Regular Agenda: 3.Consideration and possible action on a request for a Certificate of Design Compliance for facade changes at Lost Addition, Block 13, Lots 5-6, located at 1011 South Austin Avenue. (CDC-2008-038) Wyler presented the staff report of the application. The applicant seeks approval to install a wooden fence around mechanical units. The current units are on the roof and unscreened, but with the addition of new dry cleaning equipment in the store, the HVAC units need to be placed on the ground an must be screened. The proposal is for a six foot wooden fence to be erected around the units to minimize the visual impact from the street. Wyler provided Guideline 8.22 to give staff recommendation to this project. Motion by Gonzalez to approve the CDC for screening as presented. Second by Knight. Approved 5 – 0. 4.Consideration and possible action on a request for site changes at City of Georgetown, Block 51, Lot 1(pt), located at 118 West 8th Street. (CDC-2008-042) Wyler presented the application. The applicant is seeking a CDC to make site modifications to the alley seating to provide better scenery for customers located at the rear of the building. They intend to create a European courtyard atmosphere that will tie the outdoor seating area in with the Bistro’s theme. Wyler presented the Guidelines that support the staff recommendation with conditions that the east mechanical enclosure be redesigned to allow direct egress from the escape ladder, and that the mechanical door be constructed of another material than metal, perhaps wood which would be more characteristic of the theme. Robert May, owner of Down the Alley Bistro showed an example of the mural design. He stated that his engineer has engineered the back patio to drain correctly so the impervious cover concern has been addressed. He stated he met with the City’s Urban Forrester, Heather Brewer and they determined that one tree should be protected and the Bradford Pear tree can be removed. He will replace it with a 65 gallon oak tree and only mortar the underlying brick to the drip line. Mr. May discussed the fire escape that was mentioned in Wyler’s staff report. He indicated his intent was to place the fire escape so that egress will be outside the nine foot mechanical screening wall. He showed drawings of the murals again and explained how the fire escape would be designed into the mural to be unobtrusive. Then Mr. May explained the lighting to be used on the metal arches through the alleyway, leading into the courtyard. Commissioner McCalla suggested using c-9 lighting instead of mini-light Christmas lights. Mr. May said that was his intent. Commissioner Johnson questioned the fire escape being placed far enough from the wall to be safe. Wyler stated again he would ask the Commission to place a condition on the CDC that all improvements must comply with fire and building safety codes. Motion by Knight to grant the Certificate of Design Compliance for site changes as requested with the condition that all city building and fire codes be met. Second by Gonzalez. Approved 5 -0. 5.Conceptual Review and discussion with the applicant on the proposed Contessa infill project, located at the southwest corner of 8th and Rock Street. Wyler introduced Martin Brown, owner of The Brown Group out of Austin. Mr. Martin presented a proposed multi-story residential/retail infill project at the southwest corner of 8th and Rock Street, to be called Contessa. Mr. Martin stated they have studied the area and they believe there are housing and retail/office needs here. This property is not in the Courthouse View Corridor and so the height restriction is forty feet. There are parking issues and Mr . Brown met with Tom Yantis, Assistant City Manager to discuss. The proposal is to have some parking onsite with the exit of the parking into the city parking lot that is shared by the public library. The property needs 26 parking places per code and they can get 20 onsite and 10 with on street parking. Mr. Yantis was amenable to this and said they could apply for an easement to exit through the city parking lot .. Mr. Brown stated that the developer wants to teardown and rebuild the building, not remodel the current structure that is not a historically significant building. He feels the best use would be accomplished this way. They are proposing balconies and a rooftop garden . The building is built to the property lines on 8th and Rock Streets but the balconies project over the right-of-way. He stated they will need an easement to project over the parking lot. To have the rooftop garden, an elevator is required which would need an elevator housing that is over forty feet. Also, the Plexiglas guardrail on the roof is higher than forty feet. He questioned the commission about the veneer of the building and asked what they would like to see. Match the library? Stucco and brick? When questioned about the sidewalk elevation Mr. Brown stated he would like to remove the existing elevated sidewalks and bring those back down to street level per the city code. The Commissioners discussed the project with Mr . Brown. Knight indicated she would give up the extra height for the good design. Johnson stated he has a problem with the height and removing another historic building. He said this was the old Cash-n-Carry over 50 years ago. Mr. Visser, the architect, said that this group has done the due diligence on the structure. The building is falling apart, the metal siding was attached to wood and the wood is rotting, there is no insulation behind the metal or wood and the building is in bad shape. The building cannot be brought up to current codes and be safe. They are looking at cleaning up the area between the Square and the library . Mr. Visser wanted to clarify the height request they will be making, stating it will be between 48 and 50 feet. Gonzalez wants the applicant to be very clear on the height requests when they come in for application and supports this project with residential uses in the downtown area and like the uniqueness of the roof garden, saying it was a good tradeoff for the additional height. There was further discussion of planning for utility lines, sidewalks, handicap access and streetscapes, shared parking and street level uses. McCalla stated she likes the project and appreciates them not trying to mimic historical style and using scale and surrounding to design the building. O’Donnell thanked the Brown Group for bringing this forward. 6.Comments from the Director and reminder that there is a HARC Sign Subcommittee meeting on January 8, 2009 and that the next regular HARC meeting will take place on January 22, 2009. Cook reminded everyone of the next meetings. She responded to Knight’s question of when the draft Guidelines might be ready for review, possibly late January or early February. Moore requested that Wyler check on the brightness of Tamiro Plaza’s lighting and open bulbs, stating it seemed too bright. (CDC-2008-035) This item was moved to the regular agenda for the Commission to vote on as a whole . The Sign Subcommittee did not meet prior to this meeting. Wyler gave a summary of the proposed application. The Museum was seeking approval of a new projecting sign and glass signage for the renamed Williamson Museum . The Commissioners asked clarifying questions. Motion by Johnson to approve the signage as presented, with the logo. Second by Gonzalez. Approved 4 – 0. 3.Consideration and possible action on a request for a Certificate of Design Compliance for signage at Dalrymple Addition, Block G(N/PT), located at 406 W. University Avenue. (CDC-2008-037) This item was moved to the regular agenda for the Commission to vote on as a whole . The Sign Subcommittee did not meet prior to this meeting. Wyler gave a summary of the application. The applicant was seeking approval of a new freestanding sign to be located at the front of the property facing University Avenue. Motion by Gonzalez to approve the Certificate of Design Compliance as presented. Second by Johnson, with a note that this house originally belonged to Miss Annie Purl, after whom a local elementary school is named. Approved 4 – 0. Regular Agenda: 4.Consideration and possible action on a request for a Certificate of Design Compliance for signage at City of Georgetown, Block 28, Lots 1-8, located at 501 South Austin Avenue. (CDC-2008-034) Wyler presented a brief summary of this application. The applicant was seeking approval of a Master Sign Plan for Tamiro Plaza Phase One. On October 9, 2008, the Historic and Architectural Review Commission (HARC) Sign Subcommittee agreed to forward this item onto the next regular Commission meeting to be held on October 30, 2008. The reason was to allow the full Commission the opportunity to review the Master Sign Plan due to the large scale of the project. The original Master Sign Plan proposal included a projection sign facing Austin Avenue . On October 15, 2008, Staff was notified by the Agent that the projection sign is no longer part of the application and requested it be pulled from the application. Also, some details on the monument sign have been updated since the Subcommittee meeting. Those changes were reflected in this report . Gordan Baker, the applicant’s agent, was available for questions. He stated that the new limestone carving on the building was now more subtle than the original application and that the lettering would be green to match the awnings, not blue as in the diagram presented to the Commission. Commissioners asked clarifying questions about the lettering on the windows. Wyler reminded the Commission that they were approving the style, font and size of the signs, not the lettering as the individual tenants were not listed yet. Motion by Johnson to approve the Master Sign Plan for Tamiro Plaza as presented. Second by Gonzalez. Approved 4 – 0. 