Council Members Present: Mike McMaster George Arroyos Winfred Bonner Doris Curl Ferd Tonn Dick Vincent Staff Present: Bob Hart, City Manager Marianne Banks, City Attorney Council Members Absent: Sandra Lee, City Secretary Cari Speegle, Deputy City Secretary Ed Barry, Director of Development Services Jane Voltz Hildy Kingma, Chief Planner Clyde von Rosenberg, Chief Planner Mark Birchard, Animal Services Supervisor Kevin Stofle, Police Division Commander Terry Jones, Director of Purchasing Hartley Sappington, Director of Community Services Susan Morgan, Director of Finance Bill Shanklin, Fire Chief Jim Briggs, Director of Community Owned Utilities Randy Morrow, Director of Parks and Recreation Workshop -Called to order 5:30 p.m. A Review proposed animal control ordinance Sappington and Birchard discussed the new animal control ordinance. Mayor Wood asked if we can encourage state legislation for hybrid wolves since they cannot be vaccinated against rabies. Birchard will find out more information on this subject. Pastor Johnson expressed his opinion to Council regarding cats. He feeds several cats but does not own the cats and cannot afford to have them spay and neutered. Birchard will contact Johnson and help him solve the problem. Curl commented that she feels this is a very good ordinance. City Council Minutes/February 28, 1995 Page 1 of 8 Pages Reception for Universitat Osnabruck Students/approximately 6:30 p.m. Mayor Wood welcomed the students to Georgetown and presented proclamations and "Friendly Service, Georgetown Style" koozies to each student. Public Hearing - Called to order at 7:00 p.m. B Annexation of: (1) approximately 227.12 acres from the existing City limit boundary adjacent to Cedar Breaks Road northwest along FM2338 to the southeastern boundary of the Casa Loma subdivision; and (2) Phase I of Sun City Georgetown (983.335 acres) von Rosenberg explained that this is the last of two public hearing regarding this annexation. There was one question from the audience regarding what would be the next action. von Rosenberg stated that the first reading of the ordinance annexing this land will be held on March 28th and the second reading on April 11th 7:05 p.m. Public Hearing Closed Regular Session - Called to order at 7:05 p.m. Consent Agenda C Approval of meeting minutes --Regular Meeting of February 14, 1995/Sandra Lee D Approval of a resolution to authorize a license to encroach into the platted public utility located along the east side property line of Lot 8, Block 7, Serenada East Subdivisic located at 4007 Luna Trail/Ed Barry and Hildy Kingma E Pulled (see regular agenda) F Approval of a resolution authorizing the City Attorney to issue a quit claim deed tc abandoning the platted Public Utility Easement (PUE's) located along the common prof of Lots 17, 18, and 19, Block F, Resubdivision of Riverview Estates/Ed Barry and Hildl G Approval of engineering contracts with Roming-Parker Associates for work involved with downtown street renovations and Tri -Track wastewater improvements/Jim Briggs H Approval of a resolution to amend the contract with Longhorn Disposal, Inc., to implement a monthly bulky waste pick-up program/Hartley Sappington I Award of bid for padmount transformers to KBS Electric in the amount of $15,064 and to Temple Inc. in the amount of $26,235/Jim Briggs and Terry Jones J Pulled (see regular agenda) City Council Minutes/February 28, 1995 Page 2 of 8 Pages K Pulled (see regular agenda) Motion by Tonn, second by Vincent to approve the Consent Agenda with the exception of Items E, J, and K. Approved 6-0. E Approval of a short form final plat of P. W. Properties a 6.1763 acre tract in the Clement Stubblefield Survey; and ratification of the Commission's approval of requested variances to the Subdivision Regulations/ Ed Barry and Hildy Kingma Curl asked if the process is complete and is everything satisfied on the plat. Kingma stated that the plat still needs to be revised to show the 20 foot public utility easement and that this will be done before the plat is recorded. Motion by Curl, second by Tonn to approve the short form final plat. Approved 6-0. J Award of bid for antique style light poles to Dealers Electric in the amount of $58,764/Jim Briggs and Terry Jones McMaster asked if