WHEREAS, the City Council of the City of Georgetown re -negotiated a garbage hauling and disposal
contract with Texas Disposal Systems (TDS) in August 2007; and
WHEREAS, the City of Georgetown recognized that the frequent fluctuations in fuel costs experienced
by TDS must be managed by means other than constant rate changes; and
WHEREAS, the TDS contract allows for the purchase of fuel, from the City, at a contracted rate, for the
purpose of providing solid waste disposal services to the City of Georgetown customers; and
WHEREAS, the City of Georgetown wishes to implement rates and charges that fully recover the cost
of providing solid waste disposal services; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS; that the Solid Waste Disposal Rate Schedule be amended to include a
solid waste fuel cost adjustment, to be calculated and applied separately from rates listed in the rate
schedule, and to be effective on all billings after October 1, 2008.
SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found
and declared to be true and correct, and are incorporated by reference herein and expressly made a
part hereof, as if copied verbatim. The City Council hereby finds that this ordinance complies with the
Vision Statement of the City of Georgetown 2030 Comprehensive Plan.
SECTION 2. Existing Section 13.04.180 is hereby deleted in its entirety and replaced with the
following:

B. Solid Waste Fuel Cost Adjustment (SWFCA) Charge: The SWFCA charge shall be increased or
decreased to reflect fluctuations in fuel costs, as they are related to the City's contracted solid waste
fuel price, and calculated in accordance with § 13.04.181.
C. Sales Taxes: Sales taxes, where applicable, will be charged to the customer in addition to the
above rates and adjustments.
D. If service is rendered during any portion of any month, the customer will be required to pay a

pro -rated fee for service.
E. Except as provided in this section, all owners, occupants, tenants and lessees using or
occupying any building, house or structure within the corporate limits of the City shall be required
to use exclusively the City's waste disposal services.
F. Catastrophic storm cleanup will be provided, within the city limits, by a contractor appointed
by the City, at the discretion of the Assistant City Manager of Utilities or his assignee. Costs for
catastrophic storm cleanup will be assessed evenly to all Tier I customers as a one-time charge,
additional to the monthly sanitation fee, on the utility bills, after the cleanup has been completed
and the cost of the cleanup has been established.
G. Customers requesting replacement of the City -provided sanitation container, three or more
times in a calendar year, may be required to pay a replacement fee equal to the cost incurred by the
City sanitation contractor to replace it. Such fee will be charged to the customer's utility bill as a
one-time charge.
13.04.181 Solid Waste Fuel Cost Adjustment Charge (SWFCA)
A. Availability. When applicable, the SWFCA Charge shall be applied uniformly to all solid
waste customers of the City, in addition to rates listed in the Solid Waste Rate Schedule,
B. Purpose. The SWFCA Charge is designed to accurately recover from City solid waste
customers, the cost of fuel, over and above the base fuel cost included in the City's retail solid
waste rate schedules. All additional fuel costs realized, at rates other than the contracted price, and
determined in accordance with the provisions set forth below, shall be billed by the City on its
monthly bills,
C. If service is rendered during any portion of any month, the customer will be required to pay a
pro -rated fee for service.
D. Calculation: The SWFCA shall be calculated as follows:
Adjustment = [(Contracted Fuel Price) — (Average Fuel Price) CFY Y] x Total Gallons CFY x
Where:
(Contracted Fuel Price) = the Actual cost of Fuel at the starting date of the contract and as adjusted
annually for each subsequent City fiscal year.
(Average Fuel Price)cFY Y = the total sum paid to the City for fuel in City Fiscal Year Y, divided by
the number of gallons of fuel purchased by Contractor from the City in City Fiscal Year Y.
CFY = City Fiscal Year = the period beginning on October 1 of each calendar year, and ending on
September 30 of the following calendar year.
CFY X = City Fiscal Year X = is the current fiscal year for each year of the Contract.

CFY Y = City Fiscal Year Y = the City Fiscal Year preceding FY X. The City fiscal year begins on
October 1 of each calendar year, and ends on September 30 of the following calendar year.
Total Gallons = the total number of gallons of fuel for Contractor's fleet vehicles fueled at the
City's fuel station based on City records, plus the total number of gallons from transfer trailer
trucks that are used to provide Services under this Contract that are not fueled at the City's fuel
station, based on records provided by the Contractor the City in sufficient detail to demonstrate
that the fuel is related to services under this Contract.
E. The SWFCA Charge shall be evenly allocated to all City solid waste customers, and charged to
each customer's City utility bill monthly, for a time period set by the Assistant City Manager -
Utilities, until the cost of the adjustment is recovered.
SECTION 3. All Ordinances and Resolutions, or parts of Ordinances and Resolutions that are in
conflict with this Ordinance are hereby repealed, and no longer in effect.
SECTION 4. If any provisions of this Ordinance or application thereof to any person or circumstance,
shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this
Ordinance which can be given effect without the invalid provision or application and to this end the
provisions of this Ordinance are hereby declared to be severable.
SECTION 5. The Mayor of Georgetown is hereby authorized to sign this Ordinance and the City
Secretary to attest. This Ordinance shall become effective and be in full force in accordance with the
terms of the City Charter on billings after November 1, 2008.
