Whereas, an application has been made to the City Council for the Purpose of changing the Zoning District Classification of the following described real property ("The Property"): 9.10 acre site as recorded in the Nicholas Porter Survey, Abstract No. 497 as recorded in the following documents: Volume 513, Page 227; Volume 446, Page 118; Volume 777, Page 825; Document Nos. 9640396, 2000016885, and 200618818 located within the Official Records of Williamson County, Texas, hereinafter referred to as "The Property"; Whereas, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and Whereas, notice of such hearing was published in a newspaper of general circulation in the City; which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and Whereas, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by law; and Whereas, the applicant for such zoning change placed on the property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and Whereas, the City Planning and Zoning Commission in a meeting held on December 5, 2006 recommended Approval of the requested zoning change for the above described property from RS, Residential Single -Family District to Planned Unit Development (PUD) with a base district of C-3, General Commercial, Crestview Baptist Church RS to PUD Page 1 of 3 Now, therefore, be it ordained by the City Council of the City of Georgetown, 'Texas, that:: Section 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following objective of the Georgetown Century Plan, Future Land Use and Thoroughfare Plan: Goal 1: Encourage the most desirable and efficient use of land while enhancing the physical environment through functional and compatible land use configurations. ® Objective 1.5: Require zoning change requests to be consistent with the Future Land Use Plan. The proposed PUD zoning, as well as the future use of the property, is consistent with the "Public / Semi -Public", "Residential" and "Office / Service" land use designations. and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. Section 2. The Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from RS, Residential Single -Family District to Planned Unit Development (PUD) with a base zoning district of C-3, General Commercial, in accordance with the Development Plan which is attached hereto as Attachment A and incorporated by reference herein, is hereby adopted by the City Council of the City of Georgetown, Texas, Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this Ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect on the date of final adoption by City Council. This Development Plan covers approximately 9.10 acres located at Williams Drive bounded (approximately) by Cottonwood Drive to the south, Power Road to the northeast and Ranch Road to the southeast. A location map is provided in Exhibit A. FflIOOOft"JFt4 In accordance with Unified Development Code Section 4.04.030 (5) "Development Plan", the following is a summary of the design standards for the development of Crestview Baptist Church. The membership of Crestview Baptist Church has grown over the years and once more, the size of the congregation has outgrown its existing facilities. Crestview is looking to complete the most extensive addition of worship, education and parking areas to date. It will be the last major addition to their current building on the currently owned property. The Church has determined that they do not want to relocate, therefore they will complete this one last major expansion with the realization that they will no longer be able to add facilities to the land they currently occupy. The goal is to provide seating for up to 1,200 people. L Miscellaneous a. A Preliminary Plat for the 9.10 acre site has been submitted to the City of Georgetown on behalf of Crestview Baptist Church. A copy of this plat is attached hereto as Exhibit B and incorporated herein. b. The platted area is intended to be developed for a `Place of Worship". Allowed Uses Use of the site is limited exclusively to a "Place of Worship" as defined in Section 16.03.040 of the Unified Development Code. Such use shall include all reasonable accessory uses identified in the above -referenced UDC section. Except for those areas specifically covered by this Development Plan the underlying standards for the development of this project shall be all applicable standards located within the Unified Development Code. The underlying zoning district for the development of this project shall be the C-3, General Commercial zoning district. The development and use standards of the Special Area Plan Overlay District for Williams Drive, of which a portion of this site is located, shall not be applicable to the development of this project. 1. Building Height Maximum building height shall be 45 feet as established by the C-3 zoning district. Those areas identified on the attached Exhibit C shall be allowed a maximum height of 50 feet. Height shall be determined in compliance with UDC Section 6.02.040 (C) subject to the "Exceptions" of Section 6.02.040 (C)(2). I The expansions have not been designed yet so the chart below only contains estimates of the future square footages as proposed by Crestview at this time: Page 2 of 4 Crestview Baptist Church PUD Development Plan 2. Building Setbacks Setbacks shall be consistent with the distances depicted on Exhibit D. a. Front (Williams Drive) 25 Feet b. Side 25 Feet along Ranch Road 10 Feet (Subject to a "Type B" bufferyard pursuant to UDC Section 8.08.030.F, for any portion abutting a residentially zoned parcel). c. Rear (Mesquite Lane) 5 Feet 3, Parking Parking for "Places of Worship" is determined by the number of seats within the sanctuary, or place of worship. The goal of the Crestview Church is to provide seating space for up to 1,200 people. The UDC requirement is 1 space per 3 seats, which totals 400 on-site parking spaces to accommodate the proposed 1,200 seating capacity. The proposed number of spaces total 454 which provides 54 additional spaces for accessory functions. Existing Spaces 274 Proposed Additional Spaces 180 Total. Cn-Site Spaces 454 The proposed landscaping is depicted on the attached Exhibit E. 5. Phasing The project shall be phased in accordance with the following general sequence (See Depiction on Exhibit F): Phase I - The Church owned lot just South of Mesquite Lane will be used as the new Water Quality and Detention Pond for the entire project. Page') o1^4 Crestview Baptist Church PUD Development Plan Phase II - The existing Water Quality and Detention Pond will be replaced with new parking and one of the current gravel areas will be replaced by additional parking. Phase III — The current parking lot will be renovated to improve drainage and improve the layout. New curb cuts on Mesquite lane will improve traffic flow into and out of the new parking lot. Phase IV — Building expansion. The final layout of the Master Plan is for the expansion to be directly adjacent to the current building in the general area of the current Sanctuary. In essence, the final build out will be a single building on the lot, not multiple facilities. Phase V — The last phase will add additional parking in the area closest to Williams Drive where 2 Church owned houses currently= used as classrooms sit. 75% 7, Site Plan Required Implementation of this PUD development plan will be reviewed pursuant to a site plan as required by UDC Section 3.09. Said site plan will graphically depict compliance with all development standards of this PUD, as well as the underlying C-3 zoning district. A landscaping plan, demonstrating compliance with the details outlined in Exhibit F, will be required as part of the site plan process.
