Chair Horne called the meeting to order at 6:00 p.m.
Chair Horne stated the order of the meeting and that those who speak must turn in a speaker
Form to the recording secretary beFore the item that they wish to address begins. Each speaker
is permitted to address the Commigsion once For each item, for a maximum of three (3)
minutes, unless otherwise agreed to before the meeting begins.
B. As of the deadline for this agenda, no persons were signed up to speak on items other than
what was posted on the agenda.
Consent Agenda
The Consent Agenda includes non -controversial and routine items that the Commission may
act on with ons single vote A Commissioner or any member of the public may request that
any item from the Consent Agenda be pulled in order that the Commission discuss and act
upon it individually as part of the Regular Agenda. Ttve Planning and Zoning Commission's
approval of an item on tkve Consent Agenda will be consistent with the staff recomxnendaton
described in the report, unless otherwise noted.
C. Consideration of true Minutes of the April 15, 2014, meeting of the Planning and Zortiaag
Commission.
Motion by Commissioner Brent to approve the minutes from the April 15, 2014 Pla.,....,g and
Zoning meeting. Second by Commissioner Fuller. Approved. (6-Oj

D. Public Hearing and possible action on. a Comprehensive Plan Amendment to change the
future land use designation from Moderate Density Residential to the High Density
Residential for 4.'75 acres in the William Roberts Survey, Abstract No. 524, located at 2700
Shell Road. CPA -2013-002 (Mike Elabarger)
E. Public Hearing and possible action on a Rezoning of 20.02 acres in the William Roberts
Survey, Abstract No. 524, from the Agriculture (AG) District to 495 a of Multifamily
District (MF), 10.22 acres of Neighborhood Commercial District (CN)cand 5.05 acres of
Residential Single Family District (i<S), located at 2700 Shell Road. REZ-2013-021 (Mike
Elabarger)
Mike Elabarger provided an overview of the Comprehensive Plan Amendment request along
with the Rezone request, description of project and recommend for approval.
Commission and staff had extensive discussion regarding project
Chair Home invited the applicant Yo speak.
Nick McIntyre representative for the applicant spoke and answered questions from

Terrie Hoster, 3003 Edgewood Drive, v iced concerns the facility wffi change the character of
the neighborhood and questions if the facility wffi be built once zoning change is made.
Shirley Ric1-t, 30004 Edgewood Drive, stated the property value will decrease and water
pressure along with drainage issues will continue to deteriorate.
Darlene 7ilka, 30006. Edgewood Drive, stated property value will decrease; the setback should
be 100ft and voiced concerns if apartment complexes are built on the property.
Susan Andrews; 30017 Edgewood complained about the outdoor lighting, water and
drainage issues, and home owner's property valve will decrease.
Angie Benefield, 30000 Edgewood voiced concerned the Alzheimer^s Facility is becoming a
distraction to the beautiful community of Berry Creek.
Eric Qu sou m law and part of the Family that lives and works at the faolity spoke. He
addressed the concerns of the citizens and assured them building apartment complexes is not
their intent He stated we are a certified Alzheimer's facility not just a memory care which is
held at a higher level of standard through the States
Steve Averill, 30024 Edgewood also voiced concern regarding the drainage, property being
devalued and uncertainty of what potentially could be built on property.
Chair Horne closed the Public Hearing.
Commission inquired and staff responded the City Engineer, David 1Vlunk will address the
water pressure and drainage issues during the platting phase. Staff explained the existi. g
concerns and issues are not related to the applications being presented this evening.

