Whereas, the City Charter of the City of Georgetown was amended by vote of the people in April 1986 such that comprehensive planning was established as a continuous and ongoing governmental function; and Whereas, the City Council did, on March 8, 1988, adopt by Ordinance Number 880097 the Georgetown Century Plan - Policy Plan as the Comprehensive Plan for the City pursuant to Section 1.08 of the City Charter; and Whereas, Ordinance Number 880097 did create Chapter 1.12 Georgetown Century Plan in the Code of Ordinances of the City of Georgetown defining the Comprehensive Plan and elements adopted thereof; and Whereas, the City Council did, on March 13, 1990, adopt by Ordinance Number 900149 the Georgetown Century Plan - Development Plan Land Intensity, Transportation, and Utilities Functional Plan Elements pursuant to Section 1.08 of the City Charter; and Whereas, the City Council did, on April 23, 2002, adopt by Ordinance Number 2002-22 the Centum Plan: Parks, Recreation and Open Space Master Plan Element pursuant to Section 1.08 of the City Charter; and Whereas, the City Council did, on May 28, 2002, adopt by Ordinance Number 2002-32 the Century Plan: 7, ie Future Land Use Plan pursuant to Section 1.08 of the City Charter; and Whereas, the City Council did, on June 22, 2004, adopt by Ordinance Number 2004-35 the Overall Transportation Plan, pursuant to Section 1.08 of the City Charter; and Whereas, the City Council did, on October 12, 2004, adopt by Ordinance Number 2004-63 the Downtown Master Plan, pursuant to Section 1.08 of the Citv Charter; and Whereas, the City Council did, on November 22, 2005, adopt by Ordinance Number 2005-76 the Georgetown. Municipal Airport Functional Plan. Element, pursuant to Section 1.08 of the City Charter; and Ordinance No. 4R - 07 Page i of 7 2030 Comprehensive Plan: Executive Summmy Introduction; Plan Framework; Plan Elements: Land, Use Element; Procedures for Plan Administration, Impleanentation, Monitoring and Updates; arid, Appendices Whereas, the §3.05 of the adopted Century Plan - Policy Plan does allow for revisions to the adopted elements of the comprehensive plan and requires City Council review of all adopted policies or elements following the fifth anniversary of the effective date of the adopted policies or elements of the Century Plan; and Whereas, the City Council did, on September 25, 2001, adopt by Ordinance Number 2001-55 the Annual Operating Plan Element of the Century Plan, creating Performance Measures in the Century Plan -Policy Plan in terms of Goals, Policy Objectives and Strategies, replacing a governance model of Policy Ends and Focus Ends in the Century Plan -Policy Plan; and Whereas, the Annual Operating Plan Element of the Century Plan adopted on September 251 2001, outlined a Strategy for Long Range Planning as: Initiate a Comprehensive Plan revision process that will result in a strategy to revise and/or replace the elements that have been impacted by the remarkable growth and change in land use since adoption; and. Whereas, the City Council did, on September 26, 2006, adopt by Ordinance Number 2006-84 the Annual Operating Plan Element of the Century Plan, initiating review of all adopted policies or elements following the fifth anniversary of the effective date of the adopted policies or elements of the Century Plan; specifically the revision of the Policy Plan and Development Plan in total; and Whereas, on November 2, 3 and 4, 2006 three community forums were held to measure consensus on community aspirations for the desired quality of life and community character of Georgetown; and Whereas, a Citizen Steering Committee utilized the outcomes of the community forums to create a Vision Statement for the creation of a new comprehensive plan, to revise and replace the Century Plan — Policia Plan; and Whereas, a Citizen Steering Committee met over six months to review existing conditions, development trends and growth scenarios for the City of Georgetown for use in creation of Preliminary Goals, Policies and Strategies, and a new Growth Management Framework; and Whereas, on August 13, 2007, the Preliminary Goals, Policies and Strategies, and a new Growth Management Framework were presented to City Council, which directed staff to present the Preliminary Goals, Policies and Strategies, and a new Growth Management Framework to the public to revise and replace the Century Plan — Development Plan; and. Whereas, on August 23 and 24, 2007 two community forums were held to present, receive pubic comment, and refine the Preliminary Goals, Policies and Strategies, and a new Growth Management Framework; and Whereas, on October 4 and 5, 2007 two community forums were held to present, receive pubic comment, and refine the Future Land Use Map created to implement the refined Preliminary Goals, Policies and Strategies, and a new Growth Management Framework; and Ordinance No. m D7 Page 2 of l 2030 Comprehensive Plan: Executive Summary; Introduction; Plan Framework, Pian Elements: Land Use Element, Procedures for Plan Adininistraiion, Implementation, Monitoring and Updates; and