The Planning and Zoning Commission (P&Z) is now meeting in person. A quorum of the P&Z
Commission will be in attendance at the Council and Courts Building, 510 W 9th St., Georgetown, TX
78626. It is possible that one or more board members may attend via video conference using the Zoom

To allow for as much citizen participation as possible, citizen comments are accepted either in person
or via the Zoom client.

McCord. Second by Commissioner Warren. Approved (4-0) with Chair Perthuis, Commissioner

tract situated in the David Wright Survey, Abstract No.13, from the Agriculture (AG) zoning district to
the Industrial (IN) zoning district, for the property generally located at 2553 N IH-35 (2021-15-REZ).

Staff report by Harwell. The applicant is requesting rezoning of the subject property consisting of
49.890 acres to facilitate the development of a business or industrial park. The property is located
between IH-35 and Airport Road, bordered by Aviation Drive to the North. The junction of IH-35, SH
130 Toll, and the new Aviation Drive extension is due east of the subject property. and the subject
property is currently undeveloped with two small, existing metal sheds on site. The subject property
has an Employment Center Land Use designation and is currently zoned as Agriculture (AG).
Additionally, the subject property is partially located (frontage of IH-35) within the Highway Gateway
Overlay District. The surrounding area near the subject property has both developed and developing
properties. The adjacent properties to the North and West consist of recently Industrial (IN) zoned
parcels including Titan Northpark35 and Texas Outdoor Power Equipment. Land to the East is
currently zoned Agriculture (AG) zoned properties. Land to the south of the subject property consists
of Industrial (IN) zoned property with an approved PUD (Ordinance 2017-07 for Holt Cat
Georgetown). The property is proposed to be rezoned to Industrial (IN). The Industrial District (IN) is
intended to provide a location for manufacturing and industrial activities that may generate some
nuisances. Traffic generation will likely include heavy vehicles, making access to an arterial or freeway
necessary. Unless separated by a major roadway, the Industrial District is not appropriate adjacent to
any residential uses. Special attention should be given toward the appearance of the use as it relates to
the proximity to IH35 as Industrial development is not appropriate within the highway corridor
without significant screening and performance standards. Permitted uses in this district include, but
are not limited to, contractor services, movie production, printing and publishing, office/warehouse,

research, testing and development lab, manufacturing, processing, and assembling, warehousing and
distribution, truck terminal, lumber yard, dry cleaning or laundry plant, asphalt or concrete batch

wrecking, scrap or salvage yard, storage yard, emergency services station, government or postal office,
food catering services, athletic facility (indoor/outdoor), driving range, medical or dental office, general
office, data center, small engine repair, self -storage (indoor), heavy equipment sales, commercial
vehicle sales, rental, or leasing facility, fuel sales, car wash, meat market, and taxidermist. Exhibit 4
contains a comprehensive list of Industrial (IN) district permitted uses and development standards.

Public Hearing and possible action on a proposed Text Amendment to the Unified Development
Code (UDC) relating to the Tree Preservation and Landscaping standards specifically as it pertains to
tree preservation, removal and mitigation, streetyard, gateway and parking landscape standards, and
screening and water conservation requirements (UDC General Amendment No. 20-03) — Ethan

Staff report by Harwell. On July 14, 2020, the City Council directed staff to review the City's tree
preservation and landscaping standards as a part of the 2020 UDC Annual Review Cycle. The purpose
of these revisions is to address ambiguity, conflicts with other code sections, and challenges found nn its
implementation on several development projects. This original list of items was discussed by the UDC
Advisory Committee, the Planning & Zoning Commission, and the City Council. The UDC voted to
recommend approval of these proposed redlines at their March 10, 2021 meeting.
At their March 9, 2021 meeting the Council directed staff to research two additional topics for
consideration as UDC Amendments.
• Consideration of trees smaller than 6-inches in diameter as credit trees.
• Consideration of trees planted in residential lots as credit trees for the purposes of tree
mitigation.
These topics were discussed by the UDC Advisory Committee at their April 14, 2021 and May 12, 2021
meetings. The Committee worked through each issue and has proposed terms for each topic. The
purpose of this meeting of the UDCAC is to make a recommendation to the City Council on these
proposed terms. Attachment VI contains the proposed redline amendments to the UDC. Highlighted
changes are new changes since the March 2021 recommendation to accommodate for the additional
issues included in the amendments by the City Council.
The summary of the UDCAC discussion from the April 14, 2021 and May 12, 2021 meetings are
included with this item (Attachment II). A survey was open to the public on the proposed terms for the
additional items. The results of this survey, open May 31, 2021 to June 10, 2021 are also included

