Marjorie Herbert, Chair, called the April 2, 2002, Planning and Zoning meeting to order at 7:00 p.m. Other members present were Audrey McDonald, Richard Glasco, Gabe Sansing, Robert Seamans and Chris Aadnesen. Alternates, Johnny Anderson and Linda Turner were present, also. Staff present were Amelia Sondgeroth, Director, David Munk, Development Engineer, Carla Benton, Development Planner, and Tammye Sharpe, Staff Recorder. 1. Action from Executive Session - None On the Consent Agenda. 2. Consideration of Minutes of the April 2, 2002, Planning and Zoning Commission Meeting. Richard Glasco made the motion to approve the consent agenda as is. Gabe Sansing seconded the motion, which passed with a vote of 6-0. On the Regular Agenda 3. Consideration and possible action on a Public Hearing for a Record Final Plat of The Rivery, Phase One, being 125.34 acres of the Rivery Subdivision, Lot 1, and a portion of Lot 1, River Hills, Section 4, located on Rivery Boulevard, with variances to the Subdivision Regulations. Carla Benton gave the staff report. Seamans asked what amount and kind of landscaping there was going to be behind the stores. Benton said that there would be a stream of walls, and would prevent anyone seeing the backs of the stores. Benton stated that the Detailed Development Plan was being processed and the landscaping was included in the plan. Sondgeroth said the landscaping had already been submitted and had to be consistent with the Master Landscape Plan that had been approved by Council. Sondgeroth went on to say there was a screening wall, and that the applicant could be able to answer any questions. John Nowell, with Urban Design Group, said that the screen walls are 6’ – 8’, and there is a substantial amount of planting all around, and the stores are lower than grade, too. Nowell said that there was great care taken to cover the backside of the stores that received all the deliveries and the dumpsters. Sondgeroth added that by ordinance there was a requirement to screen loading areas and dumpsters. Sansing made the motion to recommend to City Council to approve this request, and the finding of facts were read. Herbert confirmed that all the technical issues were met. Aadnesen seconded the motion, which passed with a vote of 7-0. 4. Consideration and possible action on a Public Hearing for a Rezoning from RM-2, Dense Multi- Family, to C-1, Local Commercial, or more restrictive district, for the City of Georgetown, Division A, Outlot 46, (1.9246 acres), located at 1904 Railroad, with a strong recommendation that access be only on Railroad Street. Benton gave the staff report. Glasco asked if there were any height differences or restrictions from RM-3 to C-1. Benton said that there were not. Glasco asked where the drive would be. Benton said that 19th street was the designated access street. Seamans questioned if 19th street was adequate enough for the traffic. Benton said that legal council had recommended that staff not connect the improvements with the rezoning - that staff does not establish street improvements with rezoning. Sondgeroth stated that the question here for the P&Z Meeting April 22, 2002 Page 2 Commission was if the zoning was appropriate for the land use. Herbert said that she has not heard any public comment, and wanted to be assured that there had been proper notification of the surrounding property owners, and well as the notice. This was confirmed. Glasco asked that once the Detailed Development plan was done and the access street was designated, would the applicant have to come back before the Commissioners again. Benton said that the applicant would have to come back to the Commissioners for the approval of access that is not on the secondary street. Benton went on to say that if the applicants proposed to use 19th Street, no, but it is the staff's recommendation that they do come before the Commissioners to get approval to use Railroad Street. Glasco voiced his opinion that he was for the development, but was very much against the use of 19th Street as access street. Herbert made the motion to recommend to City Council to approve this request, with a strong recommendation that access to that site as it was being developed would be from Railroad Street, and not 19th Street. Sansing amended the motion by saying if legal approves, then applicant does not have to come to Planning and Zoning again. Glasco seconded the amended motion, which passed with a vote of 7-0. 5. Consideration and possible action on a Public Hearing for Rezoning from A, Agricultural, to RP, Residential Planned, with Detailed Development Plan, or more restrictive district, for 19.34 acres of 36.575 acres in the J. Berry Survey, to be known as Chisholm Park, Section Two, located at CR 152. Benton gave staff report. Benton explained that the Detailed Development Plan was part of the RP zoning - the RP zoning needs a site plan ( the one previously approved and attached). Seamans asked if there was any flooding in the area. Benton asked the Commissioners to look at Exhibit B, and pointed out that there was parkland, private and public – all the parkland was along the drainage area. Sansing asked what the street name would be. Tim Hunter, Corridor Engineering, did not know the street name. Aadnesen made the motion to recommend to City Council to approve this request. Seamans seconded the motion, which passed with a vote of 7-0. 