5.Consideration and possible action on a request for a Certificate of Design Compliance for demolition at Glasscock Addition, Lots 1 & 2 (E/pt), located at 406 East 4th Street. (CDC-2008-036) Wyler presented the application for demolition. He explained that the applicant does not have a plan for the future of this lot as required by the Unified Development Code for commercial zoned structures. It has been the commission’s policy to require a site plan for demolition permits in the Old Town Overlay District, but it is not required. Nick Rames, the homeowner across 4th Street stood up and stated that he thinks the house is an “eyesore” and that it would benefit the neighborhood and community to have it demolished . Commissioner Gonzalez discussed that fact that a house left to decay should be demolished, or it will get worse for the neighbors. There was discussion of what is enforceable . Wyler gave examples of the Dangerous Building Code items that would cause the house to be demolished by law. Some of those items listed were the roof caving in, or something in the house that would make it inhabitable, not an unleveled foundation or anything aesthetically unpleasant. There was more discussion among the commissioners. Motion by Johnson to approve the demolition as requested. Second by Gonzalez. Short stated he agrees the house should be replaced but does not agree with the code that requires a specific type of house. Approved 4 – 0. 6.Comments from the Director and reminder that the next regular HARC meeting will take place on December 11, 2008. Reminder of the next meeting by Chair O’Donnell. Regular Agenda: Item #2 above was presented by Wyler for discussion. He gave the guidelines that were applied as basis for staff recommendation of approval. O’Donnell questions the light source. Wyler explained and showed the example in the packet. Moore questioned the size of the sign in comparison to the size of the building. Wyler stated it was in compliance and the building section used for compliance was 24 feet. Knight stated she thinks the lighting is not the right type for this sign. Motion by Gonzalez to approve the sign as designed, with the exception of the lighting source which must be brought back before the sign subcommittee. Second by Johnson. Approved 6 – 0. 3.Consideration and possible action on a request for a Certificate of Design Compliance for facade and site updates at City of Georgetown, Block 50, Lots 2-3(E/pt), located at 213 West 9th Street. (CDC-2008-031) Chair O’Donnell recused himself from the dais with a conflict of interest affidavit filed. Gonzalez took over as Chair for this item. Wyler presented the staff report. The Palace Theatre plans to renovate its building located directly behind the theatre along 9th Street. The building is 50 feet wide by 112 feet deep. Mr. Kostko owns the private alley located around the subject building so no allocations to the City will be needed for items proposed within that space. The applicant proposes repainting most of the facade and updating window and door features, along with the 9th Street canopy. The colors and proposed locations and renovations are included in the packets. Commissioners discussed the possibility of a mural on the alley side of the building. Kostko responded that had been looked at, but the metal siding with strips makes that difficult. There was a discussion about the size of the canopy in the alley. It is designed at only eight inches so it will not impede truck traffic in the alley. The owner was told he may want to look into a License to Encroach if a bigger canopy is desired. Short shared his historical knowledge of this building and the alley. He stated the alley was owned by John Hoyt, Sr. and that a previous Mayor had requested that Mr. Hoyt deed half of the alley to the City. Short stated he believes that happened and the city should be involved in the decision about the encroachment into the alley. Motion by Short to approve the Certificate for Design Compliance as presented, but subject to determination of the ownership of the alleyway and if the city owns it a license to encroach is authorized by the city for the extended awning. Second by Knight. Approved 5 – 0. 4.Consideration and possible action on a request for a Certificate of Design Compliance for facade updates at City of Georgetown, Block 41, Lot 4(PT), located at 708 S. Austin Avenue. (CDC-2008-032) Chair O’ Donnell reseated on the dais. Donna Heimburg, Code Enforcement Officer for the City, gave a brief history of this property. She introduced Ginger Willette, the tenant applicant and owner of the Loading Dock. Ms. Willette asked for approval of an existing patio feature located at the rear of the building facing the alley and proposed making a few minor updates to improve the look of the back of the building. The Commission debated the look and style of the balcony . The also discussed the processes that led to this balcony being non-conforming. They questioned whether a tenant that receives a CDC gets a new CDC, does that negate the previous CDC. Cook responded yes and that the CDC goes with the tenant. Julie McCartney, Chief Code Enforcement Officer, spoke to the Commission regarding the handling of this specific case. Motion by Moore to approve the CDC based on the application to paint the metal structure, add a gate to the wooden fence and replace the roof over the second story entrance, with the condition that materials and design for the roof over the door must come back to HARC before being built. Second by Gonzalez. Approved 6 – 0. 5.Consideration and possible action to reschedule the October 23, 2008 meeting to October 30, 2008. The Commission agreed to move the meeting . Knight and Short will be absent on Oct. 30. 6.Comments from the Director. Cook reported the Commission will be having workshops with Nore Winter and Company to work on the Design Guidelines, November 11 through 13. One of the workshops will be open to the public. And one of the meetings will be a night meeting. Specific locations and times will be sent out. There will not be a regular HARC meeting in November. The regular meeting falls on Thanksgiving, and Christmas in December, so the rescheduled date for those two combined meetings is December 11. The City Council will hold a joint workshop with HARC on November 24. More information to come on that workshop. There was a question on sidewalks in the downtown area and what is allowed to be displayed on the sidewalks. McCartney reported that HARC does not have jurisdiction over the sidewalks and displays. Obstructing a sidewalk is a violation of the Nuisance Code which states three feet of passageway must be clear for pedestrians. On June 26, 2008, the applicant requested HARC approval on a Certificate of Design Compliance amendment. At the meeting, the Commission asked the applicant to come back within 60 days with certain items of concern for discussion and possible approval. On July 24, 2008, the applicant came back to the Commission to address all of the concerns that were presented at the June meeting. The applicant was given approval of the CDC amendment with the condition that an awning is put up along the Church Street facade of the south section of the restaurant. The Commission asked that the awning design come back for approval no more than 60 days after the July 24 approval. At this time, the applicant has submitted to staff and the Commission the design and rendering of the new awning and asks for CDC approval. The awning will be centered along the south section of the restaurant as depicted in the provided rendering. The awning will project 4 feet out and will be 4 feet tall with a total span of 23 feet that will cover the entire opening of the terrace. “Erin Green” by Sunbrella Fabrics will be used for the awning’s color. A printout of the color has been provided in the application packet and a material sample will be presented at the HARC meeting. Guideline 10.1 – An awning compatible in material and construction to the style of the building is encouraged. 1.) The green that is proposed will both complement the building and fill in the large white facade of the terrace overhang 1.)The awning will be no wider than the opening to the terrace A simple, triangular look to the awning will help to transition the building into the adjacent residential neighborhood. 3.)No internal illumination is proposed for the awning at this time. Guideline 10.4 – Mount an awning or canopy to accentuate character-defining features. 1.) Spanning the terrace opening, the awning will act as a decorative feature. 