HomeMy WebLinkAboutORD 2008-26 - REZ Sun City Golf PUD41) T� UnifiedOrdinanceNo. 4(:7(U0,44 An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the Zoning District Map adopted on April 4, 2002 in accordance with the Development r!- passed and adopted on day of 00 to Springschange 2.415 acres, out of the Frederick Fo-jI.Survem, abstract 229,, located on Cool • b.. known as the Sun City Cowana Facility, as recorded in document number 199968996 of the official records of Williamson County, i AG, Agriculture repealing conflicting ordinances and including severability clause, and establishing an effective date, Whereas, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property ("the property"): 2.415 acres, out of the Frederick Foy Survey, abstract 229, located along Cool Springs Way, to be known as the Sun City Cowan Creek Golf Maintenance Facility, as recorded in document number 9622645 of the official records of Williamson County, hereinafter referred to as "the property"; Whereas, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and Whereas, notice of such hearing was published in a newspaper of general circulation in the City; which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and Whereas, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by law; and Whereas, the applicant for such zoning change placed on the property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and Whereas, in compliance with Section 4.04.030(10(2) of the Unified Development Code a Development Plan was submitted in conjunction with the requested establishment of the Planned Unit Development District, oko, cl o g" Xv Sun City Golf Maintenance PUD Page l of 4 Whereas, the City Planning and Zoning Commission in a meeting held March 4, 2008, recommended changing said zoning district classification of the above described property from AG, Agriculture District classification to PUD, Planned Unit Development, with an RS, Residential base district; in accordance with attached Exhibit B and also recommended adoption of the Development Plan for the Planned Unit Development, attached hereto as Exhibit A. that: Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas Section 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following objective of the 2030 Comprehensive Plan Vision Statement and Future Land Use Goals and Policies: Vision 2.0 - Quality Growth/Sustainable Development 2.1 Throughout Georgetown we have... A. Attracted desired forms of balanced development, creating quality urban, suburban, and rural places that offer a choice of setting, and lifestyle; B. Encouraged residential developments that are well connected to the larger community and are planned and designed to compliment the heritage and natural character of Georgetown and offer a variety of housing types and price ranges; and C. Encouraged sound, compact, quality growth, including pedestrian -friendly development patterns that incorporate mixed uses and densities, conserve resources, and accommodate public transportation, alternative fuel. Goal 1: Promote sound, sustainable and compact development patterns with balanced land uses, a variety of housing choices and well -integrated transportation, public facilities and open space amenities. Policy LA: Encourage a balanced mix of residential, commercial, and employment uses at varying densities and intensities, to reflect a gradual transition from urban to suburban to rural development. Section 2. The City Council hereby finds that the proposed Planned Unit Development and Development Plan satisfy the approval criteria or Section 3.06.030 and Section 3.06.404 of the Unified Development Code, as follows: Section 3.06.030 Approval Criteria (Rezoning) I un Cite Golf Maintenance PUD Page 2 of 4 A. The application materials submitted provide complete, sufficient and correct information necessary to render adequate review and final action; B. The proposed PUD district is consistent with the Comprehensive Plan land use designation of "Residential" and implements the Goals / Policies of the future Land Use Plan as referenced in Section 1of the Ordinance; C. The proposed PUD district promotes the health, safety, or general welfare of the City and the safe, orderly and healthful development of the City by allowing development consistent with the General Plan land use designation; D. The proposed PUD district is compatible with the zoning and use of surrounding properties and with the character of the surrounding area; E. The site is suitable for the range of uses proposed with the PUD district. Section 3.06.040 Approval Criteria (Planned Unit Development) 1. The proposed PUD achieves a orderly and creative arrangement of the land uses proposed within the development and in their relationship to the larger community; 2. The proposed PUD establishes a planned and integrated transportation system which takes into consideration vehicular and pedestrian circulation; 3. The location of buildings, and the proposed amenity areas, are designed in a manner to