Appendices Whereas, on November 15, 2007, the Citizen Steering Committee met to review final text and maps, and recommended to the Planning and Zoning Commission and City Council approval of the draft 2030 Comprehensive Plan: Executive Summary, Introduction; Plan Framework, Plan Elements: Land Use Element, Procedures for Plan Administration, Implementation, Monitoring and Updates; and Appendices, to revise and replace the Century Plan: Policy Plan, Development Plan, and Future Land Use Plan; and Whereas, the Planning and Zoning Commission did hold a Public Hearing on the draft 2030 Comprehensive Plan: Executive Summary, Introduction; Plan Framework, Plan Elements: Land Use Element, Procedures for Plan Administration, Implementation, Monitoring and Updates; and Appendices, on December 4, 2007 and January 7, 2008; and Whereas, notice of such hearing was published in a newspaper of general circulation in the City, which stated the time and place of hearing which time was not earlier than fifteen (15) days for the first day of such publication; and Whereas, e-mail and website notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to over 150 citizens on the City of Georgetown e-mail listsery for the Comprehensive Plan Update; and Whereas, the Planning and Zoning Commission and City Council did hold a Joint Workshop concerning the draft 2030 Comprehensive Plan: Executive Summary; Introduction; Plan Framework; Plan Elements: Land Use Element; Procedures for Plan Administration, Implementation, Monitoring and Updates; and Appendices, on January 7, 2008. Whereas, the Planning and Zoning Commission did recommend to City Council approval of the draft 2030 Comprehensive Plan: Executive Summary, Introduction; Plan Framework; Plan Elements. Land Use Element, Procedures for Plan Administration, Implementation, Monitoring and Updates; and Appendices, on December 7, 2008; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: Section 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following procedures of the Century Plan - Policy Plan: §3.05 Periodic Revision: ...At the time that the next annual operation plan is approved following the fifth anniversary of the effective date, the (City) Council shall review and reconsider all Ends Statements in accordance with Article II of this Chapter. At this time all Ends Statements shall e reapproved either in their original form, or approved as revised. This action shall constitute the Periodic Revision of the Plan and shall require a simple majority vote of all Council members. further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Ordinance No. AOPage') of 7 2030 Comprehensive Plan: Executive Sunimanf; Introduction; Plan Framework; Plan Elemments: Land Use Element; Procedures for Plan Administration, Implementation, Monitoring and Updates; and Appendices Policy Plan, Section 2. The Document entitled Century/ Plan: Policy Plan, dated March 8, 1988, revised September 24, 1996, revised September 25, 2001, shall be replaced by the 2030 Comprehensive Plan: Introduction; Plan Framework, Procedures for Plan Administration, Implementation, Monitorina and Updates; and Appendices. Section 3. The Document entitled Century Plan: Development Plan, Land Intensity, Transportation, and Utilities Functional Plan Elements, dated March 13, 1990, revised May 28, 2002, shall be replaced by the 2030 Comprehensive PIan: Land Use Element. Section 4. Upon adoption by City Council of the 2030 Comprehensive Plan: Introduction; Plan Framework; Plan Elements: Land Use Element, Procedures for Plan Administration, Implementation, Monitoring and Updates; and Appendices, staff shall prepare a 2030 Comprehensive Plan: Executive Summary for inclusion in the 2030 Plan. Sec. 1.12.010. Century Comprehensive plan adopted. Copies of the " Qant In accordance with Chapter 1.08 of the Georgetown City Charter, the City Council has adopted that certain document entitled the " " (Policy PlaR) "2030 Comprehensive Plan" for the purposes of directing the City Council, staff and commissions in rendering actions and resolutions relating to the planning and development of the territorial limits of the City. This document is dated February 26, 2008, and may be amended from time to time.* (Ord. 2008-_) *Editor's note: Copies of the " Qant ,n, a'a^" "2030 Comprehensive Plan" are available in both the office of the City Secretary and the Planning and Development office, Sec. 1.12.020. Functional economic development plan adopted. In accordance with Chapter 1.08, subsection 2 of the Georgetown City Charter, the City Council has adopted that certain document entitled the "Georgetown Century Plan Functional Plan for Economic Development" for the purposes of directing the City Council, staff and commissions in rendering actions and resolutions relating to the utilization of all the available resources within the City and its planning area for the purpose of developing and maintaining a healthy economic growth. This document may be amended from time to time.