2.) The awning will not block any architectural detailing to the facade. Vice Chair Gonzalez invited the applicant to speak. Mr. Tom Nichols, Eleven Thirteen Architects, Inc. stated he tried several different colors for the awning and felt this is the best color for this project. He hopes the Commissioners will agree. (CDC-2008-010) Robbie Wyler read a memo that was included in the Commissioners packet. On April 24, 2008, Lee McIntosh was given Certificate of Design Compliance (CDC) for the 1105 Church Street property with a condition that he return to HARC with a sample of the proposed masonry material for the first floor facade. On July 24, 2008 he presented a material sample to the commission and stated that he will soon place it onto the facade of the Georgetonian for HARC’s viewing and consideration. Since the July meeting Mr. McIntosh has informed staff that he will be using one inch cut limestone instead of the previously proposed material. At this time, a sample of the limestone has been placed on the east facade of the Georgetonian. Therefore, by the August 28 HARC meeting, each commissioner should have an opportunity to view the limestone. He is asking that HARC take action on the material at that meeting, so that he can proceed with the renovation project. Vice Chair Gonzalez invited the applicant to speak. Mr. Lee McIntosh stated he has been working with several different designers. However, due to the economic slow down, he decided to go with a lime stone veneer. A picture of the Lymestone brand veneer was presented to the Commissioners. Commissioner Knight wished to review the March 27th minutes. After reviewing the minutes from the March 27th meeting, staff confirmed the design was approved, but the material needed to come back for approval, once a sample was placed up on the side of the building. (4-1) (Knight) 4.Consideration and possible action on a request for a Certificate of Design Compliance for site updates and an alternative parking plan at Lost Addition, Block 66(PT), located at 1102 Rock Street. (CDC-2008-029) Staff report given by Robbie Wyler. The applicant seeks approval on a Certificate of Design Compliance amendment for minor on-site modifications and an alternative parking plan to allow for business use. Mr. Wyler gave a brief history of the property . Mr. Wyler further informed the Commissioners that the applicant would like to maintain the residential feel of the property and to allow for residential backyard use, the applicant would like to place all eight spaces off-site. Five spaces will be constructed along 11th Street and an additional three will be located on the west side of Rock Street just north of 11th Street. By allowing these eight spaces to be allotted to the Gilmer Office Building, the applicant can keep most of the backyard for personal use. The parking layout along 11th Street and the sidewalk have had staff review and are awaiting HARC approval before the applicant submits the final plans. Secondly, the applicant is seeking approval to move the existing fence, currently located within the public right of way, to allow for the off-site parking, a new six foot wide public sidewalk and enclosure of the remaining yard. The new six-foot tall wooden fence would be reconstructed to enable their children and grand-children to safely play in the back yard as well as to provide screening. The new fence will be the same design as the existing one . Finally, the applicant is proposing a small, portable wooden building in the back yard. It will measure 10 feet x 12 feet. The structure, currently off-site, has the same color and trim as the existing building. Guideline 7.11 – Seek uses that are compatible with the historic character of the building. The applicant has stated she wants to keep the front and rear of the building as residential as possible to allow for family use. By placing the parking along 11th Street, the property can maintain its residential feel. 2.) No doors or porches will be altered. Guideline 8.1 – Preserve significant sidewalk features. 1.) The proposal would connect both the 11th and Rock Street public sidewalks allowing for a continuous walking path. 2.) The new sidewalks will match to those existing . Guideline 8.2 – When new sidewalks are to be installed, they shall be compatible with the traditional character of the streetscape. 1.) The new sidewalk along 11th Street will replace the aged one and will maintain the compatibility of the street with keeping parking to outside of the public sidewalk. Guideline 8.21 – Maintain the established progression of public-to-private spaces. 1.) By allowing the off-site parking, the property will have the public parking along 11th street, allowing the private fenced-in backyard to remain. 2.) A semi-public sidewalk will connect Rock Street to the front door. 3) All new sidewalks will match to those existing. Vice Chair Gonzalez invited the applicant to speak. Mr. Francisco Choi acknowledged Renee Hanson in the audience and then gave a power point presentation. Mr. Choi showed how tall his phase one building compared to the County Courthouse. He stated the heart of this discussion tonight will be, “Is Georgetown ready to go taller ? “ Mr Choi stated City of Georgetown has a 40 foot limit. Phase one is 51 feet. Phase two could be about 65 feet. He would like to do a larger scale building. Mr. Choi presented at power point presentation. Commissioner Johnson stated that Mr. Choi has been successful with approvals from HARC and City Council because he has made monumental building. Mr. Johnson said that he has to make a decision by deciding if this will be another monumental building for Georgetown. Commissioner McCalla stated we have the policies in the UDC designed to keep the integrity of downtown Georgetown. She is concerned with allowing the height of the building to grow and grow. Commissioner Knight stated the guidelines are in place to keep the integrity, but it seems there are more and more applicants wanting exceptions and this concerns her. McCalla left the meeting at 7:25 p.m. Mr. Gonzalez asked Mr. Choi how many square feet would he need for phase two. Mr. Choi stated 36,500 square feet of the first phase and he would like to double the size of phase two. 6. Comments from the Director. There was a discussion of complementing blue colors and matching blues to existing signs. Motion by Gonzalez to approve the sign CDC as submitted. Second by Johnson. Approved 4 – 2. Consideration and possible action on a request for a Certificate of Design Compliance amendment for facade updates at City of Georgetown, Block 27, Lots 1-8 located at 501 Austin Avenue. (CDC-2005-012) Wyler presented the staff report. This application meets the guidelines 8.1, 8.2 and 8.4. This is an application to change the original approved facade and site layout for Phase 1 of Tamiro Plaza. The sidewalks and doors must be rearranged to provide handicap access ramps and the design of the handrail for the ramp is as simplistic as possible to reduce the visibility. Staff recommends approval or the redesign. The Commissioners questioned the applicants on why the most visible corner was chosen and what jurisdiction the HARC had in city sidewalks. Mr. Choi, the applicant and owner, explained that two doors of the building had to have handicap access according to the fire code and he had worked with the city street department to design the best possible situation. He also said the elevation of the southeast side of the building made, with the door included would cause them to lose 2 – 3 parking spaces. There was more discussion about alternative locations . Commissioners expressed their concerns about taking away part of the sidewalk on a prominent corner of the block. Mr. Choi assured them he was doing everything possible to reduce the appearance of the sidewalk ramps. Elizabeth Cook stated that if necessary, an easement into the sidewalk could be granted to allow the encroachment into the right-of-way. Motion by Knight to approve the Certificate of Design Compliance amendment based on the applicable Design Guidelines for 501 Austin Avenue. Second by Gonzalez. Approved 4 -1. (Short opposed.) 4. Consideration and possible action on a request for a Certificate of Design Compliance for minor facade changes at City of Georgetown, Block 51, Lot 4(pt) located at 104 1/2 West 8th Street. (CDC-2008-026) Wyler presented the application. The applicant seeks approval for minor facade changes facing 8th Street as a result of weather damage and ensuing modifications. The applicant is the roofing company that has been hired to replace scuppers and collectors on the roof. Motion by Gonzalez to approve the application as submitted. Second by Moore. Approved 5 – 0. 5. Consideration and possible action on a request for a Certificate of Design Compliance for facade approval at Glasscock Addition, Block 23, Lots 1-8, located at 1105 Church Street. (CDC-2008-010) Wyler presented the application and showed a material sample. Mr. McIntosh, the owner and applicant, stated the window samples are applied to some of the south side windows. the limestone material will be placed on the east side. The limestone material presented is actually an EFIS material with the color match of native Florence limestone. He said he would email the Commission when the material is up so they can look at it. Chair O’Donnell stated he thought it was to look like cut stone. Short questioned the durability. McIntosh stated that other than repairing any damage from hail or storms, the product was guaranteed for 25 years with a recoating every 10 years. Chair O’Donnell thanked Mr. McIntosh for coming. 6. Consideration and possible action on a request for approval for a Certificate of Design Compliance amendment including signage at Cody’s Addition, Block 1, Lot 1, located at 1201 Church Street. (CDC-2007-018) Wyler presented the application. The applicant is seeking approval on a CDC amendment for facade and site changes, including signage. The Commission asked the applicant to come back within 60 days of the last meeting to discuss paint samples, and updated site and elevation plan and materials to be used for lighting and planters. The applicant provided all materials and drawings . The paint samples indicated a darker beige color on the south end of the building , with lighter color on the middle and north end to reduce the impact. The updated site plan included parking, landscaping and fencing as requested. The updated elevation included lighting sconces , fences with evergreen vines and planters. The requested sign is to be located above the windows and hung from the soffit centered on the north section of the structure. No lighting is being proposed for the sign. Wyler read the Guidelines that were applicable in the staff recommendation. Those were guidelines 8.3, 8.13, 9.4, and 9.5. Chair O’Donnell questioned Tom Nichols, applicant and architect, about the color choices for the building. Nichols stated he preferred a one color building. O’Donnell agreed he prefers the simplicity and look of one color. The Commissioners discussed different options to change the impact of the larger building on the south end. There was also discussion on lighting the sign. The applicant chooses not to do any signage lighting at this time. The screening material on the rooftop was discussed and Nichols explained it would be C-channel type metal and painted the same color as the rest of the building. The awning material was discussed and it was decided that since there was not a sample, this item must come back to the Commission before being installed. Motion by Gonzalez to approve a CDC for 1201 Church Street with the following specifications: 1. The awning on the building is approved as a concept with the condition that the materials, color and renderings and drawings must be brought in for final approval. 