Members Present, Acting-Chair; Richard Glasco; Chris Aadnesen; Audrey McDonald; Robert Seamans; and John Kirby. Linda Turner was absent from the meeting. Alternates present were Johnny Anderson, (who sat in for Linda Turner), Harry Gibbs, and Jennifer D. Shield. Staff Present: Amelia Sondgeroth, Director of Planning & Development Services; Bobby Ray, Chief Current Planner; David Munk, Development Engineer; Melissa McCollum, Development Planner; Patricia Carls, City Attorney; and Tammye Sharpe, Recording Secretary. Regular Session – Meeting began at 6:02 p.m.  Jennifer Shield was sworn in as an Alternate to replace Jeff Vercolen. Alternate Jennifer Shield sat in to vote. (Commission may, at any time, recess the Regular Session to convene an Executive Session at the request of the Chair, a Commissioner, the Director or legal counsel for any purpose authorized by the Open Meetings Act, Texas Government Code Chapter 551.) 1. Action from Executive Session – No executive session. Consent Agenda 2. Consideration of the Minutes of the June 4, 2002, Regular Meeting of the Planning and Zoning Commission. 3. Consideration and possible action on Public Hearing for a Public Review Final Plat for 18.850 acres out of the Frederick Foy Survey, to be known as Sun City Georgetown, Neighborhood 16-3, and located on Sun City Boulevard. 4. Consideration and possible action on Public Hearing for a Public Review Final Plat of 12.39 acres out of the William Addison Survey, to be known as University Park, Unit Two, Section 1, Phase B, located on the East side of Southwestern Boulevard. 5. Consideration and possible action on Public Hearing for Vacation of a subdivision named Windridge Village, being 10.985 acres out of the William Addison Survey, as recorded in Cabinet J, Slides 62 - 63, of the Official Plat Records of Williamson County, Texas, located east of the intersection of Holly and 3rd Streets. 6. Consideration and possible action on Public Hearing for a Public Review Final Plat for 3.123 acres, more or less, out of the Nicholas Porter Survey, to be known as Ryan’s Cove, located at the intersection of Janis Drive and Northwest Boulevard. Robert Seamans made the motion to approve the consent agenda as is. Audrey McDonald seconded the motion, which passed with a vote of 7-0. Regular Agenda 7. Consideration and possible action on Public Hearing Rezoning a total of 18.850 acres, more or less, out of the Frederick Foy Survey, being 4.536 acres, more or less, from A, Agricultural to RP, Residential Planned, or more restrictive district, and 14.314 acres, more or less, from RP, Residential Planned, to RP, Residential Planned with a revised site plan, or more restrictive district, to be known as Sun City Georgetown, Neighborhood 16-3, and located on Sun City Boulevard. Melissa Murphy presented the staff report. Todd Janssen from Dell Webb was present to answer questions. Kirby asked who maintains the common areas in Sun City. Janssen said that the Community Association maintains the common areas, and that the Association is mandatory. Aadnesen made the motion to recommend to City Council to approve the rezoning of a total of 18.850 acres, more or less, out of the Frederick Foy Survey, being 4.536 acres, more or less, from A, Agricultural to RP, Residential Planned, or more restrictive district, and 14.314 acres, more or less, from RP, Residential Planned to RP, Residential Planned with a revised site plan, or more restrictive district, to be known as Sun City Georgetown, Neighborhood 16-3, and located on Sun City Boulevard. McDonald seconded the motion, which passed with a vote of 7-0. 8. Consideration and possible action on Public Hearing for a Rezoning of .251 acres, out of the Lost Addition, Block 66, from RP, Residential Planned to RM-3, Office & Service Use, or more restrictive district, located at 1112 Rock Street. Bobby Ray presented the staff report, and concluded that staff was in favor of the rezoning. Johnny Anderson asked about the one opposing letter with no comment sent in from the neighbor on the southwest corner (1102 Rock Street). David Harris, with C&D Design Team, passed out information for the Commissioners to look at concerning the revisions to the site plan and configuration to the parking lot, which were made for safety reasons. Harris gave his presentation, stating that the site plan was different in that it had different ingress and egress, the garage was removed, and that the changes to the design, such as adding windows for light, and the addition of the safety railing, were approved by HARC. John Kirby made the motion to recommend to the City Council to approve the rezoning of .251 acres out of the Lost Addition, Block 66, from RP, Residential Planned to RM-3, Office & Service Use, or more restrictive district, located at 1112 Rock Street. Seamans seconded the motion, which passed with a vote of 7-0. 