there were any less expensive antique style light poles available. Briggs stated that there are no less expensive poles that meet the State Department of Transportation guidelines. There would be no charge for the standard light poles and the state will not allow us to pay the difference between standard poles and antique style poles. Curl stated that she is very frustrated with the state because they would not work with the City on this and other issues. Motion by McMaster, second by Tonn to have the state install the standard light poles and reject the bid for antique style light poles. Approved 6-0. K Declaration of K-9 animal as surplus property and approval to sell in the amount of $833.33/Susan Morgan and Terry Jones McMaster asked if this is the only K-9 animal we have. Hart responded that yes it is and we would need to purchase a new animal if we decided to return to the K-9 business. The handler is leaving the Police Department and wants to purchase the animal. The animal's useful life has only 1 year left and it takes 1 1/2 years to train a new dog. Mayor Wood asked if the school had been notified. Stofle responded that no this had come up very suddenly, but he would contact them in the next few days. McMaster asked how this price was determined. Stofle stated that the original price was divided by the useful life of the animal. City Council Minutes/February 28, 1995 Page 3 of 8 Pages Arroyos asked what we would do if we need K-9 services. Stofle responded that we can contact other sources and the City of Austin is available and probably at no charge. Motion by McMaster, second by Curl to approve to sell the K-9 animal and to discuss this issue at the budget retreat. Approved 6-0. L Citizens wishing to address the Council David Arnold expressed his appreciation to Council for writing the ordinance regarding the problem with cats. Charles Steger, of Steger and Bizzell Engineering, Inc, told the Council that the City of Taylor had filled a law suit against his company and the district court had ruled in his favor. Since the suit filled by the City of Taylor he has not received any work from the City of Georgetown. Steger would appreciate any business from the City. Arroyos asked Steger if his company had done the work during the San Jose grant. Steger replied that he had not. M Mayor, Council, City Manager and staff comments and reports ® CAFR Award - Hart commended the Finance Division for receiving the Government Finance Officers award. This is the sixth year the City has recevied this award. ® Mayor Wood read a letter from Joe Saegert thanking the Council and staff for flowers sent to his wive's funeral and for all the support during this time. N Second Reading of an ordinance amending Exhibit 1 of the Century Plan - Development Plan for the 30 acre River Hills, Section One, Block A, Lots 16 and 17, and Section Two, from Intensity Levels Two and Five to Intensity Levels Three, Four, and Five/Ed Barry and Clyde von Rosenberg von Rosenberg read the caption. Motion by McMaster second by Tonn to approve Ordinance 95-06 on second reading. Approved 6-0. O Second reading of an ordinance amendment to modify the solid waste disposal rate regarding the implementation of the monthly bulky waste pick-up program/Hartley Sappington Sappington read the caption. Motion by Curl, second by Vincent to approve Ordinance 95-07 on second reading. Approved 6-0. P Approval of a resolution calling a General Election to be held on May 6, 1995; ordering a runoff election, if necessary, and establishing procedures for said election/Sandra Lee Lee presented the resolution. Lee stated that the school district will not provide clerks at City Hall. Mayor Wood asked Tonn and Curl to make this issue a high priority for next year when meeting with GISD. Motion by McMaster, second by Tonn to approve the resolution calling the General Election. Approved 6-0. Q Approval of preliminary plat of Sun City Georgetown, Phase I, a 983.539 acre tract in the W. Roberts, M. Lewis, L. Russell, A. Short, G. Thompson, W. Wilkerson and D. Monroe Surveys/Ed Barry and Hildy Kingma Kingma explained the preliminary plat. Motion by Tonn, second by McMaster to approve the preliminary plat of Sun City Georgetown, Approved 6-0. R Approval of a short form final plat