6. Consideration and possible action on a Public Hearing for a Short Form Final Plat of a Resubdivision of Glasscock Addition, Block 34, part of Lots 1, 2, & and all of Lot 8, to create two legal lots to be known as the Ledbetter Addition, located at 505 E 5th Street, with variances to the Subdivision Regulations. Benton gave the staff report. Benton said that the variance requests were brought to the Commissioners to give clarity to what was being done, as they are usually taken care of administratively. Seamans confirmed that this was an old structure, and the request had not asked to encroach into something new. Sansing asked if the garage would be built where it was if it falls down. Herbert answered with a no, if the new Code passes, saying it would be considered a non-conforming structure. Sondgeroth stated that the New Development Code rear setback requirements are 10' instead of 20'. James Ledbetter, the applicant, remarked that his plans were to renovate the house during summer, and added that the existing shed would be brought down. The applicant assured the Commission he was going to keep the lot and house in good shape to reflect the Old Town flavor. Ledbetter said that he was planning other projects that would bring him before the Commissioners again. Seamans told Ledbetter that he did not have to have a request going before the Commissioners to attend a Planning and Zoning meeting. Sansing made the motion to recommend to City Council to approve this request, and read the Finding of Facts. Seamans seconded the motion, which passed with a vote of 7-0. 7. Consideration and possible action on a Public Hearing for Public Review Final Plat of 57.451 acres, out of the William Addison Survey and the Woodruff Stubblefield Survey, to be known as Meadows of Georgetown, located on CR 102, with variances to the Subdivision Regulations. P&Z Meeting April 22, 2002 Page 3 David Munk gave the staff report. Munk said that the applicant would meet the required 125' driveway separation along the collector level streets (Churchill Farms Drive and Indian Meadow Drive), and the Indian Meadow Drive cul-de-sac issue had been addressed by extending to the property to the west side of the project - it stubs out to that property, making the variance there no longer needed. Sansing asked what the latest was on the stop signs and traffic devices in Churchill Farms. Munk answered Georgetown Utility Systems along with Mark Miller, the Street Superintendent, were working on the issue. Munk said that the City had started a traffic study , required by City Council during the Concept Plan processing, to study Churchill Farms Drive and the undeveloped properties, and the road extension south of Churchill Farms Drive (the southeast quadrant). Seamans asked if Churchill Farms Drive would be going all the way to Southwestern Boulevard. Seamans said that there was too many stop signs on this drive. Munk said that Georgetown Utility Systems was looking at stop sign placement, and that the study would be the best way to see what was needed. Alternate Turner asked where the exits were on the plat. Munk explained the stub streets. Alternate Anderson asked with the new Unified Development Code if the 1.4 ratio links to nodes was a magic number or if the staff had calculated this. Songeroth said no, but staff would be. Chuck Carroll, with Cunningham-Allen, verified there were 3 tie-ins, construction would be able to have two access points, and that this was a Four Phase development. Carroll said that the issue of the driveways on the collector caused them to lose 3 lots, and with the use of joint access drives gave them the 125' spacing between the driveways. Cunningham also said, regarding the cul-de-sac length variance, that the cul-de-sac radius had been increased to 60'. Cunningham pointed out that 2.14 acres of the site was parkland dedication, with $40,000 given to park improvements, and that there was a right-of-way reserve from Hwy 130. Seamans asked if the right-of way was going to take away CR 102. Carroll said that from what he had heard, there would be access to State Hwy 130 from the subdivision. Herbert made the motion to recommend to City Council to approve this request. Munk verified that all the technical issues were met. Herbert read the Finding of Facts. The motion was seconded by John Kirby, which passed with a vote of 7-0. 8. Staff comments and reports a. Council Report. Carla Benton gave report. • Woodland Park, Phases 3A and 3B and the Revision of Parkwood Plaza were both passed with a vote of 6-0 by Council. • Variance to Crystal Knoll Terrance, Unit 3, Block B, Lot 87 was approved by a vote of 5-0. • Rezoning at 2nd and S. Austin Avenue for an office use approved at first reading by vote of 5-0 • Fabulous Cheesecakes & Gourmet rezoning on Rock St had first reading approved 5-0. • Rezoning for Brookview Apartment Homes at CR 151 was approved on first reading by 5-0. b. Director’s report. Amelia Sondgeroth gave her presentation of the reminder that the Planning Directors of Leander, Cedar Park, Round Rock & Georgetown are working to have a Workshop on Friday, June 7, 2002, for the Planning and Zoning Commissioners and the Council members. It will be held at the Heritage Center at the Dell Diamond, starting at noon. Sondgeroth said she would be getting information to the Commissioners before then, reserving the City Van and getting confirmation of who will be able to attend this Workshop. Audrey McDonald confirmed she would not be able to attend at this time. Marjorie Herbert confirmed her availability to attend. Herbert thanked the Alternates for being at the meeting.
