Discussion regarding Del Webb Development
Agreement
and Amendments — Jim Briggs
Briggs gave a history of the City water capacities at the time of the signing of the Del
Webb Agreement. There was discussion regarding the additional capacity being
requested by Sun City for irrigation of four golf courses and the common area.
Pfiester said the agreement should specify the amount of water requested and whether it
is to be potable or non -potable. Pfiester confirmed with Todd Janssen of Del Webb that
Del Webb is requesting an additional 1.89 million gallons. Pfiester suggested specifying
in the agreement that the requested water could come from the Airport wells and the
Pecan Branch or from the Stillhouse line.
Briggs assured Council that the City
could guarantee the potable
water
demand. He said
the current average daily amount of
potable water needed by the
City is
4.5 million.
Janssen suggested some revisions to the text of the 7th Amendment.
There was discussion regarding the fees to be charged. Janssen asked that Del Webb
be charged no more than what is charged to Southwestern University and Georgetown
Country Club because those entities have not built infrastructure.

a summary of what she understood about
the agreement. Council

input as to the
provisions of the agreement.

B Consideration and possible action to approve the Seventh Amendment to the Development
Agreement with Del Webb Texas Limited Partnership, concerning additional non -potable
water capacity for Sun City Georgetown — Jim Briggs and George Russell
Based upon discussion, it was determined that this item would be brought back to Council
on the October 9 Agenda,
C Consideration and possible action to authorize the Mayor to execute a contract for legal
services with the firm of Brown and Carls, L.L.P. — George Russell

Russell reviewed the contract and the fee schedule. He noted that the primary legal
response to the City will be provided by Patricia Carls. He recommended approval of the
contract. There was discussion regarding retaining Interim City Attorney Cathy Riedel for
a transition period. Motion by Evans, second by Pfiester to adopt the contract effective
September 7, 2001, at 5:00 p.m. Approved 4-1. (Noble opposed)