2. Sconces are approved with compliance with code specifications. 3. The building be painted a single color. 4. The sign is approved as presented. 5. The fence will start at six feet and drop to 4 feet in the front sideyard as per the site plan. 6. Planters on the south side of the building will be placed more toward the front of the building and of a smaller scale and the planters on the north side of the building will not be in a straight line and will be a smaller scale than indicated on the drawing. Second by Moore. Short amends to allow the owner to arrange the cluster of planters on the north side of the building. Gonzalez accepts the amendment. Gonzalez amends his original motion to include that the awning must be in place within 60 days of approval of the awning CDC. Second by Moore. Approved 4 – 0 – 1 (Knight abstained.) 7. Update from staff on modifying CDC application procedures. Cook distributed the new forms and checklists that are being modified. The contractors and applicants will be required to sign them in the future. Commissioners stated they like requiring the applicant to provide more material samples but questioned the enforcement of the new rules. Cook says staff is prepared to be stricter with the enforcement of submittal materials. There was discussion regarding the lack of inspections being done on HARC projects . It seems the lack of site plans in the downtown district means less enforcement because inspections are not being called in. There is a coordinated effort being put in place between Building Inspections and Planning to review all site plans against HARC approvals and building code regulations. Wyler is currently doing more on-site inspections of all downtown projects to helpfully stop projects in a timely manner that are out of compliance. Commissioners asked the upcoming UDC amendments include sidewalk guidelines for improved pedestrian flow. Commissioners also requested a statement on the applications that the property owner is ultimately responsible for all work on the property and it is their obligation to inspect the contractor’s work on a regular basis. They also requested that the checklist include a beyond a written description, a sample board, using the word “shall” instead of “may” for all requirements. 8. Wyler introduced Mr. Kostka, who represented the Palace Theatre. Mr. Kostka explained that the Palace Theatre had purchased the building behind the theatre and was renovating it. He presented the current ideas and was soliciting comments from the Commission before moving forward. The Commissioners asked questions. Provided comments that they liked the concept, suggested an awning over the future front door on 9th Street, leave as many windows as possible and consider painting a mural or something on the east side of the building facing the alley. Mr. Kostka thanked the Commission and said he would return at a later date. Mr. O’Donnell returned to the dais and took over as Chair. 5. Consideration and possible action on a request for a Certificate of Design Compliance for signage to Lost Addition, Block 13, Lots 3&4, 7&8, located at 1005 South Austin Avenue. (CDC-2008-024) Wyler presented the staff report. This application was originally taken to the Sign Subcommittee , who made suggestions and deferred to the main Commission. The applicant made changes to the awning sign as suggested and was seeking approval. Mr. Kidd was present to discuss any further changes and answer questions. He stated the existing awning would remain underneath the new awning but the signage behind the original awning would be removed. Motion by Gonzalez to approve the CDC for the awning as updated and resubmitted. Second by Johnson. Approved 5 – 0. 6. Consideration and possible action on a request for a Certificate of Design Compliance Amendment for facade changes to Lost Addition, Block 13, Lot 2, located at 1008 South Main Street. (CDC-2008-014) Wyler presented the application. This was an amendment request for an existing CDC of a building remodel. The applicant was proposing shorter windows on the south side elevation for restroom and break room privacy and convenience. And the removal of one window on the north elevation of the building for interior wall placement. The applicant was not present and the Commissioners discussed the changes. Motion by Gonzalez to approve the CDC facade changes as requested. Second by Short. Approved 5 – 0. 7. Consideration and possible action on a request for a Certificate of Design Compliance Amendment for facade changes to Cody’s Addition, Block 1, Lots 1, located at 1201 Church Street. (CDC-2007-018) Wyler presented the background and the applicant’s proposal. On July 26, 2007, the applicant came to the Historic and Architectural Review Commission (HARC) with an application to modify the roof design of an existing structure as part of an overall project to allow for a future restaurant tenant (CDC-2007-018). After working with the commission on a few design concepts, a final approval was given at the August 30, 2007 meeting. Approval was based upon the idea that the footprint of the structure would not be changed and that the elevation would match that of the rendering provided at the final meeting. The approved design has been provided as Exhibit A. On June, 5, 2008, staff met with the architects and contractor on the project to discuss concerns being expressed on the design of the building now under construction, especially the south end. At the meeting, it was concluded that the design of the south end of the building was not in compliance with the August 2007 HARC approval or the building permit. Subsequently, the applicant and agent have proposed an amendment to CDC-2007-018 for HARC’s consideration. The amendment consisted of roof elevation changes in both height and width. The applicant’s agent , Karalei Nunn with 1113 Architects was present for comments. She stated that they wanted to comply and develop a compromise at this point. She also stated that they did not recognize the comments on the building permit, to be in compliance with HARC-issued CDC as well as other technical comments, as direction to change the plans . She suggested that at this point all they could do was to provide a substantial landscape buffer, for example bamboo. Commissioners discussed the need to improve the process to include a closer review of the building plans to match the approved CDC. Wyler explained that in this case a site plan was not required because there was not a change in use or a change in the building footprint. He state the Building Department and Planning Department are now working closer to insure building plans are being reviewed against site plans and approved CDC. There is a movement toward requiring a site plan and more detailed drawings for complete renovation CDC applications. Sam Mason, of 1205 Church Street, the adjacent property owner was present. He stated he likes the building even though he realized the south portion of the building “grew”. He stated he wasn’t able to make a quick decision about the barrier landscape wall or fence that was being proposed. Nunn suggested postponing the barrier decision with Mr. Mason until more information had been gathered. Mr. Mason also spoke to the parking issue, recognizing that there will not be enough parking for the restaurant. Nunn stated the owner recognizes this also, but nothing can be done. Wyler stated no offsite parking agreement(s) were required because there was not a change in use. Sammy Evans, the General Contractor spoke to the issue. He stated the footprint of the building did not change and the walls were put back in the original location. The elevation is different than the original presented and approved version because the original could not be built. The slope was not drawn correctly on the approved drawings. He said they had to screen the mechanical equipment in two places instead of the one on the roof as originally shown. Short expressed he wanted ideas submitted for de-emphasizing scale and mass. Nunn agreed the originally proposed planters would come back and she would develop a plan to help level the scale, including paint colors or materials. Commissioners discussed issues and frustrations that the process did not stop the changes sooner. There was also more discussion on parking problems for this site . Motion by Gonzalez to grant the CDC amendment for facade changes located at 1201 Church Street, with future approval needed for the barrier between the building and the house next door and a plan for deemphasizing the mass and scale must be submitted back to the Commission and on a Commission agenda within 60 days. Second by Moore. Approved 5 – 0. 