. The City Council hereby approves the Donation Agreement and
Quitclaim Deed attached hereto as Exhibits "D" and "E", respectively.
SECTION 7. This ordinance shall be and is hereby declared to be cumulative of
all other ordinances of the City of Georgetown, and this ordinance shall not operate to
repeal or affect any of such other ordinances, except .insofar as the provisions thereof
might be inconsistent or in conflict with the provisions of this ordinance, in which event
such conflicting provisions, if any in such other ordinance or ordinances are hereby
superseded.
SECTION 8. If any provision of this ordinance or application thereof to any person
or circumstance, shall be held invalid, such invalidity shall not affect the other provisions,
or application thereof, of this ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this ordinance are hereby
declared to be severable.

SECTION 9. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This ordinance shall become effective and be in full force and effect in
accordance with the provisions of the Charter of the City of Georgetown.

BEING 0.156 of an acre of land, situated in the Highland Drive (Easy Street), a dedicated street as shown on the

The parties to this Donation Agreement are William C. Parr ("Donor"), whose

Donor has agreed to donate to the City certain real property being more
particularly herein defined and the City has agreed to accept the donation of said real
property for the placement,. construction, operation, repair, maintenance, replacement,
upgrade, rebuilding, relocation and/or removal of public parking facilities, including
but not limited to, pavement, sidewalks, and utilities (collectively, the ";Facilities") on,

a dedicated street as shown on the Plat of Highland Park Revised, a subdivision of
record in Cabinet A, Slides 369-371, of the Plat Records of Williamson County,
Texas; said 3,395-square400t tract being more particularly described by metes and
bounds in Exhibit "A" and by sketch in Exhibit 'B", attached hereto and made a
part hereof (the "Property").
1. The Donor hereby agrees, on. -even date herewith, to give, grant, and convey
the Propert5r by Quitclaim Deed to the City in the form attached hereto as
Exhibit "C",
2, The Donor and the City agree that the value of the Property is NINE
HUNDRED TWENTY and no/100 DOLLARS ($920.06).
3. At the election and expense of the City, the City may obtain an Owner's Title
Policy over the Property in the amount of the agreed value, insuring the
City's record title to the Property to be good and indefeasible, which policy
shall be subject only to the standard exceptions to title
4. The Donor shall deliver the executed Property to the City and sole
possession of the Property to the City upon acceptance by the City Council
of this Agreement.

the Plat of Highland Park Revised, a subdivision of record in Cabinet A, Slides 369-371, of the Plat Records of
Williamson County, Texas. Surveyed on the ground in the month of November, 2008, under the supervision of
Brian F. Peterson, Registered Professional Land Surveyor, and being more particularly described as follows;
BEGINNING at an iron pin found on the West line of the above -referenced Highland Drive, marking the most
easterly Northeast corner of Lot 3, Block 3, of the above -referenced Highland Park Revised, said I.,ot 5, Block
