HomeMy WebLinkAboutORD 2008-19 - UDC for Mixed Use DistrictOrdinanceNo. 00300 An Ordinance of the City Council of the City of Georgetown, Texas, amending the Unified Development Code, Passed and Adopted on the 11th Day of March 2003, as follows: Section 4.04.020.H "Mixed Use District (MU)"; Section 4.04.020.1 "Transit Oriented Development District (TORY` and adding Section 4.11 "Mixed Use Development District"; Repealing Conflicting Ordinances and Resolutions; Including a Severability Clause; and Establishing an Effective Date. WHEREAS, the City Council adopted the Unified Development Code (UDC) on March 11, 2003; and WHEREAS, in May 2005, the City's Unified Development Code established the Mixed Use (MU) and Transit Oriented Development (TOD) zoning districts; and WHEREAS, in 2006 the City Council adopted a redevelopment plan for the "Williams Drive Gateway", a 70 -acre area along the west side of Interstate Highway 35 centered approximately by Williams Drive; and WHEREAS, in May, 2006, the City Council amended the Future Land Use Plan to designate the 440 acres around the proposed location of the Georgetown Rail Station, at the northern terminus of the Austin - San Antonio Intermunicipal Commuter Rail District line, as TOD-Mixed Use; and WHEREAS, in August, 2007, the Citv Council contracted with Civic Design Associates (CDA) for two ordinances (1) Transit Oriented Development District; and (2) Mixed Use District to serve as the implementation of the Williams Drive Gateway Redevelopment Plan; and WHEREAS, CDA conducted two workshops on September 12 and 14, 2007, to receive public input into the development of the ordinances; and WHEREAS, on December 10, 2007, the City Council held a work shop where CDA presented the draft ordinances pertaining to Transit Oriented Development and implementation of the Williams Drive Gateway Plan; and WHEREAS, during the preparation and review of the proposed ordinances it become apparent to CDA and City staff that both mixed use areas could be addressed through one combined ordinance; and 0 mj Mixed Use Ordinance April 8, 2008 Page I of 5 WHEREAS, the Planning and Zoning Commission conducted a Public Hearing on the draft ordinance for the TOD and Williams Drive Gateway Plan at their regular meeting of January 3, 2008 and recommended approval of the ordinance to the City Council and asked staff to consider using the ordinance for other mixed use areas contemplated with the soon to be adopted 2030 Comprehensive Plan; and WHEREAS, on February 26, 2008, the City Council adopted the 2030 Comprehensive Plan that includes a variety of mixed use land use areas and specialty mixed use areas including the TOD and Williams Drive Gateway; and WHEREAS, on February 26, 2008, the City Council adopted the Land Use Element, which includes as Action 1A.1 that within one (1) year of the Element adoption the City is to adjust zoning provisions to provide greater flexibility for mixed use, multiple housing types, and compact suburban development, and WHEREAS, CDA has refined the draft language for Section 4.11 to be used as the zoning district for the mixed use land use areas as identified on the Land Use Plan of the 2030 Comprehensive Pian; and IN40W THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the 2030 Comprehensive Plan, Thoroughfare Plan, and Land Use Element as follows: Vision Statement 2: Quality Growth/Sustainable Development 2.1.C: Encouraged sound, compact, quality growth, including pedestrian - friendly development patterns that incorporate mixed uses and densities, conserve resources, and accommodate public transportation, alternative fuel vehicles, biking, and walking as convenient substitutes for automobile use. Vision Statement 3: Balanced Transportation/Efficient Mobility 3.2.8: Transportation Choices. Georgetown is progressing towards a functional, well integrated, multi -modal transportation system, which provides convenient public transportation choices within underserved areas to enhance bicycle and pedestrian mobility; by incorporating these facilities in new developments; and by encouraging compact mixed-use and other "walkable" development types. Mixed 9 se r•inaril April• Page of Vision Statement 4: Effective Governance 4_1: Efficient, Responsive Government 4.1.B: We have created and enforced innovative, effective, and fair regulatory codes and development standards to guide growth and 'improve development quality. We have streamlined the regulatory process, particularly for desired development types and locations. Land Use Goals Policies and Actions: Land Use Goal 1: Promote sound, sustainable, and compact development patterns with balanced land uses, a variety of housing choices and well -integrated transportation, public facilities, and open space amenities. Policies and Actions: 1A: Encourage a balanced mix of residential, commercial, and employment uses at varying densities and intensities, to reflect a gradual transition from urban to suburban to rural development. 1B: Promote more compact, higher density development (e.g., traditional neighborhoods, Transit -Oriented Development, mixed-use, and walkable neighborhoods) within appropriate infill locations. 1C: Establish standards appropriate for new residential development pertaining to lot sizes, open space, buffers, road connectivity, etc. 1D: Establish improved standards for commercial development. 1E: Expand regulatory provisions and incentives to encourage innovative forms of compact, pedestrian friendly development (mixed-use, traditional neighborhood design), and a wider array of affordable housing choices. and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other 2030 Comprehensive Plan Vision Statement or Goal, Policy, and Action. SECTION 2. The Unified Development Code is hereby amended to reflect the addition of new Section 4.11 "Mixed Use Development District", which sets forth zoning and development standards for Mixed Use zoning districts. Section 4.11, attached here as Exhibit A, may be incorporated by reference to the Code and used as a separate document. Mixed Use Ordinance April 8, 2008 of SECTION 3. The Unified Development Code is hereby amended further as follows: Section 4.04 Zoning District Purpose Statements 4.04.020 Non -Residential Districts H. Mixed Use District (MU) The Mixed Use District is intended to provide a location to promote a dense and active mixed-use urban environment that incorporates residential and non-residential uses on a district -wide basis. See Section 4.11 of this Code for district standards. Due to the length of Section 4.11, it may be incorporated into the Code by reference and used as a separate document. 1. Transit Oriented Development District (TOD) The Transit Oriented Development District is intended to provide a location to promote a dense and active mixed-use urban environment that incorporates a mass transit stop and residential and non-residential uses on a district -wide basis. See Section 4.11 of this Code for district standards. Due to the length of Section 4.11 it may be incorporated into dze Code by reference and used as a separate document. SECTION 4. All ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 5. If any provision of this Ordinance or the UDC, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION b. This Ordinance shall become effective in accordance with the provisions of the City Charter.