maximize the natural environment and take advantage of existing open space; 4. The provision of public utilities and services will be accommodated in a timely manner as established by separate Development Agreement between the City and Developer. and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other 2030 Comprehensive Plan. Policies. Section 3. The Zoning District Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from AG, Agriculture District classification to PUD, Planned Unit Development, with an RS, Residential Single -Family base district in accordance with Exhibit B attached hereto and incorporated by reference herein is hereby adopted by the City Council of the City of Georgetown, Texas, Section 4. The Development Plan accompanying the Planned Unit Development, attached hereto as Exhibit A, is hereby adopted by the City Council of the City of Georgetown, Texas. Section 5. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 6. If any provision of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or O 0 pX Sun Cit} Golf Maintenance PUD Page 3 of 4 application thereof, of this Ordinance which can be given effect without rhe invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Purpose and Intent The Cowan Creel: Golf Maintenance Facility PUD is composed of approximately 2.41 5 acres within the Frederick Foy Surve;, Abstract 229 Williamson County (See Exhibit B). The property is located within the land described by Exhibit "A" of the "EIGHTH AMENDMENT TO DEVELOPME?NT AGREEMENT WITH DEL E. WEBB CO., L.P.. CONCERNING THE DEVELOPMENT OF SU?� CITY. TEXAS" dated May 30. 2006 (the `Eighth Amendment") and is subiect to the Development .Agreement between the City of Georgetown and Del \Vtbb Texas Limited Partnership. dated February 14, 1995 as amended by Amendments One through Eight (collectively the "Development Agreement"). Pursuant to Section 4 of the Eighth Amendment. the Citv's Development Regulations in effect on February 27, 2001 govern this application and all other development approvals for the site. Pursuant to meetings with City of Georgetown staff, the Applicant has agreed to develop the PUD for the 2.416 acre. Cowan Creel: Golf Maintenance Facility in compliance with the 2007 version of the Georgetown Unified Development Code (UDC), except as established in this exhibit. The. Applicant recently completed construction ofthe third golfcourse within Sun City Texas. The golf maintenance facility identified within this PUD will be the maintenance facility for the golf course. The site was selected due to its direct access from an unloaded collector. Additionally, development plans will protect surrounding vegetation to provide screening from adjoining. neighborhoods. The contents of this PUD further explain and illustrate the overall appearance and function desired for this facilitti- A Concept Plan has been attached to this PUD. Exhibit C, to illustrate the design intent for the propertN . The Concept Pian is intended to serve as a guide to illustrate the general development vision and design concepis and is not intended to serve as a final document. B. Applicability and Base Zoning All aspects regarding the development of this PUD shall comply with the 2007 version of the Georgetown Unified Development Code (UDC), except as established in this exhibit. titled Exhibit A. For the purpose of complying with the UDC requirement of selecting a base. zoning district. RS has been selected for the Cowan Creek Golf Maintenance Facility at Sun City Texas. Sun Cin, Texas. Facilinv - Planned unit Development PaEe 2 of This PUD allows the flexibility to development the Cowan Creek Golf Maintenance Facility consistent with the character of the existing portions of Sun City, including but not limited to the existing golf course maintenance facilities; while meeting standards established in the 2007 version of the UDC and the Eicrhth Amendment of the Sun Citv Texas Development Agreement. The development will comply with the modified development standards of this PUD. _Specific to the 2.41 5 acre facility; in the case that this PUD does not address a specific City requirement; the Georgetown Unified Development Code shall apply. In the event of a conflict between this PUD and the base zoning- district RS as defined in the 2007 Unified Development Code. this PUD shall control. C. Concept Plan Exhibit C attached is a conceptual development plan intended to visually convey the design intent for the Sun Citv Texas Cowan Creek Golf Maintenance Facility. The facility will consist of one (1) building, associated parking, an outdoor material storage area, fuel storage, a fenced service yard. and water quallIv. The design of the maintenance facility will incorporate a variety of screening programs to screen thefacility from the public roadway and adjoining neighborhoods. Methods of screening will include solid screen walls, the retention of existing native vegetation areas, and the inclusion of manicured landscape areas. As outlined above, the development