Planning and Zoning Commission Meeting
Minutes
Tuesday, September 4, 2018 at 6:00 p.m.
Council and Courts Building, located at 101 E 7th Street Georgetown, TX 78626
Commissioners present: Tim Bargainer, Vice -Chair; Ercel Brashear; Alternate; John Marler; Gary
Newman; Travis Perthuis, Alternate; Ben Stewart; Josh Schroeder, Chair
Absent: Kayla McCord, Roger Chappell
Staff Present: Sofia Nelson, Planning Director; Robyn Miga, Planner; and Nat Waggoner, Recording
Secretary.
A. Chair Schroeder called the meeting to order at 6:00 p.m. Commissioner McCord was absent,
Commissioner Perthuis joined the dais. Marler led the pledge of allegiance. Chair Schroeder stated
the order of the meeting and that those who speak must turn in a speaker form to the recording
secretary before the item that they wish to address begins.
Consent Agenda
The Statutory Consent Agenda includes non -controversial and routine items that may be acted
upon with one single vote. An item may be pulled from the Consent Agenda in order that it be
discussed and acted upon individually as part of the Regular Agenda.
B. Consideration and possible action of the minutes of June 19, 2018. Nat Waggoner, Recording
Secretary
C. Consideration and possible action on a Preliminary Plat for the Wolf Ranch Section 4A
subdivision, consisting of approximately 77.659 acres out of the Stubblefield C. Survey and the
Thompson J. Survey, generally located south of Wolf Ranch Parkway, west of IH -35 and south
of W University Ave, and east of the intersection of DB Wood and Wolf Ranch Pkwy. (W SH 29)

Legislative Regular Agenda
D. Public Hearing and possible action on proposed amendments to Chapter 3, Applications and
Permits, Chapter 5, Zoning Use Regulations, and Chapter 16, Definitions, of the Unified
Development Code (UDC) relating to Mobile and Outdoor Food Vendors. Sofia Nelson, CNU-
A, Planning Director.
Nelson presented the proposed amendments. Brashear asked Nelson to clarify temporary
classification (transient) category. Brashear asked if a mobile unit was required to be removed
when not in use. Nelson responded yes. Brashear asked that separation requirements be
considered between mobile food unit and multi -family units.
Perthius asked that staff clarify what constitutes "open" for multi -family. Nelson remarked that
it would default to the status of the leasing office.

Chair Schroeder asked that staff clarify the reason for recommending a generator over a
standard 110 volt outlet. Schroeder asked who is getting permitted. Nelson remarked that the
property owner seeks the permit. Schroeder asked about secondary use (temporary). Schroeder
asked if a temporary license extends to a new property owner. Nelson remarked that
continuance between operator and the new property owner is between private parties.
Schroeder asked if the concept changed, could they seek a new permit.
Brashear, asked how many temporary permits does the City handle now. Will there be a new
staffing requirement? Nelson remarked that it is currently handled by the Permitting
Department and putting an ordinance in place will require a future tracking mechanism.
Chair Schroeder opened the public hearing and with no speakers coming forth, closed the
hearing.
Motion by Bargainer, second by Marler to recommend approval of the proposed
amendments regarding Mobile and Outdoor Food Vendors. In Support 5-1. Brashear
opposed.
Discussion: Brashear was concerned about the separation between residential and temporary
situations. Need to prove that use will not have a noise impact. Newman likes the way the
permitting process is organized to allow businesses to prove concepts.
Brashear moves to amend the original motion to remove MF 1 & 2 from the transient
classification. Second by Newman. Motion fails 2 - S.
Schroeder - On secondary use, there is no reason to limit it to 1 year since the city does not
require special use permits for permanent structures. Bargainer - This process provides
flexibility that brick and mortar development does not. Agrees with Brashear on building
code/setback consideration for separation.
E. Public Hearing and possible action on a request for initial zoning of Public Facility (PF) upon
annexation of 1.42 -acre tract in the William Addison Survey, Abstract No. 21, for the property
located at 2705 E. SH 29, located north of SH 29/University Ave and west of Inner Loop, to be
known as Fire Station No. 7 -- Sofia Nelson, CNU-A, Planning Director

Nelson presented the rezoning request.
Chair Schroeder opened the public hearing and with no speakers coming forth, closed the
hearing.
Motion by Marler second by Steward to recommend to council initial zoning for the
proposed annexation of the Fire Stations No. 7. Approved 7 — 0.
F. Public Hearing and possible action on a request to rezone approximately 0.71 acres consisting of
Lots 7 and 8, Block 1, Williams Addition subdivision, located at 1625 Williams Drive, from the
Residential Single Family (RS) zoning district to the Office (OF) zoning district (REZ-2018-017).

Randy Howry represented two properties surrounding the adjacent. Does not oppose rezoning
of office. Concerned with undeveloped property immediately north. Seeking clarification on
impact of rezoning of this particular tract.
Chair Schroeder closed the hearing with no other speakers coming forth.
Brashear- Rezoning is only to serve property immediately abutting Williams Drive.
Motion by Brashear, second by Marler to recommend approval of the rezoning to council.
Approved 7 - 0.
G. Public Hearing and possible action on a request to rezone approximately 18.331 acres out of the
Ruidosa Irrigation Company, Abstract No. 715, located 118 Mourning Dove, from the
Agriculture (AG) to the Residential Single -Family (RS) zoning district (REZ-2018-007). Sofia
Nelson, CNU-A, Planning Director
Nelson presented the rezoning request.
Chair Schroeder opened the public hearing and with no speakers coming forth, closed the
hearing.
Motion by Newman, second by Marler to recommend approval of the rezoning to council.
Approved 7 - 0.
H. Presentation and discussion of the 2030 Comprehensive Plan Update- Nat Waggoner, PMP,
AICP, Long Range Planning Manager
Nat Waggoner presented an update to the Planning and Zoning Commission.
Mr. Brashear asked for income data or net worth data for each subarea