8. Possible discussion on the Downtown alternative parking agreement map as requested by Nancy Knight at the May 22, 2008 HARC meeting. Commissioners reviewed the map and expressed concerns about future parking and lack of spaces and requirements that don’t mandate a larger number of spaces for businesses. Cook explained the Downtown Overlay has different requirements than the rest of the city. They also have less parking available to them. And a property that is an existing business is not required to have more parking if that use does not change. This is a property rights issue not a HARC issue . Commissioners all expressed knowledge of a problem and concern that there are not regulations to address the problem. Cook expressed that the City is attempting to address these issues by possibly putting in a parking garage on the west side of downtown. Discussions are being held. 9. Comments from the Director and reminder of the next meeting on July 24, 2008. O’Donnell reminded everyone that a training session for the Commission was still being planned. Cook will email possible dates for confirmation in the near future. O’Donnell requested the city address the problem of the lack of checks and balances in the building permitting system, between the HARC approval, the issuance of a building permit, and the actual construction of the building. He suggested tougher applications, requiring more information for more informed decisions to be made. Dave Hall spoke to this and stated that one improvement was that Wyler is now reviewing construction plans in the Downtown Overlay District against the HARC approvals. Wyler is also performing weekly site inspections on the larger projects. Commissioners requested that staff employ more of a police type effort and place stop work orders on jobs if warranted. They also requested that staff come back with recommendations and a punitive type statement that can be placed on HARC CDC’s and building permits. They also requested that exterior elevation inspections be added to the job card and be required for each renovation and building site. O’Donnell requested that a statement be incorporated in the CDC approval that if any changes are made to the original submittal, for fire services, public safety or utility connections, then the CDC must be amended through the HARC process. In regards to a Special Use Permit, the question was raised whether a Permit could be issued without a Certificate of Design Compliance. Minutes stated that Wyler confirmed this. It should state that a Special Use Permit and a Certificate of Design Compliance can be issued independently of each other, but the applicant must receive both to move forward with the proposed use. Wyler confirmed that. Motion by Gonzalez to approve the minutes of the April 24, 2008 meeting with the amendments as stated. Second by McCalla. Approved 5 – 0 with 1 abstention. West Short abstained due to not being at the April 24th meeting. Regular Agenda: 2.Consideration and possible action on a request for a Certificate of Design Compliance for facade updates at Lost Addition , Block 14, 0.165 acres, located at 1100 South Main Street. (CDC-2008-018) Wyler presented the staff report. The applicant is proposing an update to the Main Street Baptist Church Youth Center facade by changing the retail look of the structure and taking down existing awnings. The new look will be similar to that of the Ministry Center located on 10th Street. Wyler read the Guidelines that were applied to this application. Commissioners asked questions for clarification of the details. Jim Cummins of Steger & Bizzell spoke for the applicant. He spoke to the exterior materials, stating they were trying to make it look like the Ministry Center building across the street and using stucco instead of glass, and painting over the brick or adding stucco material over it where necessary. David Voelter also represented the applicant and explained that the brick would be resurfaced, not replaced, to match the stucco. Knight asked about the delineation of the brick showing through. Voelter said that even with the stucco material put over the bricks, the delineation will still show through. McCalla stated she felt that leaving some of the glazing on the south side would be better. Cummins said the doors to the building would be on both the east and the south side. Motion by Johnson to approve the Certificate of Design Compliance for 1100 South Main Street based on compliance with the applicable Design Guidelines. Second by Moore. Knight moves to amend the original motion to indicate that if the color or texture changes from looking like brick, the item must come back to the Commission for additional review. Second by Moore. Original motion voted on, approved 6 – 0. 3.Consideration and possible action on a request for a Certificate of Design Compliance for signage and facade updates at Morrow Addition, Block O, located at 1205 South Austin Avenue. (CDC-2008-019) Wyler presented the staff report. The applicant is seeking a CDC to update the gutters on the structure, add an ADA compliant ramp to the rear of the structure and to install a pole sign to the front yard. He read the Guidelines that were used to review this property. Questions were raised by the Commissioners. Knight asked about the signage type that was requested versus putting the sign on the structure as in other applications. Wyler explained that it was based on different zoning classifications allowing different types of signs. There was discussion about the materials and colors of the sign. The Commission was in agreement that the requested shiny gold seems out of character with the area. Motion by Knight to approve the facade updates as requested with the condition that the sign CDC application comes back to the Sign Subcommittee for further review and discussion. Second by McCalla. Approved 6 – 0. Moore commented that the applicant went to great lengths to maintain the residential character of the structure. He suggests eliminating pole signs in the downtown overlay district. Short suggests telling the applicant to change the font size and type and to make the sign more legible. 4.Consideration and possible action on a request for a Certificate of Design Compliance for awnings at City of Georgetown Block 39, Lots 1-4 (PTS), located at 107 East 7th Street. (CDC-2008-021) Wyler presented the staff report. The applicant is seeking a CDC to add two small awnings to the building’s 7th Street facade. Wyler read the Guidelines that were applied. The Commission questioned the location of the awnings in comparison to the neighboring awnings . They discussed options. The Commission as a whole stepped outside the Council Chambers to look at this building and the adjacent buildings. Then the Commission stepped back on the dais . Motion by McCalla to approve the CDC for two awnings at the front of the 7th Street facade with the stipulation that the awnings be made using the striped material as shown and that they be made to match the form and detail of the adjacent buildings . Second by Short. Approved 6 – 0. 5.Consideration and possible action on a request for a Certificate of Design Compliance for a new door and sidewalk railing at City of Georgetown Block 40, Lots 1 and 4 (PTS), located at 114 East 7th Street. (CDC-2008-022) Wyler presented the staff report. The applicant is seeking a CDC to add an additional door to the 7th Street facade of the building for future tenant use and to add removable iron railings at the edge of the sidewalk in front of the businesses. Staff recommends denial of both the door and the railing. The applicant was not present for questions or comments . Commissioners discussed the trough planter concept and the doors not fitting correctly without replacing the windows too. Motion by Knight to deny the CDC for the door replacement with the recommendation that the applicant reapply for a CDC with double doors that will match the existing doors on the building. Second by Gonzalez. Approved 6 – 0. Motion by McCalla to deny the CDC for awnings, sidewalk railings and site design based on noncompliance with Guidelines 10.1, 10.3, 8.2, 8.3, 8.6, 8.7, and 10.4. Second by Nancy. Approved 6 – 0. 6.Discussion of offsite parking agreements for the Downtown Overlay District. Wyler presented the parking plan that was in effect before this meeting. Knight requested that a discussion of this plan be added to the next agenda. The Commission discussed the process that city staff uses to stop construction or halt progress when a project changes from the original CDC application and approval. Cook explained the inspections process and stated the Planning and Inspections Departments were working with one another to determine inconsistencies in approved plans and field inspections. (CDC-2008-010 and CDC-2008-009) Wyler reported that this item was pulled from the agenda by the applicant. 