HomeMy WebLinkAboutMinutes_P&Z_09.18.2018City of Georgetown, Texas Planning and Zoning Commission Meeting Minutes Tuesday, September 18, 2018 at 6:00 p.m. Council and Courts Building, located at 101 E 7th Street Georgetown, TX 78626 Commissioners present: Tim Bargainer, Vice -Chair; Ercel Brashear; ; Roger Chappell; John Marler; Kayla McCord, Gary Newman; Ben Stewart; Josh Schroeder, Chair : Travis Perthuis, Alternate Staff Present: Sofia Nelson, Planning Director; Andreina Davila, Current Planning Manager; Robyn Miga, Planner; and Nat Waggoner, Long Range Planning Manager; and Karen Frost, Recording Secretary. A. Chair Schroeder called the meeting to order at 6:00 p.m. Commissioner McCord was absent, Commissioner Perthuis joined the dais. Marler led the pledge of allegiance. Chair Schroeder stated the order of the meeting and that those who speak must turn in a speaker form to the recording secretary before the item that they wish to address begins. Consent Agenda The Statutory Consent Agenda includes non -controversial and routine items that may be acted upon with one single vote. An item may be pulled from the Consent Agenda in order that it be discussed and acted upon individually as part of the Regular Agenda. B. Consideration and possible action of the minutes of September 4, 2018. Karen Frost, Recording Secretary C. Consideration and possible action on a Preliminary Plat for the Sun City Neighborhoods 73-80, 88 and 89 Subdivision, consisting of approximately 335.95 acres out of the Frederick Foy Survey, Abstract No. 229, Ronald Reagan Blvd, between CR 245 and SH -195 (PP -2015-020). Andreina Davila -Quintero, AICP, Current Planning Manager Motion by Bargainer to approve the consent agenda item. Second by Brashear with a request to amend the minutes to correct the wording of item D to indicate correct vote. Second of the amendment by Marler. Amendment approved 7 - 0. Motion approved 7 - 0. Legislative Regular Agenda Schroeder noted the number of guests and asked to move item G to the beginning of the Regular Agenda. So moved by Bargainer, second by Marler. Approved 7 - 0. Item G was addressed first but will be noted in order of agenda. D. Public Hearing and possible action on a Replat of approximately 5.09 acres consisting of Lot 26, Logan Ranch Section 1 Subdivision, located at 391 Logan Ranch Road, to be known as the Replat of Lot 26, Logan Ranch, Section 1 (FP -2018-013). Public Hearing and possible action on a Replat of approximately 10.043 acres consisting of Lot 46, Whitetail Section II Subdivision, located at 409 Doe Run, to be known as Replat of Lot 46, Whitetail Section II (FP -2018-017). Andreina Davila -Quintero, AICP, Current Planning Manager Davila presented the staff report. Chair Schroeder opened the Public Hearing and with no speakers coming forth, closed it. Motion by Bargainer, second by Marler to approve the replat of 409 Doe Run. Approved 7 — 0. F. Public Hearing and possible action on a Replat of approximately 0.477 acres consisting of Outlot 23, Division A, City of Georgetown, located at 507 W 17th St., to be known as the Ann Gillespie Smith Subdivision (FP -2018-027). Robyn Miga, Planner Miga presented the staff report. Chair Schroeder opened the Public Hearing and with no speakers coming forth, closed it. Motion by Newman, second by Brashear, to approve the replat. Approved 7 — 0. G. Public Hearing and possible action on a request to rezone approximately 26.6 acres out of the David Wright Survey, Abstract No. 13, located along Lakeway Dr between Northwest Blvd and Airport Rd, from Local Commercial (C-1) to Industrial (IN) zoning district (REZ-2018-018). Andreina Davila -Quintero, AICP, Current Planning Manager Davila presented the staff report and review. Allen Hill spoke as the representative for the owners. He is speaking for his wife and her two brothers whose family owns this property. He explained their ownership for the past 70+ years, citing the rerouting of Lakeway Drive and the expansion of the airport. He explains their desire to develop the property. Nick Boyd also spoke and explained the buffers and transitional space. They feel their request is consistent with the future land use land map and the comprehensive plan. Brashear asked about proposed list of restrictive uses. These are self-imposed deed restrictions. Brashear asked if they are open to other considerations, for example having certain activities restricted to indoor use only. He is not completely open to restricting the external uses. Schroeder opened the public hearing. He explained the procedures. Les Romo, Canyon Road, is adamantly opposed to this rezoning. He appreciates the developer proposing deed restrictions, but states those are not reliable. He states the elementary and middle school are very near this property, along with residences, and does not want this industrial rezoning. He feels this is driven by monetary gain, but will devalue the property values