plan has been designed to provide maximum screening from surrounding areas. As part of the design process Best Management Practices Will be used on the site. Methods includin6. but not Iimited to bio-swales.. will be used as alternative methods to fulfill environmental regulations that apply to the subject tract. Said components may encroach ��,�ithin building setbacks as necessary. D. Allowable Uses The 2 acre facility may include the following; uses: Multi -use Building (approximately 10,000 sq. ft.) Lot Configuration and Building Setbacks The Concept Plan illustrates the site circulation and lot configuration. The Golf maintenance facility development plan is designed with the following building setbacks: ® Front ? feet Rear 20 feet Side 20 feet Circulation and parking design may encroach within the 25 foot front yard setback. In such instances. a minimum 10 foot landscape buffer will be established between the parking lot and public right-of-wayand comply with section H. Parking Lot Landscaping Requirements of the PUD. Storage areas may encroach within building setbacks so long as said facilities are screened from surrounding uses by a solid screen wall. F. Parkina Requirements The. CoNvan Creek Golf Maintenance Facility will comply with Table F.1 Parking Ratio per this PUD. The Parking Ratio outlined below is determined based on the square footage of enclosed building space provided within the facility. Covered portions of the building including but not limited to sun screen areas and covered patios will not be included within the ratio. Parking Lot Screening Requirements It is thedesign intent to reduce the visual impact of parking areas from public right -o' ways. The hedge calculation shall be one (I) evergreen shrub per three (3) linear feet for parking frontage to be screened. In an effort to create naturalistic plant massing screening shall be offset at least six (6) feet ever; 60 linear feet. H. Parking Lot Landseal2ine Requirements The development plan will achieve a landscape feel consistent with the other built golf course maintenance facilities within Sun City Texas. In order to achieve this aoai parking within the PUD will be landscaped to the following standards: A. Parking Lot Landscape Calculation 1. The parking lot landscape area requirements are based on the, percentage of required parking located between the building facade and the street right-of- w�av: for the purpose of this PLD.. 18 square feet of landscaping is required per parking stall. 2. Internal Parking- Lot Landscaping - Two (2) trees and four (4) shrubs shall be planted for each 600 square feet of required landscape area. B. Location All new trees wlithin a parking lot shall be planted in a pervious area of at least 100 square feet and have a minimum interior dimension of 8.6 feet wide. Shading Trees shall be planted throughout parking, lots so that no portion of the lot is more than 64 feet away from the trunk of a tree unless othti ise approved bythe. Director. I. Buffer Yard Requirements The buffer yard shall consist of a ] 0 -foot wide. planting vJth an average of tw+o t,2 evergreen trees for each 60 Iinear feel of buffer vard. Street Tree Requirements The development of the maintenance facility will be built consistent with the existing streetscape look and feel of Sun City T exas. Therefore, per the desire to remain consistent with the look and feel of Sun City, and consistent with the goveming ordinances established in the Sun CiT Texas Development Agreement, street trees art not required along right -of way frontage adjoining the PUD. K. Primary Landscape Requirements The primary landscape shall be calculated by total site impervious cover times 16°io landscape required. The requirements may be satisfied by parking: lot Iandscaping, Tree Canopy, and Replacement Trees. Required planting shall consist of two (2) trees and four (4) shrubs per 600 square feet of primary landscape required. Landscape Credits for Primary Landscape: The following may count towards meeting the landscaping requirements: 19 Any area improved with Iandscaping by the Applicant. 11 Up to 26 percent of paved parking areas where constructed with brick pavers or pervious pavement systems as approved by the Director. Street trees planted within the propert,� line., and parking lot trees. 