of Goree Addition, a 7,468 square foot parcel in the Snyder Addition, Block 31; and ratification of requested variances to Subdivision Regulations/Ed Barry and Hildy Kingma Kingma presented the plat. Motion by Tonn, seconded by Curl to approve the short form final plat of Goree Addition. Approved 6-0. S First reading of an ordinance providing for the annexation of (1) a property owned by Pottery and More, Inc. and located at the southeast corner of Westinghouse Road and IH35; and (2) a property owned by Claris Shell and Stephen Shell, known as Katy Crossing, and located south of FM971 near its intersection with CR151A/Ed Barry and Clyde von Rosenberg von Rosenberg presented the ordinance. Motion by McMaster, second by Tonn to approve on first reading. Approved 6-0. T First reading of an ordinance rezoning a 108 acre parcel in the Antonio Flores Survey to be known as Katy Crossing Subdivision, from A, Agricultural to RP, Residential Planned and RM -2, Dense Multifamily Residential and a waiver of rezoning fees/Ed Barry and Hildy Kingma Kingma presented the ordinance. Motion by McMaster, second by Tonn to approve on first reading. Approved 6-0. U First reading of an ordinance repealing existing animal control ordinances and adopting new animal control ordinances covering definitions and penalties, licenses and permits, animal and livestock impoundment and adoption, animal bites, care and nuisances, and dangerous, wild and exotic animals/Hartley Sappington Sappington presented the ordinance City Council Minutes/February 28, 1995 Page 5 of 8 Pages Jimmy Redwine addressed the Council. Redwine's son operates a wholesale business raising non -venomous snakes. This business has no retail and these snakes are not pets. Redwine asked the Council for clarification on how this proposed ordinance would affect his son's business. Banks stated that there are no provisions for grandfathering in the ordinance. Hart suggested that wholesale breeding provisions be added to the proposed ordinance. Motion by McMaster, second by Curl to approve first reading of the ordinance with the provision that the staff work on getting a way to legalize the wholesale business for Mr. Redwine's son. Approved 5-1. Bonner opposed. 8:10 p.m. - Recessed 8:24 p.m. - Reconvened V Consider allocation of $5,000.00 from Council Contingency for the construction of a picnic pavilion at Chitauqua Park and to name the picnic area in honor of Edna Powell/Bob Hart McMaster stated that he had talked to Mrs. Powell and she stated she would be honored to have the picnic area named in her honor. A bronze plaque will be placed at the picnic area. Motion by McMaster, second by Bonner to approve. Approved 6-0. Bonner will contact Mrs. Powell and inform her of this action. W Formal adoption of a program for the review and completion of the Historic Preservation and Urban Design Plan/Bob Hart Hart stated this item is returning to Council because of concern regarding how it was posted on the last agenda. Curl stated that she and Voltz were pulling their recommendations on the plan because of no consensus within the Council or the Community. Mayor Wood thanked Curl, Voltz and the committee for the work done on this plan. Mayor Wood recognized Nelda Burson who stated that she agrees with a statement made earlier by Curl that Georgetown is a nice looking City and she would like for it to continue to look nice. Burson read a letter that she had written to Council about 3 months ago which stated that she feels homeowners should have the right to live, plan and decorate their homes as they desire Renee Hanson addressed the Council and requested that a representative from the Heart of Georgetown Neighborhood Association be appointed to the new HPUD Committee City Council Minutes/February 28, 1995 Page 6 of 8 Pages Mayor Wood requested that interested citizens provide comments back to Hart within 60 days regarding this issue. Citizens interested in serving on a new committee should submit applications to Hart. Motion by McMaster, second by Vincent that this item be discussed at the Council retreat in June instead of proceeding as Council directed at their meeting of February 14, (which was to adopt a process for completion of the HPUD plan and schedule a workshop) Approved 6-0.
