Day of April 2002 in accordance with the Unified Development Cade passed and adopted on the 1111% Day of March 2003, to rezone 10.47 acres in the Wright Survey from AG, :agriculture District to C-3, General Commercial District, as recorded in Document Number.) 00401891.1 of the Official Public Records of Wlilliam son County, Texas; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. Vt7hereas, an application has been made to the City Council for the Purpose of changing the Zoning District Classification of the following described real property ("The Property 10.47 acres in the SA%'righ.t Survey recorded by deed in Document Number 2004018911 of the Official Public Records of Williamson County, Texas, hereinafter referred to as "The Property Whereas, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration at a public hearing and for its recommendation or report; and Whereas, notice of such hearing was published in a newspaper of general circulation in the City; which stated the time and place of hearing, which time was not earlier than fifteen (15') dans for the first day of such publication; and Whereas, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the Lots within two hundred feet of the property, as required by law; and Whereas. the applicant for such zoning change placed on the property such sign(s} as rec?uired b�, laws for advertising the Planning and Zoning Commission hearing, not Less than fifteen (15j days before the date set for such hearing; and IA/ Thereas the Citv Planning and Zoning Commission in a meeting held on Au gust 5, 2008, recommended approval of the requested zoning change for the above descriaed property- from AG, Agriculture District to C-3, General Office District. that: ?noir, therefore, be it ordained by the Cite Council of the City= of Georgetown, T exas, Section 1. The facts and recitations contained in the preamble of this Ordinance are I ereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this Ordinance implements the following vision of the Georgetown 2030 Comprehensive Plan, specifically the following goals, policies and actions of the Land Use 'Element: Buo-ee's 2 0 2009`"53 AG to C-3 Zoning Page 1 of 2 Goal 4: Maintain and strengthen viable land uses and land use patterns (estable nei(D-hborhoods, economicaliv sound commercial and emnpiovrnent areas, etc. j. Section 2. The Base Ordinance and the Zoning Map of the Cid-, as well as the Zoning -District for the Property shall be and the same is herel: y changed from AG,Agriculture District to C-3, General Office District in accordance with Exhibits A and B (i ocation Map and Field 'totes) and incorporated herein by reference, is hereby adopted by- the City Council of the Cite of Georgetown; Texas. Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed; and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section 5. The Mavor is herebv authorized to sign this Ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect on the date of final adoption by Citv Council. PASSED AND APPROVED on First Reading on the 26th day of August 2008. Public Hearing and possible action on a Rezoning from AC, Agriculture District to C-3, General Commercial District for 10.47 acres in the Fright Survey, to be Known as Buc-ee`s Cominercial Tract, located at Airport Boulevard and Lakeway Drive. (VK) REZ-2008-01.0 Staff report given by Valerie Kreger. The site is contains approximatelST 10.47 acres located at the northeast corner of Lakewav Drive and Airport Road (see Exhibit A). The existing zoning of the property is AG, Agriculture and currently the site is undeveloped. Tile tract is designated as Employment Center bordering on a Community Commercial Node on the 2030 Future Land li se Plan. The applicant is requesting a rezoning from the AG District to the C-3, General Corrunercial District. Per the submitted letter of intent, the applicant is seeking the rezoning in order to develop commercial uses including. general retail and restaurant services. The property was annexed into the City's limits on November 28, 2006, (Ord. No. 2006-131 & 2006-133) and assigned the standard interim%holding zoning district of AG. The adjacent property to the east will be part of the same development and was ;ranted C-3 zoning, in June, 2008. Lakewav Drive is proposed to be re -alio ed to allow for a safer and more direct crossing of IH 35. Additional right-of-way, which the applicant is accounting for, will be needed from this tract for that re-aligiunent. Also, additional right-of-way will be required of this tract for future Airport Road improvements. Chair Gibbs invited the applicant to speak.
