HomeMy WebLinkAboutMinutes P&Z 05.02.2023Minutes of the Planning and Zoning Commission City of Georgetown, Texas Tuesday, May 2, 2023 The Georgetown Planning and Zoning Commission met on Tuesday, May 2, 2023 at 6:00 PM at Council and Court Building, 510 W. 9th Street. The City of Georgetown is committed to compliance with the Americans with Disabilities Act (ADA). The following Members were in attendance: Present were: Doug Noble, Christopher B Stanley, Chere Heintzmann, Scott A Allen, Mike Tiland, Stephen F Dickey, Colin McGahey Agenda Notice Public Wishing to Address an Advisory Board On a subject that is posted on this agenda: Please fill out a speaker registra on form which can be found on the table at the entrance to the mee ng room. Clearly print your name and the le er of the item on which you wish to speak and present it to the Board Liaison prior to the start of the mee ng. You will be called forward to speak when the Board considers that item. Only persons who have delivered the speaker form prior to the mee ng being called to order may speak. Speakers will be allowed up to three minutes to speak. If you wish to speak for six minutes, it is permissible to use another requestor's granted me to speak. No more than six minutes for a speaker may be granted. The requestor gran ng me to another speaker must also submit a form and be present at the meeting. On a subject not posted on the agenda: A request must be received by the Advisory Board or Commission Liaison prior to the day the agenda for this mee ng is posted. Motion Approved: 7 - 0 Voting For: Doug Noble, Christopher B Stanley, Chere Heintzmann, Scott A Allen, Mike Tiland, Stephen F Dickey, Colin McGahey Voting Against: None 1.A Meeting Minutes Consideration and possible action to approve the minutes from the April 18th, 2023 regular meeting of the Planning & Zoning Commission. -- Jessica Lemanski, Planning Specialist 1.13 2022-2-TIA - Rivery Boulevard Mixed Use TIA Consideration and possible action to disapprove for the reasons set forth in the item application for a Traffic Impact Analysis, consisting of approximately 12.667 acres in the McCoy School Sub, Lot 1, generally located at 1313 Williams Dr. to be known as Rivery Boulevard Mixed Use (2022-2-TIA) — David Munk, PE, and Lua Saluone, Utility Engineering Travis Baird approached the podium to address the Commission and explained that at the time of posting, there was a fee due to the City of Georgetown on this project. All fees have now been paid, and staff is requesting approval of this project. Moved by Stephen F Dickey; seconded by Doug Noble to Approve Item 1.B. Regular Session 2.A 2023-6-WAV Dollar General Store #24318 Public Hearing and possible action on a Subdivision Variance from Right -of -Way requirements pursuant to Section 12.02.030 of the Unified Development Code, for the property located on 2800 E University Ave, bearing the legal description of 1.7335-acre tract situated in the William Addison Survey, Abstract No. 21, in Williamson County, said land being Lot 1 B, Block "A" Final Plat of a Planned Unit Development Of Churchill Farms, Section Six, Phase One recorded in Cab. N Sld. 216, of the Plat Records Of Williamson County, Texas (2023-6-WAV) - Mayra Cantu, Strategic Support Manager Mayra Cantu presented the staff report. Commissioner Dickey asked if the letters in opposition on the agenda were more in relation to the development and use of the site. Mayra confirmed, yes. Most comments were not in reference to the waiver request. Vice -Chair Heintzmann opened and closed the public hearing with no speakers coming forth. Moved by Doug Noble; seconded by Christopher B Stanley to Deny the waiver request. Motion Approved: 7- 0 Voting For: Doug Noble, Christopher B Stanley, Chere Heintzmann, Scott A Allen, Mike Tiland, Stephen F Dickey, Colin McGahey Voting Against: None 2.B 2022-16-SUP - 231 Village Park Drive ADU Public Hearing and possible action on a request for a Special Use Permit (SUP) for an Accessory Dwelling Unit in the Residential Single -Family (RS) zoning district on the property located at 231 Village Park Drive, bearing the legal description of 0.132 acres, Lot 31, Block A, Section 4B of the Georgetown Village Planned Unit Development (2022- 16-SUP). Grant White, Planner Grant White presented the staff report. Commissioner Stanley asked for clarification on the health, welfare, and safety approval criteria and what goes into that analysis. Travis Baird explained that that particular criteria is vague, and staff generally refers to Chapter 1 of the Unified Development Code for guidance on what elements to examine. Staff looks at