HomeMy WebLinkAboutORD 2008-56 - REZ Wesleyan EstrellaORDINANCE NO 0700f� 540V An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the Zoning District Map adopted on the 411, Day of April 2002 in accordance with the Unified Development Code passed and adopted on the 11th Day of March 2003, to rezone 39.996 acres in the David Wright Survey, also known as the Wesleyan Homes Senior Community, from AG, Agriculture District to PUD, Planned Unit Development District with a base zoning district of MF, Multifamily, as recorded in Volume 936, Page 510 of the Deed Records of Williamson County, Texas, and Document Numbers 2008039383, 2002001643, 2006003817, 2006014163 and 9638840 of the Official Public Records of Williamson County, Texas; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. Whereas, an application has been made to the City Council for the Purpose of changing the Zoning District Classification of the following described real property ("The Property"): 39.996 acres in the David Wright Survey as recorded in Volume 936, Page 510 of the Deed Records of Williamson County, Texas, and Document Numbers 2008039383, 2002001643, 2006003817, 2006014163 and 9638840 of the Official Public Records of Williamson County, Texas, hereinafter referred to as "The Property'; Whereas, the City Council has submitted the proposed change in the Base Ordinance to 4: the Planning and Zoning Commission for its consideration at a public hearing and for its recommendation or report, and Whereas, notice of such hearing was published in a newspaper of general circulation in the City; which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and Whereas, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by law; and Whereas, the applicant for such zoning change placed on the property such signs) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and Whereas, the City Planning and Zoning Commission in a meeting held on August 5, 2008, recommended approval of the requested zoning change for the above described property from AG, Agriculture District to PUD, Planned Unit Development District with a base zoning district of MF, Multifamily with the following condition: (1) The existing drive aisle that is within the required 20 -foot rear setback shall be removed and relocated to be consistent with the remaining proposed drive aisle at approximately 50 -feet from the property line. Wesleyan Homes Senior Community r � AG to PUD Zoning Page 1 of 3 that: Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas, Section 1. The facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this Ordinance implements the following vision of the Georgetown 2030 Comprehensive Plan, specifically the following goals, policies and actions of the Land Use Element: i Goal 1: Promote sound, sustainable, and compact development patterns with balanced land uses, a variety of housing choices and well -integrated transportation, public facilities, and open space amenities. i Policies/Actions 1E.3: Promote mixed-use, pedestrian friendly land use patterns, including community activity centers, neighborhood activity centers, conservation subdivisions, and walkable neighborhoods. ® Goal 4: Maintain and strengthen viable land uses and land use patterns (e.g., stable neighborhoods, economically sound commercial and employment areas, etc.). • Policies/Actions 4A: Minimize impacts of/encroachments by incompatible land uses (e.g., commercial intrusions into healthy residential neighborhoods). and further finds that the enactment of this Ordinance is not inconsistent or in conflict with any other policies of the Georgetown 2030 Comprehensive Plan. Section 2. The Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from AG, Agriculture District to PUD, Planned Unit Development District with a base zoning district of MF, Multifamily in accordance with Exhibits A (Location Map), B (PUD Development Plan with Conceptual Land Plan and Conceptual Landscape Plane) and C (Legal Description/Field Notes) and incorporated herein by reference, is hereby adopted by the City Council of the City of Georgetown, Texas, Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section d. The Mayor is hereby authorized to sign this Ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect on the date of final adoption by City Council. PASSED AND APPROVED on First Reading on the 26th day of August 2008. Property This Development Plan covers approximately 39.996 acres to be known as Wesleyan Homes Senior Community. The site is located at Williams Drive and Estrella Crossing as depicted in Exhibit A. 21 • The purpose of the development plan is to augment the City's Unified Development Code (UDC) to ensure a cohesive, quality development that may occur in multiple phases. The vision for the Wesleyan Homes Senior Community is to develop a community campus that will include a variety of living facilities and amenities to primarily serve the residents of the Wesleyan Community. The project will provide a combination of age -restricted residential products, including independent living, assisted living, nursing and final care. The existing independent living retirement facility is at the center of the development and provides studio, one -bedroom and two-bedroom residence units integrated with dining and activity facilities. The second phase will include duplex cottages and an assisted living community offering a continuum of living in the same development. A future third phase will add more duplex cottages and a skilled or long term nursing center, providing the final level of residential care to the community. Along with these housing options, Wesleyan Homes will provide a community amenity center with possible on-site food service, an adult daycare center and a wellness center to provide health and exercise opportunities for both the residents of Wesleyan Homes as well as the outside public. The community will be unified by compatible architectural style, landscaped open space with walking trails and convenient circulation and parking. In accordance with Unified Development Code Section 4.04.030(5) "Development Plan", the following is a summary of the design standards for the development of Wesleyan Homes Senior Community. The purpose of this Development Plan is to establish standards for fevelopment including land uses, building - •. landscaping • a '•: parking requirements not anticipated by the underlying zoning. The base zoning classification used with this PUD district is "MF", Multifamily, as described in Section 4.04.010(G) and the general standards described in Table 6.02.030 of the Unified Development Code (UDC). Except for those requirements specifically deviated by this Development Pian, all development standards established in the most current version of the UDC for the "MF" zoning district shall be applicable to the development of this project. Building Setbacks: The building setbacks along Williams Drive and Estrella Crossing will be 25 feet. Side and rear setbacks adjacent to lot 2 currently agricultural/ residentially zoned, but commercial in the future shall be 10 feet minimum. All other setbacks shall be 20 feet minimum. All properties in this scope of work will be under the jurisdiction of the city of Georgetown, Texas.
