An Ordinance of the City Council of the City of Georgetown, Texas, amending
part of the Zoning District Map, adopted on April 4, 2002 in accordance with the
Unified Development Code passed and adopted on March 11, 2003, to change 2.03
acres, out of the Frederick Foy Survey, abstract 229, to be known as the Sun City
Second Fire Station and Temporary Construction Facility, from AG, Agriculture to
PUD, Planned Unit Development, with a Base District of C -N, as recorded in
document number 199968996 of the official records of Williamson County, Texas;
repealing conflicting ordinances and resolutions, including a severability clause,
and establishing an effective date.

number 199968996 of the official records of Williamson County, hereinafter referred
to as "the property";
Whereas, the City Council has submitted the proposed change in the Base Ordinance to
the Planning and Zoning Commission for its consideration in a public hearing and for its
recommendation or report; and
Whereas, notice of such hearing was published in a newspaper of general circulation in
the City; which stated the time and place of hearing, which time was not earlier than fifteen (15)
days for the first day of such publication; and
Whereas, written notice was given not less than fifteen (15) days before the date set for
the meeting before the Planning and Zoning Commission to all the owners of the lots within two
hundred feet of the property, as required by law; and
Whereas, the applicant for such zoning change placed on the property such sign(s) as
required by law for advertising the Planning and Zoning Commission hearing, not less than
fifteen (15) days before the date set for such hearing; and
Whereas, in compliance with Section 4.04.030(A)(2) of the Unified Development Code a
Development Plan was submitted in conjunction with the requested establishment of the
Planned Unit Development District,

Whereas, the City Planning and Zoning Commission in a meeting held September 2,
2008, recommended changing said zoning district classification of the above described property
from AG, Agriculture District classification to PUD, Planned Unit Development, with a CN,
Neighborhood Commercial Base District, in accordance with attached Exhibit B and also
recommended adoption of the Development Plan for the Planned Unit Development, attached
hereto as Exhibit A.

Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas
Section 1. The facts and recitations contained in the preamble of this ordinance are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this
ordinance implements the following objective of the 2030 Comprehensive Plan Vision Statement
and Future Land Use Goals and Policies:
Vision Statement 4.0 — Effective Governance
4.D. Georgetown has anticipated and planned for the long-range need for public facilities
including police, fire, recreation and libraries.
Land Use Goal 3: Provide a development framework... that provides for efficient provision of
public services and facilities as the city expands.
Section 2. The City Council hereby finds that the proposed Planned Unit Development
and Development Plan satisfy the approval criteria of Section 3.06.030 and Section 3.06.404 of
the Unified Development Code, as follows:
Section 3.06.030 Approval Criteria (Rezoning)
A. The application materials submitted provide complete, sufficient and correct
information necessary to render adequate review and final action;
B. The proposed PUD district is consistent with the 2030 Comprehensive Plan land use
designation of "Moderate Density Residential" and implements the Goals./ Policies
of the future Land Use Plan as referenced in Section 1of the Ordinance;
C. The proposed PUD district promotes the health, safety, or general welfare of the City
and the safe, orderly and healthful development of the City by allowing
development consistent with the General Plan land use designation;
D. The proposed PUD district is compatible with the zoning and use of surrounding
properties and with the character of the surrounding area;
E. The site is suitable for the range of uses proposed with the PUD district.
Section 3.06.040 Approval Criteria (Planned Unit Development)

1. The proposed PUD achieves a orderly and creative arrangement of the land uses proposed
within the development and in their relationship to the larger community;
2. The proposed PUD establishes a planned and integrated transportation system which takes
into consideration vehicular and pedestrian circulation;
3. The location of buildings, and the proposed amenity areas, are designed in a manner to
maximize the natural environment and take advantage of existing open space;
4. The provision of public utilities and services will be accommodated in a timely manner as
established by separate Development Agreement between the City and Developer.
and further finds that the enactment of this ordinance is not inconsistent or in conflict with any
other 2030 Comprehensive Plan Policies.
Section 3. The Zoning District Map of the City, as well as the Zoning District for the
Property shall be and the same is hereby changed from AG, Agriculture District classification to
PUD, Planned Unit Development, with a CN, Neighborhood Commercial Base district in
accordance with Exhibit B attached hereto and incorporated by reference herein is hereby
adopted by the City Council of the City of Georgetown, Texas.
Section 4. The Development Plan accompanying the Planned Unit Development,
attached hereto as Exhibit A. is hereby adopted by the City Council of the City of Georgetown,
Texas.
Section 5. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
Section 6. If any provision of this Ordinance or application thereof to any person or
circumstance shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this Ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this Ordinance are hereby declared to be severable.
Section 7. The Mayor is hereby authorized to sign this Ordinance and the City Secretary
to attest.