3.Consideration and possible action on a request for a Certificate of Design Compliance for facade and site changes and an alternative parking plan at Lost Addition, Block 13, 0.165 acres, located at 1008 South Main Street. (CDC-2008-014) Wyler presented the staff report. The applicant is seeking CDC approval to renovate the exterior of the building which includes adding a second story to the rear of the building, removing existing materials and exposing original siding while also landscaping the property to provide a courtyard on the side of the property. This structure was built in 1925 and is classified as a medium priority historic structure according to the 1984 Georgetown Historic Survey. The survey noted the primary significance as the building’s architecture, a rare example of the bungalow style used as a commercial building. Prior to the Survey, the building was given a faux brick facade to cover the original aging wood siding to the building. No record of the building’s original color has been found. The applicant proposes to restore the building to its original character and update the interior to today’s modern professional office standards. Wyler listed the guidelines that apply to this application. Bryant Boyd, architect for the project, was available for questions. Knight says she appreciates the building renovation efforts but has trouble with the parking areas. Wyler explained that the requirement, per the Unified Development Code is one parking space per 500 square feet of floor area. In this area, an alternative parking plan can be proposed and has been. Commissioners voiced concerns about the extensive use of alternative parking plans in this area and the lack of parking spaces that can be used due to already being allocated. Wyler agreed to bring in a map of parking spaces in the downtown area that have already been allocated to existing businesses. Chair O’Donnell opened the floor for comments. Sharon McCarty McKinnon, owner of the business located at 1003 S. Austin Ave, spoke in regards to the parking issue. She owns the parking lot that is adjacent to the applicant’s property. She says the lot is not always full, but that it is a private parking lot and she needs to keep those spaces available for her employees and customers. She was also concerned about parking of construction vehicles during the renovation of this building. She would like her parking lot access closed off on the Main Street side of the lot if possible. She was directed to speak to city staff for follow-up and direction. Commissioner Johnson questioned the removal of the cast iron staircase. Mr. Boyd stated the stairs were added in the 1960’s and are not up to present code so need to be removed. Johnson wanted Mr. Boyd to keep the exterior side doors and the staircase. Johnson also questioned the addition of a skylight to a historic building. Boyd said it was to improve the natural lighting in the stairwell. Discussion was held back and forth regarding the exterior doors. Mr. Boyd agreed to come back to the Commission once the building tenant was secured and a decision was reached about the interior configuration. Motion by Johnson to approve the Certificate of Design Compliance for this project as outlined in the staff report, with the exception of the skylight addition and removal of the exterior stairway on the north side of the building and doors which we disapprove. Motion died for lack of a second. Motion by Gonzalez for approval of the Certificate of Design Compliance for facade and site changes and an alternative parking plan at Lost Addition, Block 13, located at 1008 S. Main Street as presented. Second by Knight. Approved 4 – 1. (Johnson opposed, O’Donnell for.) Motion by Knight that the applicant must bring the landscaping and final layout (site plan) back to the commission for approval. Second by Tommy. Approved 4 – 0. 4.Consideration and possible action on a request for a Certificate of Design Compliance for signage and site changes at Montgomery Addition, Block 1, Lots 10 and 11, located at 1903 South Austin Avenue. (CDC-2008-015) Wyler presented the property summary and background. He stated the applicant is seeking CDC approval to allow for office use of a Residential Single-Family (RS) zoned property. He explained that City Council recently passed an ordinance that allowed a change in use of a Single-Family Residential zoned property to be used for an office, subject to standards in the UDC Section 5.02.125, with a Special Use Permit. The change in use will include the addition of parking (including the demolition of an existing garage), the construction of a handicap ramp and the addition of a business sign to the building. Wyler further explained that the applicant is currently awaiting Planning and Zoning Commission and City Council decision on a Special Use Permit (SUP) application to allow the proposed office use of the house. He said the application is scheduled for Planning and Zoning Commission public hearing on May 6, 2008 with first reading at City Council on May 27, 2008. If HARC wishes to approve this application it should be conditioned on the approval of the SUP by City Council. If the SUP is not approved, the applicant cannot proceed with the office development of this house and property. Wyler gave the history of the house. This is the Halley House, built in 1916, and is classified as a Medium Priority Structure in the 1984 Georgetown Historic Survey. A double garage is mentioned as an “Outbuilding” to the primary structure, although no historic significance is provided. Wyler suggested the applicant might have more information on the garage that he was unable to locate. The applicant proposes changing the use from residential to office as allowed with the recently adopted UDC amendment and with proper approvals. Due to the current location along South Austin Avenue and adjacent to a commercially zoned property, the applicant has stated that a small business would suit the property best. Wyler went on to report that a major part of the project is the addition of six parking spaces. In the commission packets, the parking layout, currently under review by staff as the Site Plan, is required for the Special Use Permit. Wyler said that he expects the site plan review to be finalized before the May 6 meeting. He said staff worked with the applicant to design the parking spaces and the use of Eco-crete, which allows drainage through the parking spaces, to protect the large 20-inch pecan tree and other large trees on the property. He stated the applicant is proposing to remove the existing driveway to protect more of the trees and allow for the six parking spaces. Demolition of the garage, which is shown to be sinking about 18 inches, will allow room for two more parking spaces. The parking will be screened by landscaping per the site plan that is under review by staff. In addition, a sign proposal is being put forth for a free standing sign and a hanging sign. The ordinance only allows hanging signs. Wyler stated HARC has the ability to approve or allow a wall sign instead of free standing or hanging sign, if they so choose. The CDC application includes the approval of a sign. Jim Coulter, engineer for the project was available for questions. Chair O’Donnell asked about the application of the Eco-crete. The engineer produced a sample and Wyler said it was acceptable to the Permitting and Inspections Department, and up to code standards. Knight said she was opposed and disappointed in this project and felt the city was piecemealing the Design Guidelines and Zoning Ordinance to fit the project. She said this property is the perfect transition from commercial into that residential neighborhood. Knight said it is the quintessential bungalow that people expect to see on our main arteries coming into the historic community and she was not in favor of granting a special use permit or any of the things proposed to make this anything other than residential. O”Donnell asked for confirmation that the Special Use Permit is to be considered by the City Council and that the Commission was not acting on that . Wyler confirmed. Moore asked for confirmation that the Special Use Permit is contingent upon receiving a CDC from HARC, and that if HARC denies the CDC then the Special Use Permit cannot be issued. Wyler confirmed. Moore gave background on this item from the Planning and Zoning (P&Z) Commission meeting. He said the applicant originally requested a rezoning to commercial (C-1) zoning through the P&Z Commission. The request was denied. After that a City Councilman proposed the ordinance allowing this to happen and the applicant withdrew the original application to rezone it to commercial use and applied under this ordinance to allow office use. Moore said that there was quite a bit of opposition to the ordinance and he opposed it and shared the views of the other commissioners. He reported the ordinance passed the council and is in effect. He stated unless the commission can find something wrong with the proposal, there is not much to be done. He emphasized that because of the opposition to this from many people in Georgetown that felt any non-residential use should not be allowed into Old Town, which is exactly what this does, the City Council discussed that there should be a compromise. The compromise proposed would allow office use but it would maintain as much as possible the appearance of a residential flavor of the structure. The ordinance references the “maintaining the residential property appearance” and he said that was very important in the debates. He suggested the Commission not use the same design criteria for office use in the downtown zone because the yard signs and parking are not consistent with a residential appearance. He reported that also, the people that live next to this are in a residential used structure and he stated the Council didn’t feel the residents should have to see a yard sign in the adjacent property because they cannot convert to office use also. Moore thinks the sign should be attached to the building to remain unobtrusive. He also thinks the lights on the outside of the building are not in compliance with the Design Guidelines. The proposed lights are too bright and obtrusive . He also discussed the fact that the proposed curb cut is half the size of the front property line and that much curb cut and concrete is not of a residential character. He said the engineer said it is required by the city. Wyler confirmed that the city engineer and fire department have approved the necessary curb cut. Cook said the City may be able to look at another solution for the curb cut size. O’Donnell asked about