Legislative Regular Agenda AS Public Hearing and possible action on a Comprehensive Plan Amendment to amend Sections 1.12.010 and 1.12.080 of the Code of Ordinances relating to the adoption of the 2030 Comprehensive Plan Update, including an updated Parks, Recreation, and Open Space Master Plan, in accordance with Chapter 1.08 of the Georgetown City Charter and Functional Elements Thereof (2021-2-CPA). Planning & Zoning Commission Minutes Page 6 of 9 January 18, 2022 AT Public Hearing and possible action on a request for a Zoning Map Amendment to rezone 12.785 acres in the Isaac Donagan Survey, Abstract No. 178, from the Agriculture (AG) zoning district to the Planned Unit Development (PUD) zoning district with a base zoning of Low Density Multi -Family (MF-1), for the property generally located at 3301 W SH 29 (2021-23-PUD). Subdivision Variance from the minimum driveway spacing requirement for nonresidential driveways pursuant to Section 12.08.020. of the Unified Development Code. According to UDC 12.08.020. the driveway separation for a full access commercial driveway is 425 feet for a roadway with a signed speed of 50 mph as measured from the center of the driveway to the right of way line of the intersecting street. The Shell Roadway is signed at 50 mph at the proposed driveway and driveway separation as scaled from the Quik Trip site plan is 265 feet from the center of the driveway to the SH 195 right of way. A right in right out driveway would be allowed at this location but the applicant is requesting a full access driveway. Consequently, the Applicant seeks this Subdivision Variance to allow a full access driveway. The subject Quik Trip Property is bounded to the north by SH195 a freeway and to the west by Shell Road, a major arterial. The subject property has few trees within the site but it is not encumbered by natural features. The subject Quik Trip Property is adjacent to SH195 to the north (a freeway) and Shell Road to the west (a major arterial). The Quik Trip will use these two major roads for access. Motion to approve item AT (2021-23-PUD) by Commissioner Noble. Second by Commissioner Stanley. Approved 5-0. AUPublic Hearing and possible action on a Subdivision Variance from the minimum driveway spacing requirement for non-residential driveways pursuant to Section 12.08.020 of the Unified Development Code, for the property located at 2001 S11 195, bearing the legal description of 4.658 acre tract of land, out of the William Roberts Survey, Abstract 524 (2021-23-WAV). David Munk, P.E., Senior Utility Engineer The applicant has requested this item be postponed for 30-days. Motion to grant postponement by Commissioner Noble. Second by Commissioner Stanley. Approved 5- AV Public Hearing and possible action on a Subdivision Variance from Section from the minimum driveway spacing requirement pursuant to Section 12.08.020. of the Unified Development Code, for property located at 3113 W. SH-29, being the legal description of 0.3547 acres, 0.4915 acres, 0.54 acres, 22.54 acres, and 32.69 acres out of the Isaac Donegan Survey, Abstract No. 178 (2021-25-WAV). The applicant is proposing the expansion of two existing driveways, currently utilized to support agricultural use of the adjoining property, and several residences, to a collector level roadway intersection with SH-29. According to UDC 12.08.020. the driveway separation for a full access driveway is 425 feet for a roadway speed of 50mph as measured from the center of the driveway to a street right of way. Technically, the UDC does not specify a driveway separation distance for a 65mph road. However, driveway spacing is consistent with the national standard for stopping sight distance on roadways. In this case, a 65mph SH29 would require 645'. SH29 is signed at 65 mph and therefore the separation between the Riverstone Drive ROW and the center of the Korner Kitchen existing driveway is significantly short at 175 feet. The applicant is proposing the addition of a 500 plus foot deceleration lane across the Korner Kitchen driveway and to Riverstone Drive. The proposed Riverstone Drive is too close to the existing Korner Kitchen Driveway for administrative approval and consequently the Applicant seeks this subdivision variance to allow the installation of Riverstone Drive. Approval of this variance would be required to allow expansion of the existing driveway(s) to meet the City Code requirements for any level of roadway (from local on up). If this variance is not approved, the applicant cannot expand the existing driveways beyond their current width, nor utilize them for a public roadway connection. Motion to approve Item AV (2021-25-WAV) by commissioner McCord. Second by Commissioner Noble. AWConsideration and possible action on a request for reapplication within a period of 90 days for a zoning application recommended for denial by the Planning and Zoning Commission located at at the southwest corner of the IH-35 frontage road and CR 143 (2021-9-PUD) -- Sofia Nelson, Planning Director Chair Perthuis recused from this item. Staff report by Nelson. The applicant addressed the commission and was available to answer questions. Motion to approve Item AW (2021-9-PUD) by Commissioner Noble. Second by Commissioner Heintzmann.