L.P.. CONCERNINIG THE DEVELOPMENT OF SLS CITY TEXAS"' dated May 30,,
2006 (the `Eiahth Amendment";) and is subject to the Development Agreement between
the City of Georgetown and Del Webb Texas Limited Partnership, dated February 14,
1995 as amended by Amendments One through Eight (collectively, the "Development
Agreement'}. Pursuant to Section 4 of the Eighth Amendment, the City's Development
Regulations in effect on February 27, 2001 govern this application and all other
development approvals for the site. The Sun City Texas Second Fire Station site.
however, will be in compliance with the 2007 version of the Georgetown Unified
Development Code (UDC), except as established in this exhibit. Applicant's agreement
to comply with the 2007 version of the UDC is applicable only to this property and
does not waive any of Applicant's rights under the Development Agreement with.
respect to development approval applications for other properties.
The Eiahth Amended Concept Plan for Sun City Texas (Exhibit B to Eiahth
Amendment, City Council Date: March 28, 2006) identifies a 2 acre Fire Station site in
the northwest portion of the community, "Second Fire Station Site". Consistent with
the terns of the approved Concept Plan and Development Agreement, the Applicant
agrees and intends that the pezmanent use of the Second Fire Station Site will be said
future fire station, Per the Development Agreement, Second Fire Station Site property
is required to be conveyed to the City no later than the issuance of the 6,000��
residential building permit in Sun City. However, prior to that time on a ternporary
basis, the Second Fire Station Site shall be allowed to be used as an office for
construction, administrative and customer service in accordance with the terms and
conditions specified below.
The temporary office use shall cease on the later of: (a) the date that the Second Fire
Station Site is conveyed to the City per the requirements of the Eighth Amended
Development :4greement by and between Del Webb Texas Limited Par tnerslup and the
City of Georgetown, or (b) the date specified in a lease or license or other wr-itten
agreement between the City of Georgetown and Pulte, if the City in its sole discretion
chooses to authorize such use after the City acquires ownership of the Second Fire
Station Site.

The Second Fire Station Site shall only include the following uses. All other uses shall

1. Permanent Use - Public (government facility) - said use allowed only by the
City of GeorcRetown or an Emergency Scivices District.
2. 'Temporary Use - Office, limited and conditioned as follows:
a. Duration of Use - The Office use shall cease on the later of: (a) the date
that the Second Fire Station Site is conveyed to the City per the
requirements ofthe Eighth Amended Development Agreement by and
between Del Webb Texas Limited Partnership and the City of
Georgetown, or (b) the date specified in a lease or license or other written
agreement between the City of Georgetown and Pulte, if the City in its
sole discretion chooses to authorize such use after the City acquires
ownership of the Second Fire Station Site.
b. Authorized Office Uses. The uses allowed on the Second Fires Station
Site during the temporary use period shall be limited to the followina:
Use by Pulte for construction, administrative, customer service, and
developer staff office, employee locker room(s), kitchen.
c. Building Limits. Only the following buildings shall be allowed: No
more than four (4) trailers combined into one structure with the total
square footage of all structures not to exceed 2600 sq. ft.
D. Concei)tual Da-elopment Plan ('Exhibit Q
Due to the Applicant's desire to use the tract as a temporary construction facility before
the conveyance of the property to the City, the Applicant has prepared a conceptual
plan for the proposed temporary construction facility for the purposes of this
development plan. This conceptual Plan, Exhibit C of this PUD, illustrates the design
intent of the facility and matches the Site Plan submitted to the Citv. Per the teams of
the rJDC section 3.09.050, the approval of the Second Fire Station Site Plan at a fiiture

date shall supersede the previously approved Site Plan for the temporary .ons Lructioii