regulations that were used to identify the requirements for this project and the use that would be allowed. Wyler stated the general criteria were reviewed against the Unified Development Code for the use and the Design Guidelines. Cook shows in the UDC that there are standard criteria that the HARC is supposed to use in reviewing CDC applications. One is that the integrity of an individual historic structure is preserved. She went on to read from UDC Section 3.13.030, “The overall character of the Historic or applicable Overlay District is protected . Signs that are out of keeping with the adopted design standards, and are not in character with the site or landmarks within the Historic or applicable Overlay District in question will not be permitted. The following may also be considered by the HARC when determining whether to approve a certificate of design compliance: The effect of the proposed change upon the general historic , cultural and architectural nature of the site, landmark or District, The appropriateness of exterior architectural features, including parking and etc.” She stated those are the generic guidelines from the UDC that can be used when something in Old Town is changing from residential, commercial or vacant properties to commercial use. There are items that may not have specific Guideline numbers but the Commission may apply the generic criteria from the UDC. O’Donnell said he doesn’t recall the HARC changing the use of a property before applying the Guidelines before. Knight didn’t want to apply specific guidelines to a property that had not already been approved for a certain use. She stated the city issued an ordinance that allows this property to be rezoned to a special use, but that property has not been issued a Special Use Permit at this time. She thinks this an inappropriate use of this home. Motion by Knight to deny the Certificate of Design Compliance for change in use from residential to office, site design, signage and demolition of a garage at Montgomery Addition, Block 1, Lots 10 and 11, located at 1903 South Austin Avenue. Second by Moore. Motion is carried, CDC is denied, 4 – 0. O’Donnell says he thinks this puts the Commission in an odd position. Gonzalez says the ordinance passed that made this possible to be considered, and then City Council asks the Commission to ignore everything they are here to do. Knight says she agrees. If they already had a Special Use Permit and this it (CDC application) was in front of the commission, then they would have to consider the Guidelines. 5.Consideration and possible action on a request for a Certificate of Design Compliance to remove a structure at City of Georgetown, Block 9, Lots 5-6, and 7-8 (W/PTS), located at 215 West 3rd. (CDC-2008-016) Wyler read the caption, presented the staff report and listed the guidelines that apply to this application. The structure is classified as a Medium Priority Structure according to the 1984 Georgetown Historic Survey. Recently, the property owner gave the applicant permission to move the structure from the property so that it could be relocated to Liberty Hill for renovation purposes. He reported the applicant said she was unaware that HARC approval was required and began the preparations for the relocation. Subsequently, the applicant was advised of the City’s process for building relocations in the Downtown Overlay District. The house currently sits on lifters in preparation for moving. All further preparations for removal have been stopped until HARC approval is given. The windows are boarded up and a portion of the structure was removed to allow for safe transport. Before the moving preparations took place, the structure was falling apart and in dire need of renovation. The applicant proposes moving the structure to Liberty Hill , Texas so that it can be renovated on her property and given another chance at becoming a livable structure. She stated to staff that the owner has no intentions of renovating the structure and she wanted to move the house before it was considered a “Dangerous Building”. If it is deemed “Dangerous” the City of Georgetown Inspection Services will require its removal. Wyler went on to report a moving route has been approved by the Georgetown Police Department. The Code Enforcement Department stated they had no jurisdiction on the maintenance of historic structures. Wyler also noted the Section in the UDC that states the Historic District Planner and the Building Official have guidelines to use to address the issue of neglect of historic structures. This gives Code Enforcement the authority to enforce the guidelines. However, since this building has been neglected to date and in an effort to save the structure, staff recommends approval of the CDC to allow the structure to be removed from the property. Motion by Johnson recommending approval of the CDC for removal as recommended by staff. Second by Moore. The Commission discussed the application of the section of the UDC that can be applied to structures in the Downtown Overlay Districts to address neglect of historic structures. Knight requested a letter be sent to property owners informing them of the ordinance and the new enforcement and the need for them to maintain their property. Question called. Staff recommends approval of the CDC for the Master Sign Plan as proposed in the applicant’s detailed guidelines with the minor amendment. The applicant should be allowed to cover no more than 30% of any glass panel for the first floor window signage and that window signage for Monument Cafe should be limited to the entrance doors and adjacent entrance windows. In addition, only the first floor windows should have the option for signage. Secondly, all tenant signs (including window signs) for the property must be approved by both the property owner and city staff before being installed. An administrative letter of approval from the city for each tenant should be provided prior to obtaining a Sign Permit. Commissioner Gonzalez questioned the use of the neon sign. The applicant, Gordan Baker, explained that they would like to relocate and use the existing Monument neon sign to the new location. There was a discussion of the use of neon in the downtown area. (CDC-2008-009 & CDC-2008-010) Wyler presented the summary staff report. The applicant is seeking Certificate of Design Compliance approval to move a Medium Priority house, based on the Historic Resource Survey, from 1009 Church Street to 706 College Street where it will be joined with an existing house. In addition, the applicant is seeking Certificate of Design Compliance approval to change the use of the Wesleyan Retirement Home, a parking lot, and a house; to renovate the exterior of the retirement building along with some site modifications to give it a more appealing look for the planned office use. The applicant is proposing to add Lymestone (a limestone looking veneer) to the first floor of the building, tint the windows, add new parking in the rear of the building which he proposes will save the large pecan trees in the front of the building, add new awnings and side driveway, and install diagonal parking and street lighting on 11th Street. The Comprehensive Plan Amendment and Rezoning applications are scheduled to go to the Planning and Zoning Commission the following week . Wyler introduced Lee McIntosh, the applicant. Wyler stated Mr. McIntosh has an alternative plan to suggest to the Commission based on the opposition that has been received by the City and himself. Mr. McIntosh stated he felt like he was doing the right thing by preserving the house through relocation. His new idea is a redesigned parking plan, which he could do with moving the existing house to the north side of the existing lot and put it in service as a single-family home. He stated he was prepared to withdraw the 7th Street application at this time. The Chair questioned whether the HARC could change the CDC application . Cook explained that the parcels are the same and notifications had been made so HARC has the authority to negotiate the application. HARC has many options to consider including, reducing the number of required parking spaces, using shared parking on 11th , Myrtle or Church Streets, reduction of the requirements, etc. HARC is not allowed to change the zoning of a structure or make a Comprehensive Plan Amendment, those must go through Planning and Zoning and City Council. Mr. McIntosh stated that this complex will be Class A offices and that the staff in those offices won’t need all the parking initially, but experience tells that in two to three years of completion of the project, he will need 180 – 200 parking spaces. A solution will have to be found or the use and success of the remodeling of this building will be limited. Chair O’Donnell opened the floor for the public comments. Each speaker was given three minutes to share their opinion. Ross Hunter, 908 Walnut Street – Mr. Hunter expressed opposition to the application stating that Georgetown’s value is based on history and by reducing the historical structures’ value, he would be affecting the neighboring property values. Janis Shields, 1002 Elm – Ms. Shields wants the developer to use the existing parking that she says is underutilized at present. She is concerned about a previous building that the developer remodeled not being finished by the developer according to the approved CDC plans. Ellen Davis, 405 E. 10th Street – Ms. Davis expressed concerns about increased traffic generated by this new development. Carol and Larry Rooke, 1001 S. Church Street – Ms. Rooke explained that they have remodeled an historic house immediately next door to the one in question and they do not believe a house in Old Town should be allowed to be destroyed