HomeMy WebLinkAboutMIN 10.22.2001 CC-SMINUTES OF MEETING OF •. - -!D OF OF •' • TEXAS The City Council Personnel Hearing was called to order at 2:32 p.m. in the City Council Chambers to consider the following item: - -ammol- Consideration and possible action on appeal of termination of employment of Terry Osborne, pursuant to Sec. 2.16 of the City Charter of the City of Georgetown and the City of Georgetown and the City's Personnel Rules and Procedures Policy No, 451. The employee, Terry Osborne, was sworn in by the Mayor. Osborne explained his actions. Attorney for the City, Chris Bacon, cross examined. Council asked questions of Osborne. Bacon redirected questions to Osborne. Mayor asked Osborne if he wished to call witnesses. Osborne called John Lawton. Lawton was sworn in by Kersch. Lawton spoke on behalf of Osborne. Osborne called Terri Hahn. Hahn was sworn in by Kersch. Hahn spoke on behalf of Osborne. Osborne called Janet Loper. Loper was sworn in by Kersch. Loper spoke on behalf of Osborne. Council asked questions of Osborne. Bacon called Osborn's supervisor, Traci Stengle. Stengle was sworn in by Kersch. Bacon questioned Stengle. Mayor and Council asked questions of Stengle. Osborne had no further questions. Minutes of Osborne Personnel Hearing October 22, 2001 Page 1 of 2 Bacon had no further witnesses. Council asked questions of City staff. Osborne made a closing statement in which he thanked the Council and the witnesses for their time and asked that the results be fair. Bacon stated that the City does not prevent employees from taking a second job, but the Personnel Policy asks that the supervisor be notified. He said Osborne was aware of the policy but did not make his second job known to his supervisor. Bacon said Osborne's abilities were not in dispute, that he was fired because of an issue of lack of trust. He told Council there is evidence that Osborne was warned and still chose to violate the policy. Kersch stated that the question is: "was there good cause for the termination of the employee." She read the policy. There were comments from Council. Kersch asked for those in favor of the employee's termination. Navarrette and Pfiester voted in favor. Opposed by Lyda, Evans, Noble, Burson and Smith. Kersch stated that the termination was not witheld. upheld. * as corrected by Mayor Kersch at the Council Meeting of November 13, 2001. Kersch asked for a motion to support the order. Motion by Smith, second by Evans that good cause does not exist supporting the termination of Terry Osborne as the Tennis Pro for the City of Georgetown. Approved 5-2.