9. Consideration and possible action on Public Hearing for a Rezoning of 1.044 acres, described as Block B of the South San Gabriel Urban Renewal Tract and .45 acres, described as Lot 1, Block C of the South San Gabriel Urban Renewal Tract from RM-2, Dense Multi-Family District to C-1, Local Commercial District, or more restrictive district, located on the south side of West University Avenue (SH29) between Scenic Drive and Railroad Street to be known as Wendy’s Restaurant; and, Approval of access from both Scenic Drive and Railroad Street. Bobby Ray presented the staff report, and made correction to the report by stating that Scenic Drive is the higher classification, instead of Railroad Street. Vana Proffitt, with The Wallace Group, gave her presentation in favor of the new Wendy’s. Glasco was concerned about the Exhibit C, and got clarification that the entrance and exit from Wendy’s is from Railroad and Scenic. CITIZENS CONCERNS Ronald Swain, 103 Diamond Trail, & TRG Neighborhood Association president, was concern about traffic load and safety of children, along with noise - the quality of life would be affected. John Sandford, with Commercial Pisces Food Stores, did not know what time of operation the store would decide on (dining room until 10:00 p.m., 11:00 or 12:00, drive-thru-. Sandford said that there were 26 stores, and that they had plans for wanting 2 stores here in Georgetown; one on the west and one of the east. PauletteTaylor, Georgetown resident, was concerned about safety on Railroad (excess speed, no speed bumps, lots of feeder streets, apartment complex people walking, and her concern of the whole neighborhood being compressed with rezoning at one end (Caring Place) and the other side with the proposed Wendy’s. Taylor asked if there was a traffic study done for the site. Seamans proposed a 6’ sidewalk all the way around the site to handle the pedestrian traffic. Jean Jackson, Georgetown resident, was concerned with the traffic, with a backup on IH35, and would like to see if we could find another place to put the Wendy’s. Carolyn Liverman, 1402 Forest Street, was concerned with traffic now that the school year has started up, and also with the neighborhood’s taxes going up. Herb Fulton, local businessman, was concerned with traffic on Railroad and University Street, and safety of children crossing the street. George Rzepniewski, Wendy’s applicant, stated he would try and make sure egress & ingress was not more of a problem than it already was. Anderson, asked how many people would enter and leave Wendy’s during the lunch hour, to which Rzepniewski answered around 300 to 400 cars from 11:00 to 2:00. Gabe Sansing, 1805 Westwood Lane, likes the design, but does not the locale. COMMISSIONER’S CONCERNS Seamans asked about the landscaping plan for sound and lighting for the neighbors to the south of the site. Kirby was also concerned about the intensity of the lights and locations they would be on the site so as to screen them from the neighbors. Seamans asked the city engineer, David Munk, about having an entrance off University Avenue and then people could go to the Scenic Loop (light) to cross street, which might protect the neighborhood and help with the traffic problem. Shield brought up the issue of speed bumps, to which Sondgeroth said that there is no rule regarding speed bumps especially with the hospital near. Kirby made the suggestion of moving the light from Scenic and University to University and Railroad. Aadnesen made the motion to recommend to City Council to deny the motion for a rezoning of 1.044 acres, described as Block B of the South San Gabriel Urban Renewal Tract and .45 of an acre, described as Lot 1, Block C of the South San Gabriel urban renewal tract from RM-2, Dense Multi-Family District to C-1, Local Commercial District, or more restrictive district, located on the south side of West University Avenue (SH29) between Scenic Drive and Railroad Street to be known as Wendy’s Restaurant; and denial of access from both Scenic Drive and Railroad Street. Seamans seconded the motion, which passed with a vote of 7-0. 10. Staff comments and reports. a. Council Action update. Melissa Murphy McCollum had no update at this time for the Commissioners. It was decided that the staff would be bringing only the reports forward that were not consistent with how the City Council handled them. b. Director’s report Amelia Sondgeroth gave the Commissioners an update on the UDC. Discussion. Kirby asked about the homeowners association and if it was still on the agenda for discussion. Trish Carls, City Attorney, said that she would be looking into obtaining more information on the homeowners questions, and will share the information at the next meeting. 11. Commissioners comments and reports None. Motion by Aadnesen to adjourn. Second by Seamans. Motion passed unanimously. Meeting was adjourned at 7:42 p.m.
