ORDINANCE NO.
An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the
Zoning District ?map adopted on the 4�' Day of Apri12002 in accordance with the Unified
Development Code passed and adopted on the 11t'' Day of March 2003, to rezone 0.634 acres
being Lot 5, Block.", Highland Park Revised Subdivision, from. C-3, General Commercial
District to C-1, local Commercial District, as recorded in Document Number 2005062134 of
the Official Public Records of Williamson County, Texas; repealing. conflicting ordinances
and resolutions; including a severability clause; and establishing an effective date.
Whereas, an application has
been made to
the City Council for the
Purpose of changing
the Zoning District
Classification of
the following
described real property
("The Property"):
0.634 acres being Lot 5, Block 2, Highland Park Revised Subdivision, recorded by
deed in Document Number 2005062134 of the Official Public Records of
Williamson County, Texas, hereinafter referred to as "The Property";
Whereas, the City Council has submitted the proposed change in the Base Ordinance to
the Planning and Zoning Commission for its consideration at a public hearing and for its
reconu-nendation or report; and
Whereas, notice of such hearing was published in a newspaper of general circulation in
the City; which stated the time and place of hearing, which time was not earlier than fifteen (15)
days for the first day of such publication; and
Whereas, written notice was given not less than fifteen (15) days before the date set for
the meeting before the Planning and Zoning Commission to all the owners of the lots within tram
hundred feet of the property, as required by law; and
Whereas, the applicant for such zoning change placed on the property such sign(s) as
required by lam= for advertising the Planning and Zoning Commission hearing, not less than
fifteen (15) days before the date set for such hearing; and
Whereas, the City Planning and Zoning Commission in a meeting held on August 5;
2008, recommended approval of the requested zoning change for the above described
property from C-3, General Commercial District to C-1, Local Commercial District.
Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas,
that:
Section 1. The facts and recitations contained in the preamble of this Ordinance are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly= made a part hereof, as if copied verbatim. The City Council hereby finds that this
Ordinance implements the following vision of the Georgetown 2030 Comprehensive Plan,
specifically the following goals, policies and actions of the Land Use Element_

Goal 4: Maintain and strencthen viable land uses and land use patterns (e.tr., stable
neighborhoods, economically sound commercial and employment areas, etc.}.
Policies/Actions 4A: Minimize impacts of/encroachments by incompatible land uses
commercial intrusions into healthy residential neighborhoods).
and further finds that the enactment of this Ordinance is not inconsistent or in conflict with � anv
other policies of the Georgetov,Tn 2030 Comprehensive Plan.
Section
2. The Base Ordinance and the
Zoning Map of the City,
as well as the Zoning
District for the
Property shall be and the same
is hereby clanged from
C-3, General Commercial
District to C-1, Local Commercial District in accordance with Exhibits A and B (Location Map
and Field Notes) and incorporated herein by reference, is hereby adopted by the Cite Council of
the City of Georgetown, Texas, subject to the following conditions:
a. The permitted use on the site shall be limited to the off-site parking for the City's
buildings located at 300 and 301 Industrial avenue.
b. A landscaped buffer between the subject property and the contiguous parcels to
the north and the west shall be required, consisting of the following:
i. A ten (10) foot wide planting area with an average of one deciduous tree, one
deciduous shrub and one evergreen shrub per 50 linear feet that may include
diversion feature with possible concrete rip -rap bottom;
ii. A solid six (6) foot screen fence.
Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
Section 4. If any provision of this Ordinance or application thereof to any person or
circumstance shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this Ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this Ordinance are hereby declared to be severable.
Section 5. The Mayor is hereby authorized to sign this Ordinance and the City Secretary
to attest. This Ordinance shall become effective and be in full force and effect on the date of
final adoption by City Council.

