HomeMy WebLinkAboutORD 2009-16 - Temporary Food EstablishmentsAn Ordinance of the City Council of the City of Georgetown, Texas, Amending Section 8.12.020 of the Georgetown Municipal Code Relating to the Definition of "Temporary Food Establishment"; Repealing Conflicting Ordinances and Resolutions; Including a Severability Clause; and Establishing an Effective Date. WHEREAS, the Williamson County and Cities Health District (the "Health District") is the agency designated to issue permits and inspect all food establishments within the City of Georgetown, Texas (the "City"); and WHEREAS, the Health District represents several municipalities with different regulations relating to food sanitation; WHEREAS, the Health District has requested that the City amend its ordinance pertaining to food sanitation to establish consistent regulations across its district; and WHEREAS, the City Council of the City of Georgetown, Texas, finds that it is in the public interest to make the changes in the food sanitation regulations as requested by the Health District. • ! • ! • ! ! • •ITITITE • , SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance is not inconsistent or in conflict with the 2030 Comprehensive Plan. SECTION 2. The definition of "Temporary Food Establishment" in Section 8.12.020 of the City of Georgetown Code of Ordinances is hereby amended to provide as follows: Temporary food establishment means: Ordinance No. a(VU-41-0 LID Amending "Temporary Food Establishment" definition in Sec. 8.12.020 Page 1 of?. (1) a food establishment that operates for more than 4 hours in a single day, serves potentially hazardous foods, and is open to the general public; or (2) a food establishment that operates for a period of no less than 2 consecutive days and no more than 14 consecutive days in conjunction with a special event or celebration. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
