Staff Present: Sofia Nelson, Planning Director; Chelsea Irby, Senior Planner; Andreina Davila- Quintero, Current Planning Manager; Mirna Garcia, Management Analyst Chair Brashear called the meeting to order at 6:00 p.m. and Commissioner McCord led the pledge of allegiance. A. Public Wishing to Address the Board At the time of posting, no persons had signed up to address the Board. Consent Agenda The Statutory Consent Agenda includes non-controversial and routine items that may be acted upon with one single vote. An item may be pulled from the Consent Agenda in order that it be discussed and acted upon individually as part of the Regular Agenda. B. Consideration and possible action to approve the minutes from the April 22, 2019 special called session and May 7, 2019 regular meeting of the Planning and Zoning Commission. – Mirna Garcia, Management Analyst Motion by Chair Brashear to defer taking action on approval of April 22 and May 7, 2019 minutes until the next regular scheduled meeting. Second by Commissioner Stewart. Approved (7-0). C. Consideration and possible action on a Preliminary Plat for 15.37 acres in the Francis A. Hudson Survey, Abstract No. 295, generally located at 1196 La Conterra Blvd, to be known as Hidden Oak (2019-1-PP). – Chelsea Irby, Senior Planner Motion by Commissioner Stewart to approve the Consent Agenda as presented, Item C (2019-1- PP). Public Hearing and possible action on a request to zone a 2.53-acre tract in the Williams Addition Survey, Abstract No. 21, and 0.17 acres consisting of a portion of Old 1460 Trail, a right-of-way of varying width of record described to Williamson County, Texas, designation of initial zoning upon annexation of General Commercial (C-3) and Scenic/Natural Gateway Overlay districts, for the property generally located at 1051 Old 1460 Trail (2019-4-ANX) – Chelsea Irby, Senior Planner The staff report was presented by Irby. Staff has reviewed the request in accordance with the Unified Development Code (UDC) and other applicable codes. Staff has determined that the proposed request meets the criteria established in UDC Section 3.06.030 for a Zoning Map Amendment. The subject property is generally flat with little tree cover. The property has two existing houses, multiple accessory structures, and outdoor storage. The subject property has roadway frontage on Old FM 1460 and FM 1460. The subject property has an existing Future Land Use designation of Mixed-Use Neighborhood Center. The property is currently in the ETJ and is not zoned. There were questions from the Commission members regarding zoning, and impact on other requirements such as spacing between access points to the property. The applicant was invited to speak and provide further clarification. The applicant, Jim Wittliff, spoke about the project and the request. He provided details about the current property, and the need to be preserved. Once the property is annexed and properly zoned, there will be clean up work of the site and maintain the property. There are plans for a 1-story residential building and a small office-type of building. Chair Brashear opened the Public Hearing. One speaker signed up to speak regarding the item. The speaker, Danny Sean, had questions about the right-of-way easement and sought clarification. Chair Brashear provided clarification to Mr. Sean and explained that the request is to rezone the property and define land use within the property lines. This request will not affect other property. Chair Brashear closed the Public Hearing. Motion by Commissioner McCord for approval of Item D (2019-4-ANX), the zoning map amendment to zone the subject property to general commercial (C-3) and Scenic/Natural Gateway Overlay upon annexation. Second by Commissioner Stewart. Approved (7-0). E. Public Hearing and possible action on a request for a Special Use Permit (SUP) for the multi-family, detached specific use in the Mixed-Use Downtown (MU-DT) zoning district on the property located at 203 Forest St, bearing the legal description of 1.46 acres out of the Nicholas Porter Survey, Abstract No. 497, also being Lots 5, 6, 7, and part of Lot 8, Block 8, Division D, part of Lots 5, 6, 7 and 8, Block 4, Division D, and a part of Outlot I, Division D, of the Original Townsite of the City of Planning & Zoning Commission Minutes Page 3 of 4 May 21, 2019 Georgetown, and a portion of W 2nd St and Forest St (2019-3-SUP). – Andreina Davila-Quintero, AICP, Current Planning Manager The staff report was presented by Davila-Quintero. Staff has reviewed the request in accordance with the Unified Development code (UDC) and other applicable codes. Staff has determined that the proposed request meets the criteria established in UDC Section 3.07.030.C for a Special Use Permit. The applicant is requesting a Special Use Permit (SUP) for the specific use of “multifamily, detached dwelling units” within the Mixed-Use Downtown (MU-DT) zoning district to construct 16 multifamily, detached buildings, for a total of 26 dwelling units. According to the applicant’s Letter, the development will be a cottage style mix of single-story and two-story wood framed structures. The building footprints for the units are small, ranging from 400 to 600 square feet, and each unit will have a front porch to encourage community interaction, with pathways between the units. Commission members had several questions regarding floodzone areas and drainage. Davila- Quintero provided clarification regarding the property’s location in floodzone areas and indicated that the structures will be outside those areas. Davila-Quintero also provided explanation regarding the need for a Special Use Permit (SUP). Commission members also had questions regarding fire department requirements and safety. Davila-Quintero explained that there were requirements that need to be met by the applicant, and they are meeting with the fire department to ensure those requirements are met. There was also a question regarding the amenity requirements and Davila- Quintero provided explanation that there is an amenities list that outlines those requirements. There is a minimum number of amenities the applicant is to provide for the project. The applicant spoke and provided additional clarification regarding the property and the amenities that will be provided. Chair Brashear opened the Public Hearing. No one came forward. Chair Brashear closed the Public Hearing. Motion by Commissioner McCord to recommend approval of Item E (2019-3-SUP), the Special Use Permit (SUP) requested for the multi-family, detached specific use in the Mixed-Use Downtown (MU-DT) zoning district. Second by Commissioner Newman. Approved (7-0). F. Public Hearing and possible action on proposed amendments to Chapter 7, Non-residential Development Standards and Chapter 8 Tree Preservation, Landscaping, and Fencing of the Unified Development Code relative to setbacks and bufferyards when non-residential development is located adjacent to single family development in the ETC. – Sofia Nelson, CNU-A, Planning Director The staff report was presented by Nelson. On February 26, 2019, the City Council directed staff to review the minimum setback and bufferyard requirements when non-residential development is adjacent to residential development in the extraterritorial jurisdiction (ETJ) as part of the current UDC Annual Review process. The purpose of this amendment is to provide the same level of separation, buffering and screening to single-family homes in the ETJ when non-residential Planning & Zoning Commission Minutes Page 4 of 4 May 21, 2019 development is adjacent to residential in the city limits. The proposed amendments to the UDC include: increase the minimum side and rear setbacks when adjacent to residential development for commercial, office, civic and industrial zoning districts; and provide a low, medium or high level bufferyard, as applicable, when multi-family and non-residential development is adjacent to single- family homes in the ETJ. The Commission members sought clarification of the changes and where to locate the changes made in the Unified Development Code. Nelson provided clarification of these changes. Chair Brashear opened the Public Hearing. No one came forward. Chair Brashear closed the Public Hearing. Motion by Commissioner Stewart to approve the amendments as presented for Item F. Second by Commissioner-in-training Patterson. Approved (7-0). G. Discussion Items, Updates, and Announcement. – Sofia Nelson, Planning Director No updates at this time Chair Brashear provided an update to the Commission regarding GTAB. Nelson provided information regarding the UDC Advisory Committee and proposed changes and fencing standards issue. The next Planning and Zoning Commission meeting will be held on June 4, 2019.
