Public Hearing and possible action on a request for a Subdivision Variance from the minimum lot width or street frontage along a public street requirement pursuant to Section 6.02.010 of the Unified Development Code, to allow 2 new lots to be created along a private road, for the property located at 500 Shell Stone Trail (2020-6-WAV) -- Michael Patroski, Planner Staff report by Patroski. The applicant has requested a subdivision variance to Section 6.02.010 of the UDC requiring new lots to have a minimum of 25 feet of frontage and access on a public roadway. The subject property is located along a private road addressed at 500 Shell Stone Trail. The subject property is an estimated 0.48 miles east of the nearest public road Shell Road. The applicant's goal is to subdivide the 10-acre subject property into two lots:1 lot consisting of 7.26 acres, and 1 lot consisting of 2.74 acres. To subdivide property into lots smaller than 5 acres requires the filing of an approved Subdivision Plat with the Williamson County Clerk's Office. The applicant is unable to plat the property and adhere to Section 6.02.010 as the access to the site is via a private roadway, Shell Stone Trail. Therefore, the applicant is requesting a subdivision variance to the requirement that the new subdivision lots have direct access to a public roadway and be permitted to use the existing private roadway Shell Stone Trail. Should the proposed subdivision be permitted to utilize the private roadway as frontage, both proposed lots would have lot frontage over the required 25'. Commissioner McMichael asked what the use is for the second parcel? Patroski explained that it is used for grazing for animals. Commissioner McMichael asked if this is owned by a separate party, and if the purpose is to get an AG exemption on the entire parcel. Patroski explained that the applicant can elaborate and answer that question. Planning & Zoning Commission Minutes Page 6 of 9 August 18, 2020 The applicant, Amber Kurkowski, explained that the land is currently used to graze animals. The concern is that the adjacent property owner will sell the lot in the future where someone can build a warehouse. The reason for the exemption is to keep the land undeveloped for grazing. Chair Brashear asked if the Commission has the ability to limit future use of the property if this is approved. Patroski explained that no limits can be placed on the use at this time. Motion to approve item AO 1,2020-6-WAIT), citing the request's conformance mrith. items 1, 2,4 and 5 of the Staff report, by Commissioner McCord. Second by Commissioner Warren. Approved (6-1), with Chair Brashear opposed. AP. Public Hearing and possible action on a request for a Zoning Map Amendment to zone, upon annexation, approximately 0.526 - acres out of the L.P Dyches Survey, Abstract No.171 to the General Commercial district (C-3) and the Scenic/Natural Gateway Overlay Zoning District, for the property generally located at 8300 RM 2338 (2020-6-ANX) -- Nat Waggoner, Long Range Planning Manager Staff report by Davila -Quintero. The applicant is concurrently seeking annexation and has requested initial zoning designation of General Commercial (C-3) for 0.526 acres. The subject property will functionally be part of the Highland Village development. The small portion of land was not originally included in the Highland Village Annexation, Development Agreement, and Planned Unit Development (PUD) approved by City Council in 2017. The subject property is located along RR 2338 (known as Williams Dr within the city limits), east of the intersection of RR 2338 and Ronald Reagan Blvd. This tract will be functionally incorporated into the Highland Village Development, which is approved through a Planned Unit Development approved by City Council in 2017 (ORD 2017-75). The subject property has a Future Land Designation of Mixed Density Neighborhood (MDN). This designation includes a blend of single-family and medium -density housing types with emphasis on connectivity and access to neighborhood amenities including schools and parks. The surrounding area is vacant and undeveloped, however, there are many entitled developments in the vicinity including Highland Village and Parmer Ranch, both of which are mixed -use developments consisting of residential and non-residential uses. Sun City, a residential development, is located further to the east. This is the first development/planning application for this property. There are however related zoning and annexation cases which contribute to the overall functionality of this tract. Chair Brashear asked if the existing PUD will need to be amended. Davila -Quintero explained that it will not. Commissioner Albright asked when the annexation will take place. Davila -Quintero explained the fast reading will be on September 8, and the second reading on September 22. The annexation would take effect after the second reading. Public Hearing and possible action on a request for a Zoning Map Amendment to rezone approximately 14.518 acres out of the Joseph Fish Survey, Abstract No. 22, from the Agriculture (AG) district to the Local Commercial (C-1) district for the property generally located at 4795 Williams Dr. (2020-10-REZ) -- Andreina Davila -Quintero, AICP, Current Planning Manager Staff report by Davila -Quintero. The Applicant wishes to rezone the subject property from its current Agriculture (AG) zoning district to Local Commercial. The subject property will be divided into two tracts, the dividing line of which will be determined by the proposed major collector roadway that crosses the property in an east -west direction as shown on the City's Overall Transportation Plan. The parcel will be the subject of a future subdivision request to divide the existing lot into two tracts. (See Exhibit 5, Applicant's Letter of Intent for Rezoning). The property is located at 4795 Williams Dr, about '/2 mile northwest of the intersection of DB Wood/Shell Rd and Williams Dr. It is currently undeveloped. The subject property is located along the Williams Dr corridor. This corridor includes a mix of mixed density residential and commercial along and surrounding Williams Drive. Trends continue to include commercial and mixed -density residential in the immediate and surrounding areas. Nearby subdivisions include the Reserve at Heritage Oaks, Heritage Oaks, Gabriel Estates, Merritt Heritage and Oaks at Wildwood. Nearby commercial uses include office, personal services, financial institutions, and retail uses. The southern portion of the property was annexed in 1995 as part of a large area annexation request (Ordinance 95-12). The northern portion was annexed in 2011with the annexation of the northern portion of the adjacent properties and the Reserve at Heritage Oaks subdivision (Ordinance 2011-57). At time of annexation, the property was zoned Agriculture (AG), the current initial zoning district for newly annexed property. Commissioner Warren asked what kinds of buffers will be required for the residences along the two neighborhoods this project will border. Chair Brashear commented that when the application was originally submitted, the request was for C-1 along Williams Drive and MF-2 adjoining the residential neighborhood. The applicant met with the neighbors and the application was amended because the neighbors preferred the C-1 district and not MF. Nick McIntyre, representing the applicant, presented to the Commission. He elaborated that after meeting with neighborhood groups, the original application was amended as Chair Brashear stated. Chair Brashear opened the Public Hearing. Janet Miller is concerned about what will happen to the cemetery on the west side, and how this project will affect it. Kristy Miller also would like more information about how the cemetery will be treated. Chair Brashear closed the Public Hearing. Planning & Zoning Commission Minutes Page 8 of 9 August 18, 2020 The applicant explained that the cemetery is not part of the application. It will not be affected. Motion to recommend approval to the City Council for Item AQ (2020-10-REZ) as presented by Commissioner Warren. Second by Commissioner McCord. Approved (7-0). AR. Discussion Items: a. Updates and Announcements — Sofia Nelson, CNU-A, Planning Director i. Nelson commented that it has been one year since the shot -clock review process was presented. b. Updates from other Board and Commission meetings i. Chair Brashear commented on the GTAB Roadway impact fee process starting, where recommendations to City Council will be made before the end of the year. They will start meeting in September and hold monthly meetings to discuss roadways and funding. Also, the Mobility Bond Committee will start meeting on Monday. They want to get consensus if roadway bond projects are needed and make recommendations to City Council. c. Reminder of the September 1, 2020, Planning and Zoning Commission teleconference meeting starting at 6:00pm. Motion to adjourn by Commissioner McMichael. Second by Commissioner Warren. Approved 7- 0.