round of amendments approved on March 10, 2021.

Unified Development Code Advisory Committee Action:
At their March 10, 2021 June 16, 2021 meeting the UDCAC voted to unanimously recommend approval
of all the proposed amendments.
The Commission had questions and sought clarification regarding the heritage tree fees and sizes.
Harwell explained that fees were revised at Council's direction. The fees were calculated and a type of
moving scale based on size was developed to allow for the fees to change based on tree size.
Chair Perthuis opened and closed the Public Hearing as no one signed up to speak.

AQ. Consideration and possible action to approve an application for a Stormwater Permit, consisting

The Commission sought clarification regarding regulations in the ETJ. Munk explained what the City
regulates in the ETJ and what the County regulates.
Commissioner Heintzmann sought clarification regarding the approval process. Munk explained.that if
all requirements are met, the application is presented for approval. This application has met all
requirements.
The applicant, Campbell Key, was available to answer Commission questions related to engineering.

Carole Dillon, 532 Rockport Street, commented that there are toxic metals and chemicals in the
drainage that goes into lakes and streams when it rains. She also commented on the owner's
compliance history.
Joanne Randall, 534 Rockport Street, signed up to speak but no longer wishes to speak.
Sharon Lesikar, 414 Palmette Dr, gave her 3 minutes to Vilma Vromant.
Vilma Vromant, 309 Tangle Ridge Lane, presented data regarding the environmental impact of
drainage so close to the community. She also spoke regarding the effect to the residents' quality of life.
Christina Spano,152 Silverado Dr, gave her 3 minutes to Ardath Stewart.
Ardath Stewart,100 Blue Sky Ct, presented to the Commission and discussed the compliance history of
5 Star, and pointed out issues of non-compliance at the owner's other plants.
Mary Ann Sinayi, 114 Stetson Trail, gave her 3 minutes to Christina Schwedtfeger.
Christina Schwedtfeger, 407 Old Blue Mountain Lane, also presented to the Commission and spoke
about the technical requirements that still had not been met by the owner, the inadequate design by the
owner, and the effect on Berry Creek.
Munk commented that the owner is available to answer questions.
Les Garrett, the owner, commented that he is willing to implement technology discussed to improve
the drainage issues and wants to work with neighbors.
Commissioner Heintzmann asked several questions regarding the owner's intent, openness to work
with the residents, and why that site was chosen. Garrett explained he is not open to withdrawing his
application at this time, but would like to work with the residents to address concerns.
Commissioner Heintzmann also asked about the plant's hours of operation.
Michael Spano,152 Silverado Dr, gave his 3 minutes to Tom McCabe.
Tom McCabe,110 Bee Creek, also commented on his opposition.
Rose Chunik, 420 Escondido Drive, gave her 3 minutes to Tim Peery.
Tim Peery,10620 Signal Hill Rd, Austin, TX, commented on effects of living near a concrete plant in his
neighborhood such as increased traffic, shared road with large trucks and encountering blind spots.
Commissioner Warren asked the owner to explain the violations at the other plants. Garrett explained
the violations at other plants. Commissioner Warren also asked about the kind of insurance coverage

the owner has in the event there needs to be clean-up of any discharge, so that the City does not
become responsible for this cost.
Nelson explained the criteria that is used to evaluate applications, which is what was used to determine
if this application met all requirements. Staff found the application is consistent and meets
requirements outlined in the UDC for approval.