in that area. Jennifer Franz, 120 Canyon Road, has a major concern about the number of elementary students that are in the immediate area. She is concerned that the toxic fumes from this rezoning will expose children to toxicity. She is also concerned about the traffic and the amount of trucks on this road. This zoning district is too much for this property and could be disastrous. Brittany Mangin,118 Canyon Road, comes to the committee from a place of love and logic. She Planning & Zoning Commission Minutes Page 2 of 4 September 18, 2018 wants to object to the industrial uses and understands the safety of the children and value of the homes. Their neighborhood is a quiet place and they want to keep it that way. Look at other areas for industrial zoning. Shawn Flonouy,101 Canyon Road, is concerned that an environmental impact study and traffic study has not been conducted. He feels this change will be detrimental to the neighborhood. Industrial use poses a danger for the elementary and middle school children. Elizabeth Hunter, Roble Grande, appreciates that these owners have been good citizens, but believes this is just another way for the airport to encroach into neighborhoods. They do not believe the airport is in a great place. The noise and air pollution is bad. Traffic is bad on Lakeway and Northwest Blvd. The flooding issues will become worse. Ron Doemback, 128 Canyon Road, says never received a notice of this petition, lives approximately 500 feet from this property. He feels the intended purpose of the new zone will not be enforceable. He is concerned about the drainage and Nina Young, 112 Canyon Road, wants to express concerns that the buyer is already under contract. She asks for an impact study to protect the children. She considers Georgetown to be beautiful, with deer in residential areas, the cougar, wild turkey and red foxes. She does not want to see them leave. Chase Tinney, 119 Canyon Road, believes in speaking up for what is right. They have a close knit neighborhood, arid an industrial park near their neighborhood is not right. Chair Schroeder closed the hearing with no other speakers coming forth. Motion by Marler, second by Stewart to recommend to council denial of this rezoning Brashear speaks. He explains there are many steps, plans and studies to develop a property. These guard the project regardless of the zoning of the property. He is concerned that the recently approved Airport Master Plan would allow this transition zone. He appreciates that a possible PUD will help with restrictions and guiding the development. There are many things to consider in this application, and this area. Bargainer comments that the land owner should look at a PUD zoning and talk to the neighborhood, to get this property developed. Marler believes the C-1 zoning is applicable in this area. McCord agrees and states development is inevitable in this area. She feels many of the uses in Industrial zoning district are unsuitable. Schroeder agrees with Brashear and that the commission cannot force environmental or traffic studies. It is hard to live near an airport. And that is usually where industrial uses are built. Motion to deny passes 5 — 2. (Schroeder and Brashear opposed.) H. Public Hearing and possible action on a request to rezone Rivery Phase 1 Block B, Lot 5E, approximately 4.428 acres, and located at 716 S IH -35, from Local Commercial (C-1) to General Commercial (C-3) zoning district (REZ-2018-019). Robyn Miga, Planner Bargainer and Brashear recused themselves for conflict of interest and filed the affidavit with the recording secretary. Chappell took the dais. Miga presented the staff report. Motion by Chappell, second by McCord to approve the replat. Approved 6 — 0. I. Presentation and discussion of initial findings of the subarea profiles. - Nat Waggoner, AICP, Long Range Planning Manager Waggoner explained that the comp plan update process. This summer, the housing situation is being studied in the city. There will be opportunities in the future for this board to discuss different strategies and recommendations with council. He explained the subarea map development and what it would be used for. This will be used with the planning area housing data to identify how many housing units and types of those units. They are reviewing price per square foot and house prices historically and projections. They are looking at the share of the market for types and prices of homes. They are looking at rentals versus sales. They are trying to summarize the full data report and how that can be utilized to plan the future of the city. Commissioners discussed the numbers and concerns about the difference between wealth versus income and the difference that is affected by SU students and those in Sun City. There is concern about the median income number and the correlation to affordable housing. Waggoner will come back with more data next time. J. Updates and Announcements.