the criteria as objectively as possible. Baird elaborated staffs suggested condition on the item, clarifying that there are no restrictions on whether or not a property can be leased out in our UDC. Discussion on short-term rentals at this property. Vice -Chair Heintzmann commented that SUPs are intended for extraordinary conditions, and this neighborhood is established as single family. She is concerned this would affect the character of the neighborhood. Commissioner Stanley commented that it would not be illegal for the owners to rent the property, and the suggested conditions on the SUP would not allow a multi -family configuration on this property. Discussion on the use of Accessory Dwelling Units. Vice -Chair Heintzmann opened the public hearing. Jill Fussell, 402 Village Commons Blvd., approached the podium to address the Commission and voiced concerns regarding the limited parking on and around the subject property, as well as the impervious cover and potential encroachment of the driveway into the Critical Root Zone of a large oak tree. Melora Jacober, 1109 Clove Hitch Dr., approached the podium to address the Commission and explained that there are 4-5 people living and/or renting rooms at this property in violation of the neighborhood CCRs. Jacober said that renters are not subject to screening and check in online without ever meeting the owners of the property. The alley where tenants get access to the property butts up to an elementary school. Jacober voiced concern that the burden is placed on the community to hire an attorney to enforce their CCRs. Brian Ortega, 125 Cedar Elm Ln., approached the podium to address the Commission and established that he has lived in Georgetown for 25 years and has served on several Boards within the city. Ortega voiced concern over the intended use of the property, as well as the alleyway parking configuration. Ortega asks the Commission to deny this SUP request. Jessica Consen, 1082 Bowline Dr., approached the podium to address the Commission. Jennifer Knight, 1105 Clove Hitch Dr., ceded one minute of her time to Consen. Consen established that she has seen over 80 tenants filter through this property over the years, and voiced concerns over tenant behavior and unsafe activity. Consen explained that she is not against Airbnbs, but is instead opposed to the lack of safety this property and its management brings to the neighborhood due to the lack of owner investment in the community. She is concerned with the safety of her children and elderly neighbors, and has called the police several times due to unsafe tenant activity around this property. Consen urges the Commission to deny this request. John Nelson, 233 Village Park Dr., approached the podium to address the Commission. Jennifer Knight, 1105 Clove Hitch Dr., ceded one minutes of her time to Nelson. Nelson explained that this property is owned by an LLC consisting of friends living in California who do not live on the property. An old jeep from previous tenants is still parked in the driveway and occupying one of their parking spots. Vice -Chair Heintzmann closed the public hearing. Moved by Stephen F Dickey; seconded by Doug Noble to Deny Item 2.13. Commissioner Dickey commented that this does not work in this neighborhood, and the property is listed on both Airbnb and Vrbo. He is also unclear about what is planned for the oak tree near the driveway. Motion Approved: 7- 0 Voting For: Doug Noble, Christopher B Stanley, Chere Heintzmann, Scott A Allen, Mike Tiland, Stephen F Dickey, Colin McGahey Voting Against: None 2.0 P&Z Meeting Supporting Documents Presentation and discussion regarding potential changes to supporting documentation for Consent Agenda items on the Planning and Zoning Commission Meeting. Travis Baird - Assistant Planning Director, Current Planning Travis Baird approached the podium to address the Commission and explained that staff is proposing posting comments on projects as a composite document on the Commission's agenda as opposed to the full plans set to allow for a smoother process when posting agendas. Baird asked the Commission if the comment sheet and maps for application would provide Commissioners with enough information to review the requests on teh agenda. Commissioners Stanley and Dickey commented that this sounds okay to them. The Commission generally agreed. No action was taken by the Commission on this item. 3. Executive Session In compliance with the Open Meetings Act, Chapter 551, Texas Government Code, Vernon's Codes, Annotated, the items listed below will be discussed in closed session and are subject to action in the regular session.
