Council Present, Council Absent: Mayor Gary Nelon, Doug Smith, Sam Pfiester, Ken Evans Farley Snell, Llorente Navarette, Jack Noble, Gabe Sansing Staff Presents_ Paul Brandenburg, City Manager, Trish Carls, City Attorney, Tom Yantis, Assistant City Manager of Operations, Jim Briggs, Assistant City Manager for Utility Operations, Amelia Sondgeroth, Director of Planning and Development, Shirley Rinn, Deputy City Secretary 's 1- - •s' '- s • Called to Order at 4:00 p.m. A PC Leasing -- Dennis Schoenborn, Director of Information Resources This item was deferred until Tuesday, September 24, 2002 B Review and discussion of proposed UDC Ch. 1 - 3: General Provisions, Review Authority, Applications and Permits - Amelia Sondgeroth, Director of Planning and Development Services Amelia Sondgeroth addressed the council and told them she felt that is was extremely important that the council have a full understanding of the sequence of events in the Unified Development Code. She said that the current draft does a good job in cleaning up 1st three chapters of the UDC, but that she wanted to clarify and highlight a few issues in each of these the chapters. The Council discussed issues regarding the appeals process under the new code, land uses, applicability and phasing requirements, "service" businesses and the impact of the new code, the impact on Williams Drive, non -conforming uses and the means by which to handle those situations. There was also discussion regarding the historic district and the downtown overlay district boundaries, as well as discussion regarding the quasi-judicial authority of the Historic and Architectural Review Commission. There was further discussion regarding the HARC's authority in relation to design guidelines and the impact of the HARC's design guidelines on properties that need to be redeveloped. It was clarified that the properties that have historic designations are in the town square and that most of the buildings in the overlay district could be torn down. However, any new designs would have to go through HARC. They went on to discuss whether or not the council was comfortable with the possibility that it could take a long time to redevelop the downtown overlay district. The council went on to discuss its concerns regarding the subjectivity of the decision-making process of HARC, as well as its concern that the HARC has the final authority on decisions and not the Council. There was also discussion regarding the need for timelines for approving design guidelines, as well as the need to have concurrent timelines for the HARC and Planning & Zoning Commission. There was concern that the HARC process could hinder the ability of an owner to redevelop a property that desperately needed to redeveloped. There was also concern that the HARC membership may City Council Meeting Minutes/September 23, 2002 Page 1 of 2 Pages not be compiled of members who have the "expertise" that was intended, which makes the decisions being made more subjective. There was also additional discussion regarding the review/appeal process of the HARC and possibly amending the same. The council went on to discuss whether or not there was a need to have a concept plan in the development process. Trish told the council that the current concept plan tells the staff nothing.Trish went on to inform the council that during the UDC discussions regarding this issue the staff had indicated that items they wanted to see at this stage were items that are now included in the preliminary plat. There was further discussion regarding "Future Land Use and Thoroughfare Plan", zoning issues and long range planning. Amelia clarified that staff will normally approve items unless there is a variance, which case the item would go to the Planning & Zoning Commision and then to Council. There was also a discussion regarding the importance of training for the Board of Adjustment as well as for the Planning & Zoning Commission. It was mentioned that the training should be a requirement for membership. There was additional discussion regarding the expiration of approvals and the impact of expirations on phasing developments. Council clarified that there is no extension for preliminary plats and Trish discussed the reasons for not having the extensions.