* (Ord. 890276 § 2(6)) *Editor's note: The Strategic Plan for Economic Development, adopted in this section as the "Functional Plan," was amended 12/12/89 by Ord. 890479. Copies of the "Georgetown Century Plan Functional Plan for Economic Development" are available in both the office of the City Secretary and the Planning and Development office. In accordance with Chapter 1.08, Subsection 2 of the Georgetown City Charter, the City Council of the City of Georgetown has adopted that certain document entitled the "Overall Transportation Plan" for the purpose of directing the City Council, staff, and/or commissions in rendering actions and resolutions relating to the utilization of all of the available resources within the City and its Plannina Area for the purpose of developing a public transportation network of roads. This document is dated June 22 2004, and may be amended from time to time.* (Ord. 2004-35) *Editor's City Charter. note: Copies City Council of the City of Georgetown has adopted of the "Overall Transportation Plan" are available in both the office "Georgetown Municipal Airport Functional Plan Element" for the purpose of the City Secretary and the Planning and Development office. Functional downtown plan adopted, In accordance with Chapter 1.08, Subsection 2 of the Georgetown City Charter, the City Council of the City of Georgetown has adopted that certain document entitled the "Downtown Master Plan" for the purpose of directing the City Council, staff, and/or commissions in rendering actions and resolutions relating to the utilization of public and Private property within the City and its Planning Area for the purpose of developing an economically viable and historically rich downtown Georgetown. This document is dated October 12, 2004, and may be amended from time to time.* (Ord. 2004-63) *Editor's note: Copies of the "Downtown Master Plan" are available in both the office of the City Secretary and the Planninq and Development office. Sec. 1.12.050. pese eted. Functional airport plan adopted. In accordance with Chapter 1.08 Subsection 2 of the Georgetown City Charter. the City Council of the City of Georgetown has adopted that certain document entitled the "Georgetown Municipal Airport Functional Plan Element" for the purpose of directing the City Council, staff, and/or commissions in rendering actions and resolutions relating to the utilization of the Georgetown Municipal Airport and surrounding property for the purpose of development: safety; and noise control at the GMA. This document is dated November 22 2005, and may be amended from time to time.* (Ord. 2005-76) *Editor's note: Copies of the "Georgetown Municipal Airport Functional Plan Element " are available in both the office of the City Secretary and the Planning and Development office. Sec. 1.12.060. Functional development plan adopted. In accordance with Chapter 1.08, Subsection 2 of the Georgetown City Charter, the City Council of the City of Georgetown has adopted that certain document entitled the "Century Pl R Deve!GpMeRt Rlan.L °2030 Comprehensive Pian: Land Use Element" for the purpose of directing the City Council, staff, andior commissions in rendering actions and resolutions relating to the utilization of all of the available resources within the City and its Planning Area for the purpose of developing public and private land and serving that land with infrastructure systems. Adoption of the DeveiapmentlaR , "2030 Comprehensive Plan: Land Use Element" is inclusive of the Future Land Use and Growth Management Framework. . This document is dated February 26 2008 and may be amended from time to time. Ordinance No. ? No. 2008- , (repealed Ord. No. 2004-35, and § 3; Ord. Sec. 1,12,080. Functional Parks, Recreation and Open Space Master Plan adopted, In accordance with Chapter 1.08, Subsection 2 of the City Charter, the City Council of the City has adopted that certain document entitled the "Parks, Recreation and Open Space Master Plan element of the Century Plan" for the purpose of directing the City Council, staff, and/or commissions in rendering actions and resolutions relating to the utilization of all of the available resources within the City and its planning area for the purpose of developing and conducting the parks and recreation programs of the City. This document may be amended from time to time. (Ord. No. 2002-22, § 2) Section 6: The 2030 Comprehensive Plan: Introduction; Plan Framework; Procedures for Plan Administration, Implementation, Monitoring and Updates; and Appendices shall be implemented in accordance with the Administrative procedures of the 2030 Comprehensive Plan, consistent with state law and Unified Development Code notification and procedures. Section 7: All future ordinances of the City implementing elements of the 2030 Comprehensive Plan: Land Use Element, primarily the Unified Development Code and Growth Management Framework, shall be in conformity with the adopted 2030 Comprehensive Plan: Land Use Element. Section S. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 9. if any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions; or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable.