E. Standards for Second Fire Station:

The `Build -to" line provision outlined in Chapter 6.03 of the UDC shall be waived for
placement of the fire station and all other permanent structures to be built by theCity
of Georgetown due to fire truck access and publicsafety necessities.
2. Parking requirements
A minimum of 1 space per 750 s.f. of Enclosed Floor Area
3. Impervious Cover
Per the Georgetown UDC, Section 11.02, the impervious cover limit for land over the
Edwards Aquifer is 50° o with the potential for increases up to 65% with waiver criteria.
The impervious cover maximum for the Second Fire Station site shall be 65%, provided
that waiver criteria is met. The calculation of the impervious cover shall be measured
based on the land area defined by the legal description, Exhibit B.
Additionally, this development plan will be in compliance with the impervious cover
limitations outlined within the Eighth Amendment of the Sun City Texas Development
Agreement. Exhibit G of the Development Agreement establishes a 40 percent
maximum impervious cover in overall development.
4. Building Coverage
The building coverage maximum shall be 45%. The calculation of the building
coverage shall be measured based on the land area defined by the Legal description
Exhibit B.
Additionally, the Second Fire Station will be in compliance with the building coverage
limitations outlined within the EI hth Amendment of the Sun City Texas Development
Agreement. Exhibit G of the Development Agreement (Revised by City Council
March 28, 2006) establishes a 30 percent maximum building coverage in overall
development

Accessory buildings to the Second Fire Station are not subiect to review and

7. Architectural Criteria
Once the design of the fire station building structures within the development is refined
and finalized, a comprehensive architectural theme will be developed which will
specify the architectural style, materials and colors. The theme will be consistent with,
and compliment the established theme within the Sun City Texas Faster Manned
Community. In order to convey the architectural theme, items such as architectural
elevations, material sample boards and color samples may be submitted to the City for
review at the time of site planning review.
8. primary Landscape Requirements
The Second Fire Station shall meet the landscaping and buffering requirements of a C-
3 General Commercial District, as described in Chapter 8 of the Georgetown UDC.
9. Signage
The control and placement of signs is especially important to the aesthetic harmony of
Sun City Texas. A critical component of a cohesive community is the sense of place
and identity. All signage associated with the Second Fire Station. facility will be
consistent with the Sun City Texas Master Sign Flan.
F. Standards for 'ITemL)orary Construction Facility -

e. Tree Canopy
Tree Canopy Area shall be calculated as 15 percent of the entire lot square footage
as definedin Exhibit C. The calculation for the mature crown area of all retained
and planted trees from the. City approved tree list (Table 8.04.020, Tree. Canopy
List) shall be given a mature canopy square footage credit of 1.26 square feet.
All trees not on the tree list will be given a mature canopy, square footage credit of
79 square feet. Tree Canopy Credits may be met by all existing trees that are
retained and all planted trees, as well as any trees planted within the adjacent right
of way.
f. Replacement 'Frees
It is the design intent of the PUD to create a setting that enhances and showcases
the natural setting of the site. A tree survey has identified all ten (10) inch caliper
or greater trees within the PUD. Through the design process, the design may
result in the loss of some ten (10) inch caliper or greater trees. In such cases, all
surveyed trees over ten (10) inches shall be replaced and may provide credit
toward required Primary Landscape requirements or replacement trees on a 1 tree
to 1 tree basis.
Replacement trees must be a minimum of 4 inches in caliper.
All replacement trees must be of the salve species or comparable
alternative and the same size at maturity as the trees removed.
All replacement trees must be located within the lot, as defined in Exhibit
C.
Replacement Tree Calculation shall be calculated as 20 percent ofthe total caliper
inches of trees removed equaling the total inches to be replaced. In addition, much
of the existing vegetation, including trees smaller than ten (10) inches and
und.erstory brush, which are not within the construction area, will be retained as
pari ofihe screening of the site