Motion by Chair Horne to recommend to City Council approval Comprehensive Plan
Amendment to change the future land use designation from Moderate Density Residential to
the High Density Residential for 495 acres in the William Roberts Survey, Abstract No. 524,
located at 2'700 Shell Road_ Second by Commissioner Ra..hi.... Denied. (2-4) Brent, Fuller,
Webb, Viotti
Chair Horne asked and Staff strongly suggested sendirvg forth approval or denial of the
rezoning application to City Council.
Motion by Chair Home to r end to City Council approval Rezoning of the 10.22 acres
of Neighborhood Commercial District (CN), 5.05 acres of Residential Single Family District
(RS) and denial of 4.75 acres Agriculture (AG) District to of Multifamily District (MF), located
at 2'700 Shell Road.
Motiorz dies for 2acX of a second.
Staff instructed commission to take up a 2^a motion to put clear on the record what the
positions of the majority of the members are.
Motion by Commissioner Brent to recommend to City Council approval of the request to
rezone S.OS acres of Residential Single Family District (RS) and recommend approval of what
is shown as region 4 on Shell Spur Road to CN and approve region 1 for single Family
residential and take the balance of region 3 and limit the use to group housing.
Staff stated the City's code does not allow the type of zonir�g on region 3. Commissioner Brent
rescirided his motion.
Staf£ stated if the majority of the members are not supporting this. application, the
Commission should make a recommendation to City Council to deny the case or perhaps
make a recommendation to the applicant to apply For a Planned Unit Development.
Motion by Commissioner Fuller to disapprove the motion as proposed and make
recommendation the project is brought back in a form of a hLl'D. Second by Commissioner
Brent. Approved. (6-O)
F. Public Hearing and possible action on a Rezorung of 116.45 acres in the Joseph Fish Survey,
Abstract 232, from Agriculture (AG) District to 1.51 acres of Neighborhood Commercial (CN)
District, 5.09 a of Local Commercial (C-1) Districq and 109.54 acres of Residential Single -
Family (ILS) District, located on Williams Drive and behind Ford Elementary School and the
Woodlake residential subdivision, adjacent to Lake Georgetown. REZ-2014-003 (Mike
Elabarger)
At this time Commissioner Brent, recused TximseZffrom the dais due to conflict of interest
Mike Elabarger provided an overview of the Rezone request, description of project and
recommend for approval.
Chair Horne invited the applicant to speak.
Applicant, Brian Birdwell, 6549 Commancl-ie Trail gave a brief overview of his application
and wasavailable for quer tions.

Chair Home opened the Public Hearing.
Lorraine Bustamante, 255 Woodlake Drive, Representing the Board of Directors for Woodlalee
Subdivision voiced concern with increased traffic th_ ough subdivision, dianges to the
character of the neighborhood- property values decreasing and road access.
Don Young, 301 Wildwood concerned with traffic flow increase due to the addition of
another 300-500 homes.
Staff stated a Traffic Impact Analysis (TIA) will be done through the platting stage of the
application. Staff stated tree applicant proposes 3oD homes.
Barb Antal, 235 Wildwood Drive also concerned with traffic and narrow streets.
Chair Horne closed the Public Hearing.

Neighborhood Commercial (CN) District, 5:09 acres of Local Commerdal (C-1) District, and

G. Public Hearing and possible action on a Rezoning o£ 3.40 acres in the Joseph Thompson
Survey from the Agriculture (AG) District to the Residential Single -Family (RS) District for
land to be added to flue future Bluffview Subdivision_ REZ-2013-022 (Jordan Maddox)
Jordan Maddox provided an overview of the Rezone request, description of project and
recommend for approval.
Chair Horne opened the Public Hearing. No one came forward to address the Commission.
Chair Horne closed Public Hearing.
Motion by Commissioner Brent to recommend to the City Counal approval o£ the rezoning
request, conditional upon the completion of annexation on May 29"'. Second by
Commissioner Fuller. Approved. (6-O)
H. Public Hearing and possible action on proposed amendments to the Unified Developmeak
Code (UDC) relative [o permitted zoning districts, development standards and definitions for
multi -family land uses. (Valerie Kreger)
Valerie Kreger was not present Andrew Spurgin provided a brief overview of the proposed
amendments to the Unified Development Code.
Discussion between commission and staff regarding bypassing the city's newly formed
Unified Development Code Advisory Committee and its urgency.
Motion by Commissioner Fuller to recommend to City Council approval of the proposed
amendments to the Unified Development Code (UDC) relative to permitted zoaing districts,
development standazds and definitions for multi -Family land uses_ Second by Commissioner
Vieth. Approved (6-O)
Staff informed Chair Horne to Open and Close the Public Hearing. At this time; Chair Home
Opened the Public Hearing_ Nb one came forwaid to address the Commission.

(Chair Horne). Chair Horne gave a brief overview of the May 6.n UDC Advisory
Committee meeting.
Update on the Georgetown Transportation Advisory Boazd (GTAB) Meerings.