100'0 of the crown area of undisturbed existing trees shall be reduced from the landscape area requirements: provided that the area surrounding the tree is left undisturbed and that the area consists of at least one hundred (100) square feet_. not less than fifty percent (60%) of the crown area. L. Tree Canopy Tree Canopy Area shall be calculated as 16 percent of the entire lot square footage as defined in Exhibit B. The calculation for the mature crown area of all retained and planted trees from the Cit` approved tree. list (Table 8.04.020, Tree Canopy `List) shall be given a mature canopy square footage credit of 1.266 square feet. All trees not on the tree list will be given a mature canopy square footage credit of ?9 square feet. Tree Canopy Credits may be met by all existing trees that are retained and all planted trees. as well as any trees planted «within the adjacent right of way. M. Replacement Trees It is the design intent of the PUD to create a setting that enhances and showcases the natural setting of the site. A tree surveN! has identified all ten (10) inch caliper or greater trees within the PUD. Through the design process, the design may result in the loss of some ten (10) inch caliper or greater trees. Replacement trees must be a minimum of 4 inches in caliper. All replacement trees must be of the same species or comparable alternative and the same size at maturity as the trees removed. All replacement trees must be located within the lot, as defined in Exhibit B. Replacement Tree Calculation shah be calculated as 20 percent of the total caliper inches of trees removed equaling the total inches to be. replaced. N. Fuel Tank Reauirements A. Access Fuel Storage is critical to the operation of a golf maintenance facility. Fuel storage will be allowed. within the PUD. Paragraph 3 of Exhibit G (Revised by City Council March 28. 2006) of the Sun Citye Texas Development ,Agreement states All streets within the Project are classified as minor." Based on Paragraph 3. there are no major arterials within the Sun City Texas community. The PUD will not be required to comply with UDC Section 8.04.05- . which states. "All aboveground tanks located inside the city limits of Georgetown, Texas shall be directly accessible from a major arterial roadway.. as defined by Section 10.04.030 of this Code "Flammable Liquid Transport and Parking Restrictions," or by a street within the confines of an area designated as a Business Park or Industrial District (as defined in Section 4.04.020 of the City's unified Development Code).' Consistent with the two (21 existing golf maintenance facilities within Sun City Texas, the. Cowan Creek Golf Maintenance Facility vrill receive access from a non -loaded residential collector. B. Emergency Vehicle Access All aboveground tanks shall have emeraerncv vehicle access from the front side of the tank via an all-weather driving surface of not less than 30 feet in width. All remaining sides of aboveground storage tanks will be accessible by a ten (10) foot wide access area unobstructed by landsca)ing, walls. or any other materials. Q. Impervious Cover The Cowan Creek Golf Maintenance Facilitrl is located over the Edwards Aquifer. Per the Georgetown UDC. Section 11.02. the impervious cover limit for land over the Aquifer is 50% with the potential for increases up to 65% with waiver criteria. Sun Cite Texas, Cowan Creek Golf N/Iaintenace Faeilin, . The calculation of the impervious cover shall be measured based on the land area defined by the legal description, Exhibit B. Additionally, the development pian will be designed within compliance of the impervious cover limitations outlined within the Eicrhih Amendment of the Sun City Texas Development Agreement. Exhibit G of the. Development Agreement (Revised by Cit -v Council March 28, 20061 establishes a 40 percent maximum impervious cover in overall development. P. Building Coverage The building coverage maximum within the 2.41 D- acre Cowan Creek Golf Maintenance Facility shall be. 30%. The calculation of the building coverage shall be measured based on the land area defined by the legal description., Exhlbit B. Additionally, the development plan will be designed within compliance of the building coverage limitations outlined within the Eighth Amendment of the Sun City Texas Development Agreement. 1✓xhibit G of the Development Agreement {Revised by Cite Council March 28, 2006' establishes a 30 percent maximum building coverage in overall development Q. Buildin6 Height The maximum height Limit within the tract will be thirty-five (3 5) feet. R. Architectural Criteria As described within the Concept Plan narrative. the design intent is to screen the building from surrounding uses. Based on this design goal, the design of the building's architectural form will focus on the facade directly facing the public roadway. Once the design of the development is refined and finalized, an architectural theme will be developed for the front facade which will specify the architectural style, materials and colors. The theme will be consistent with and compliment the established theme within. the Sun City Texas Master Planned Community. In order to convey the architectural theme. items such as architectural elevations, material sample boards and color samples may be submitted to the City for review at the time of site planning, reviex.V. Sianaoe The control and placement of signs is especially important to the aesthetic harmony of Sun Cln. Texas. A critical component of a cohesive community, is the sense of place and identity. All signage associated with the maintenance facility will be consistent with the Sun City Texas Master Sion Plan and existing signs within the community .