for profit . She stated that everyone should work to stop the decay of downtown because people do not want to come to Georgetown to see commercial buildings; they come for the historic homes. Renée Hanson, Barbara Moyer, 1252 S. Austin Ave. – Ms. Hanson representing the Heart of Downtown wants to preserve the boundaries of the Downtown Overlay in keeping with the vision of the Downtown Master Plan. She stated she felt HARC will set a precedent here. She stated the downtown area is valuable and has the ambience of a heritage that has been written about in many articles. She opposed the application and asked that an alternative parking plan be allowed that would leave the house where it stands. Michele Ledebohm, 1004 S. Church St. – Ms. Ledebohm brought and presented petitions from the neighborhood, in opposition of this development. She wants the HARC to help preserve the heritage and character of the town, not just the Square and to recognize the historical value of these houses. (Petitions and letters placed on permanent record.) Robert Phipps, 1404 Elm St. - Mr. Phipps applauded Mr. McIntosh for developing the Wesleyan as an alternative use, but stated attaching the old house to the new house on College Street is appalling. He suggested using the front of the Wesleyan Building for parking as an alternative to moving the house. Rick Williamson, 204 Holly St. – Mr. Williamson wants to emphasize the same sentiments as the others, not wanting to “chip away” at downtown . Chair O’Donnell thanked everyone for coming forward and addressing the Commission. The Commissioners debated several options and thoughts . Commissioner Johnson explained that the church that owns the parking lot that could be used as alternative parking, would lose its non-taxable status on that property if it allowed the property to be used during the week by Mr. McIntosh’s tenants. Mr. McIntosh also stated that he needs to own at least 70% of the parking “fee simple” to sell or lease his property in the future. O’Donnell asked about the denial procedure. Cook explained that the applicant has 175 days if the HARC denies the application for moving the house, delaying the action for negotiations, then the applicant receives an automatic approval from HARC which allows the original action. Discussion of parking alternatives. Motion by Gonzalez to postpone relocation of house until the next HARC meeting of April 24, 2008, after Planning and Zoning and City Council have met and reviewed this. Second by Knight. Mr. McIntosh says he would like to move forward with discussions to figure out an alternative plan because he wants to act in good faith with the city. He does not want to hold the house “hostage”. He reminds the Commission that the Guidelines do not protect historic structures after 175 days. Motion restated. Approved 6 – 0. Motion by Knight to approve alternative parking plan utilizing the nonconforming parking use as suggested by staff. Second by Gonzalez. Amended by Johnson to suggest the applicant and City work with the church for possible parking solutions. Second by Gonzalez. Commissioner Short says he understands based on experience, that keeping non-conforming use of the parking lot and the single-family house ensures it can not be changed to another commercial use and that he is empathetic to the surrounding homeowners. Vote on amended and original motion, approved 6 – 0. Commission took a 5 minute break. Wyler updated the Commission on the monument sign application. The applicant is proposing a new monument sign in the same place as the existing. Since there are not any details designed yet, Wyler is recommending that the proposed monument sign’s design along with the surrounding landscaping be reviewed by staff before a sign permit is granted, so that an administrative approval may be given. Wyler also asked that extra lighting be approved for illuminating trees on the property. Motion by Johnson to approve the staff recommendation for the monument sign CDC, with the final approval of content on the monument sign to approved administratively, and with landscape lighting of the sign. Second by Gonzalez. Approved 6 – 0. Motion by Knight to approve the site modifications as shown on the application, with the exception of parking in the rear which should be negotiated with staff, and including staff authority to make changes north of 11th Street. No second of this motion. Discussion of action of Commission. Motion by Knight to approve all the site modifications as presented from 11th Street south and the non-conforming parking lot and giving staff authority to make minor modifications of this plan. Second by Johnson. Approved 6 – 0. Wyler gave an update of the proposed facade changes. The applicant is proposing to powerwash the brick, put a bronze tint on the windows, placing the Lymestone on the first floor, awnings on the front and back of the building, removing large louvers on the side of the building, and placing lights under the trees. Discussion of the look of all the materials together and the removal of the shutters. Austin Avenue. (CDC-2007-045) Motion by Gonzalez to approve the minutes of the December 13, 2007 meeting. The other items of the consent agenda were approved at the previous Sign Subcommittee Meeting. Second by Chapman. Approved 7 – 0. Regular Agenda: 6.Consideration and possible action on a request for an amendment for a previously approved Certificate of Design Compliance at City of Georgetown, Block 41, Lot 1(PT), located at 700 S. Austin Avenue. (CDC-2007-042) Wyler presented the application for amendment of the previous CDC. The applicant made several changes in constructing the building and is proposing to remedy some of the items. Some of the items are too costly after being constructed another way, or were constructed based on building permit code issues. Main features that were not constructed as to plan and CDC approval were the number and size of windows, the front facade was faced with a stucco finish instead of a brick finish, and keystones were not installed on the windows. The applicant is proposing to install keystones above the second floor windows on both Austin Avenue and 7th Street, but not on the first floor windows beneath the awnings. The wood trim that is installed on the front of the building and around the windows will be painted black. Shutters will be installed on second floor windows and will be painted black to match the existing shutters. Dentil molding will be put in above the 7th Street entrance and a black, wrought iron railing will be installed along the 7th Street ramp. The applicant/owner, Steve Quenan was available for a report on the progress of the construction. He stated the shutters had been made and the painter picked those up the week before and was painting them before installation. The dentil moldings were being installed . The trim pieces were to be constructed the following week. He questioned whether to install an awning over the 7th Street entrance. The Commission debated and decided the original application for CDC did not include that awning. If Mr. Quenan determines that another awning is needed, he will return to the Commission for further approval. Chair O’Donnell questioned the possibility of faux brick on the front facade of the building, since brick was originally approved. Mr. Quenan stated he investigated the brick facing and found it was cost prohibitive and the installer had stated the brick facing would not stick well to the existing stucco. Mr. Quenan stated that there just wasn’t enough existing brick left over from the renovation to install on the front of the building. The Commission agreed that the aesthetics of the lack of brick on the front facade was disappointing and that brick had been approved. Motion by Gonzalez to approve the change in the front building facade to be stucco face instead of brick. Second by Knight. Jack Hockmeister of 704 S. Austin Ave, next door to the Quenan’s building, asked to speak. He presented pictures of the building in question from around the turn of the century in which the facade was stucco. Chair O’Donnell thanked the guest for speaking and bringing this forward. The Vote was called for previous motion. Approved 5 – 1. (Chair did not vote.) Motion by Knight to approve the amended CDC as recommended by staff and as presented in the staff report attached to the agenda. Second by Gonzalez. Approved 6 – 0. Comments, questions and general discussion from Commission and /or staff and reminder of the next meeting of the Commission on February 28, 2008. Knight wanted to address the new practice of applicants placing a website address on a sign face. She didn’t necessarily think that was appropriate in a historic district. Gonzalez stated the Commission is not allowed to dictate what is or isn’t placed on a sign as long as it’s not vulgar or inappropriate. Wyler mentioned that the Design Guidelines would be up for review soon, he is working on a schedule and the process that would be followed , and this issue can be addressed during those discussions. Knight indicated there are already several items on a list that need to be addressed. Damon stated he would like to see an interim approval of some sort for developers seeking financing for their projects. He indicated developers need to have basics approved, whether at a concept level, or whatever is described, that would allow the developer to take the approval to the bank. There was discussion about what constitutes “approval” and the different levels of such. Knight expressed concern about staff follow-up and inspections after a CDC is issued. Wyler stated that is definitely being addressed by him doing regular inspections of all projects downtown, and regular contact with owners /developers.