5. Public Hearing and possible action on a Rezoning of Lot 5 (South Part), Block 2 of Highland
Park Revised, from RS, Residential Single Family district to C3, General Commercial district
located at Highland Drive and West 24th Street.
Staff report was given by Bobby Ray. Staff held a meeting on August 25, 2005 with the
neighbors of this property. Three recommendations were made by the neighbors at this
meeting, which are as follows: 11 to condition the C3 District to limit allowed usages to
commercial parking lots only, 2) to consider abandonment of right-of-wav along Highland
Drive from Industrial Avenue to West 24th Street, which would be used for additional
landscaping and buffering, and 3) to provide a type B landscape buffer with a 17 -foot buffer
and a screen wall fence between this lot and the adjacent residential lot. Staff is supportive
of all of the requested conditions and have placed them in the recominended motion to City
Council. No comments were given by citizens.
Motion by Gibbs to recommend to City Council approval of a Rezoning of Block 2, Lot 5
(South Part), of Highland Park Revised, from RS, Residential Single-family district to C37
General Commercial district located at Highland Drive and West 24th Street. Second by
Shield. Approved 7-0.

Ray read only the caption of the ordinance after having satisifed the requirements of the
City Charter. Motion by Carr, second by Sansing to approve the ordinance on first reading.

1 Public Hearing and possible action on a Rezoning from C-3; General Commercial District to C-
1, Local Commercial District for 0.634 acres being Lot u, Block 2, Highland Park Revised
Subdivision, also known as Cite of Georgetown Municipal Complex Parking improvements,
Located along hndustrial Avenue. (VK) REZ-2003-011 Staff report given by Valerie Kreger. The
approximately 0.634 acre site is located. on the north side of Industrial Avenue, west of the
GeorgetoNAm Municipal Complex (see Exhibit A). The property, currently undeveloped, has an
existing zoning classification of C-3, General Commercial District. The Future Land Use mai

identifies this location as Mixed Use Neighborhood Center. The Cityof GeorgetoNfvn is
proposing a rezoning from the C-3 District to the C-1 District, which will be a decrease in the
intensity of uses allowed. The City intends to construct an off-site parking Iot to serve the
nearby Cite offices. Currently, overflown parking for the Georgetown Municipal Complex
consists of parallel parking on both sides of Industrial Avenue. The C-3 District requires a 2S -
foot front building setback is1 which parking is not allowed. Without a change in zoning or a
variance, the lot does not provide adequate developable area for a non-residential use. This site
sits just off the very southern end of a dead-end (blocked off) Highland Drive, but the only
driveway access will be from Industrial Avenue. Along with the rezoning, the Citv is in the
process of abandoning Highland Drive, further elimiriat ng any possibility of future connection
to Industrial Avenue. The requested zoning district of C-1 is appropriate given the 2030 Land
Use designation of Mixed Use Neighborhood Center and Employment Center. Ilae site's
Mixed Use Neighborhood Center land use designation supports smaller areas of mixed
commercial use within existing and new neighborhoods, allowing for corner stores, small
grocery, coffee shops, personal services, professional offices, and non-commercial uses such as
churches, schools and upper story residential. The Employment Center designation supports
well planned, larger scale employment and business activities. The C-1 District is intended to
provide areas for commercial and retail activities that primarily serve residential areas, but are
not appropriate along residential streets or collectors. The district permits commurd.ty service,
educational, governmental and medical facilities, and restaurants, offices, retail sales and
personal services. Staff recomrnends approval of the zoning change. Chair Gibbs invited the
Applicant to speak. Since this is a City Project, staff reported. Chair Gibbs opened the public
hearing. Bill Par, 202 West 24th voiced concern about the fencing and drainage. Raul
Rodriguez, from the engineering firm stated a privacy= fence will be added, and with a
detention pond will be in place. The public hearing was closed.
Motion by Milburn to recommend to the City council Approval of a Rezoning from C-3,
General Commercial District to C-1, and Local Commercial District for approximately 0.634
acres described as Lot 5, Block 2, Highland Park Revised Subdivision, also known as City of
Georgetowrn Municipal Complex Parking Improvements, located along Industrial Avenue.
