PLANNING AND ZONING COMMISSION
MINUTES
October 5, 1999
Chair, Claude Proctor, called the October 5, 1999, Planning and Zoning Commission meeting to order
at 6:05 p.m., and explained the meeting process. Other Commissioners present were: Charles
Parker, Patrick Walsh, Sarah Milburn, Cal Wilkerson and Robert Brannon. Leon Douglas was absent.
Staff members present were Ed Barry, Director, Art Rodriguez, Assistant City Attorney, Wendy Walsh,
Development Planner, Chris Stewart, Development Planner, David Munk, Development Engineer, Jim
Babcock, Development Technician and Janis Russell, Recording Secretary.
Consent Agenda
1. Consideration and possible action on the Minutes of the September 7, 1999, Planning and
Zoning Commission Meeting.
2. Consideration and possible action on a Rezoning of the Amended Plat of Dicotec Subdivision,
Lot 3, from A, Agricultural to C-1, Local Commercial, or any more restrictive district, located at
Williams Drive and Sequoia Spur.
3. Consideration and possible action on a Public Review Final Plat of 6.423 acres in the Ephraim
Evans Survey, to be known as Hewlett Subdivision, Section 2, Block B, Lot 1, located on the
IH-35 frontage road and Westinghouse Road, with possible Variances to the Subdivision
Regulations. This item was pulled until the November Planning and Zoning Commission
meeting at the request of the applicant.
4. Consideration and possible action on a Public Review Final Plat of 52.4628 acres of land out
of the Frederick Foy Survey, to be known as Woodland Park, Section 1A, located northeast of
the intersection of FM2338 and FM3405, with Variances to the Subdivision Regulations.
5. Consideration and possible action on a Public Review Final Plat of 21.67 acres in the William
Roberts Survey, to be known as The Woods at Berry Creek, Sections Two and Three, located
north of Brentwood Drive and Meadow Green Drive, with Variances to the Subdivision
Regulations.
Charles Parker made a motion to approve the Consent Agenda. Cal Wilkerson seconded the motion
which passed by a vote of 6-0.
Regular Agenda
6. Consideration and possible action on a Variance to the Subdivision Regulations for Churchill
Farms, Section 5, Block A, Lot 14, located at 152 Stonehedge Boulevard. Jim Babcock gave
the staff report and recommendation. Dan Austin, Drees Custom Home Builders, agent for the
applicant, addressed the Commission and stated that stone pillars had been built in error. Mike
Henry, Board member of the Churchill Farms Homeowners Association, addressed the
Commission and informed the Commission that the Homeowners Association supports the
variance request. After the discussion, Sarah Milburn made a motion to approve the requested
variance to Table 34020 and Section 34020 F.4. of the Subdivision Regulations for Churchill
Farms, Section Five, Block A, Lot 14 to allow a six foot privacy fence on the property line along
Reinhardt Boulevard, an encroachment of the entire 25 foot front yard setback, after making the

required findings of fact. Charles Parker seconded the motion which failed to pass by a vot e of
3-3. Sarah Milburn, Patrick Walsh and Charles Parker voted in favor and Cal Wilkerson,
Claude Proctor and Robert Brannon voted opposed. After extensive discussion, Patrick Walsh
made a motion to send the variance request to City Council without a recommendation from the
Planning and Zoning Commission. Robert Brannon seconded the motion which passed by a
vote of 6-0.
7. Consideration and possible action on a First Revised Concept Plan of 82.8658 acres in the
John Powell, Francis Hudson and Ephraim Evans Surveys, and Georgetown Gateway, Phase
A, Section I, to be known as Kelley Trust; Rezoning from A, Agricultural to C-2A, Commercial
First Height, or any more restrictive district and Public Review Final Plat of 27.24 acres in the
John Powell and Francis Hudson Surveys, to be known as Kelley Trust, Phases Two and
Three, located at the northeast corner of the IH-35 frontage road and Westinghouse Road, with
Variances to the Subdivision Regulations. David Munk gave the staff report and
recommendation. Jim Cummins, of Steger and Bizzell Engineering and agent for the
applicant, responded to questions from the Commission. Access points were discussed and it
was concluded that the separation between “A” Street and access point A could be between
300 to 400 feet, but not less than 300 feet. Sarah Milburn questioned the alignment of “B”
Street with Clearview Drive. She questioned notification of the residents living on Clearview
Dr. She was informed that all residents living with 200 feet of the property were notified by
letter, and a notification signs were posted on all street frontages. Ms. Milburn asked why the
streets had to be aligned. David Munk responded that the alignment would make for a
smoother flow of traffic, it would create the needed connectivity and car lights would not shine
into the windows of the residents on the corners of CR116 and Clearview Drive. John Wall,
adjacent property owner was asked to address the Commission regarding the notification. He
had received his letter and exhibit and showed it to the Commission. The exhibit sent to
surrounding property owners did not depict the connection from “B” Street to Clearview Drive.
Staff explained that the exhibit is taken from the initial submittal provided by the applicant with
the application. The exhibits do sometimes change between application and Planning and
Zoning Commission based on staff recommendations and discussions with the applicant.
Extensive discussion followed. After the lengthy discussion, Patrick Walsh made the follow ing
motion :
Approval of the First Revised Concept Plan of 82.8658 acres to be known as Kelley
Trust, provided the Technical Issues are addressed prior to City Council consideration;
Approval of the Rezoning from A, Agricultural to C-2A, Commercial First Height,
excluding mini-warehouse use, for 27.24 acres out of the John Powell and Francis
Hudson Surveys, to be known as Kelley Trust, Phases Two and Three;
Approval of the Public Review Final Plat of 27.24 acres to be known as Kelley Trust,
Phases Two and Three, provided the Technical Issues are addressed prior to City
Council consideration;
Denial of a variance to Section 34020 F.3. of the Subdivision Regulations to allow
access point B;
Approval of a variance to Section 34020 F.3. to allow access points A and C, provided
that the Texas Department of Transportation approves the access points;
Approval of a variance to Table 33030-A to allow the separation between “A” Street and
access point A to be between 300 to 400 feet, provided that the Texas Department of
Transportation approves the access points, after making the required findings of fact.

Charles Parker seconded the motion which passed by a vote of 5-1 (Sarah Milburn voted
opposed).
8. Commissioners' comments and reports. Urban Design update by Patrick Walsh. Claude
Proctor reminded the Commissioners of the Open Meetings Act meeting scheduled for Friday,
October 15th. Sarah Milburn informed the Commission that she had difficulty attending the
Historic Preservation Commission’s meeting. The next meeting is Oct. 28th at 6:30 p.m.
9. Staff comments and reports.
a. Council action update - Wendy Walsh updated the Commission.
b. Joint meeting with the Parks Board. Ed Barry reported that the City Council wants a
joint meeting in November and informed the Commission of another planning conference in
October.
With no further business, the meeting was adjourned at 8:20 p.m.
