HomeMy WebLinkAboutORD 2007-60 - Strength of ForceI go al 91 X14" 1 WHEREAS, the citizens of the City of Georgetown, Texas have adopted the civil service system for its fire and police departments; and WHEREAS, civil service is governed under Chapter 143 of the Texas Local Government Code; and WHEREAS, Local Government Code, Section 143.021, requires that the governing body of a municipality shall establish classifications and numbers of positions by ordinance. WHEREAS, the caption of this ordinance was printed in the Williamson County Sun in compliance with the City Charter of the City of Georgetown. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The classification plans for classified positions in the Fire and Police Departments shall be as follows: PANT ONE — FIRE DEPARTMENT The following classifications of firefighters in the Fire Department shall exist effective on and after the dates set forth herein under the provisions of Chapter 143 of the Texas Local Government Code. These classifications and no others shall exist effective on and after the dates set forth herein with the number shown indicating the number of positions in each classification. Classification Assistant Chief — Fire Operations Fire Battalion Chief Fire Captain (New Rank) Fire Lieutenant Apparatus Operator Firefighter Total Number in Classification 1 4 3 12 15 33 68 The one (1) Assistant Fire Chief is appointed by the head of the department, and serves at the pleasure of the Department Head, in accordance with Local Government Code, Section 143.014. Ordinance No. Strength of Force Ordinance Page 1 of 2 The following classifications of officers in the Police Department shall exist effective on and after the dates set forth herein under the provisions of Chapter 143 of the Texas Local Government Code. These classifications and no others shall exist effective on and after the dates set forth herein with the number shown indicating the number of positions in each classification. Number in Classification Classification Assistant Chief of Police I Police Captain 2 Police Lieutenant 6 Police Sergeant (Formerly Detective/Sergeant) 16 Police Officer 52 Total 77 The one (1) Assistant Police Chief is appointed by the head of the department, and serves at the pleasure of the Department Head, in accordance with Local Government Code, Section 143.014. SECTION 2. All positions, other than the position immediately below the Department Head, shall be filled pursuant to the provisions of Local Government Code, Chapter 143, and eligibility lists applicable to the position. SECTION 3. That it is hereby found and determined that the meetings at which this ordinance was passed were open to the public, as required by Section 551, Texas Government Code, and that advance public notice of the time, place and purpose of said meetings was given. SECTION 4. Should any section, paragraph, sentence, clause, phrase or word of this ordinance be declared unconstitutional or invalid for any purpose by a court of competent jurisdiction, the remainder of this ordinance shall not be affected thereby and to this end the provisions of this Ordinance are declared to be severable. SECTION 5. This Ordinance shall become effective on October 1,21I007. M N 00, KA 1 1 ! i WHEREAS, Article 102.0172 of the Texas Code of Criminal Procedure authorized cities to create a municipality court technology fund and to collect court costs from persons convicted of misdemeanor offenses in municipal court for such purposes, and the City of Georgetown adopted provisions implementing this program in Section 4.40.0 10 of the City Code of Ordinances; and WHEREAS, as originally adopted, Article .102.0172 contained a sunset provision of September 1, 2005; and WHEREAS, into 2003, the sunset provision was repealed from Article 102.0172, but Section City Code still references this repealed sunset provision; and WHEREAS, the City Council has determined that the reference to the expired sunset provision in Section 4.40.010(D) of the City Code of Ordinances should be repealed inasmuch as it has been repealed by the Texas Legislature. • THEREFORE, ORDAINED OF OF GEORGETOWN, TEXAS: SECTION 1: That Section 4.40.010(D) of the City of Georgetown Code of Ordinances be amended to provide as follows: A. (no change) Ordinance No. aM-7 Technology Fee Fund for Municipal Court Page 1 of 2 technology fee fund expires by operation of law or otherwise, any funds remaining in the fund shall continue to be used and administered as required by the ordinance codified in this chapter. SECTION 2: If any provision, section, subsection, sentence, clause or phrase of this ordinance, or the application of same to any person or set of circumstances for any reason is held to be unconstitutional, void or invalid or for any reason unenforceable, the validity of the remaining portions of this ordinance or the application thereby shall remain in effect, it being the intent of the City Council of the City of Georgetown, Texas in adopting this ordinance, that no portion thereof or provision contained herein shall become inoperative or fail by any reason of unconstitutionality or invalidity of any portion or provision. SECTION 4: The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. The caption of this ordinance shall be published in accordance with the provisions of the City Charter. This ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown.
